Chapter 1. Introductory provisions

§ 1. Scope This regulation and its appendices shall apply:

A)
on Norwegian territory, including Norwegian airspace

B)
on board every aircraft or vessel under Norwegian jurisdiction

C)
to all Norwegian citizens wherever they are located

D)
to all legal persons, entities and bodies that have been established or incorporated under Norwegian law

E)
to all legal persons, entities and bodies with regard to business activities they are engaged wholly or partly in Norway.

§ 2. Definitions In this Regulation:

A)

Contract or transaction means any transaction of whatever form and whatever laws that are applicable, consisting of one or more contracts or similar obligations made between the same or different parties; for this purpose, the term "contract" bonds, guarantees and counter-guarantee, particularly financial guarantees and counter-guarantee, and any credit, whether legally independent of the contractual relationship or not, and any ancillary provision which has arisen pursuant to or in connection with the transaction | ||
B)

Assets assets of every kind, tangible or intangible, movable or immovable, which are not money, but that can be used to obtain cash, goods or services

C)

Freeze assets: to prevent the assets in any way be used to obtain cash, goods or services, including but not limited to, sell, rent or pledge them

D)

Money: financial assets and benefits of every kind, including but not limited to

I)
cash amount of money, checks, deposits, bills, statements and other payment instruments

Ii)
balances with financial institutions or in other entities, balances on accounts receivable and tilgodehavendebevis

Iii)
listed and unlisted financial instruments and debt instruments, including stocks and shares, securities certificates, bonds, promissory notes, purchase or subscription rights, unsecured securities and derivative

Iv)
interest, dividends and other income or assets incurred on or generated by assets

V)
credits, netting agreements, guarantees, performance bonds or other financial commitments

Vi)
letters of credit, bills of lading and mortgage deeds

Vii)
documents showing ownership in funds or financial resources

E)

Freezing of money: to prevent moving, transfer, alteration, or use of, access to, or handling money in any way that may lead to changes in volume, amount, location, ownership, possession, character or purpose or other changes that may make it possible to use the money, including portfolio management

F)


Goods originating in Crimea or Sevastopol: goods wholly produced in the Crimea or Sevastopol or have undergone a recent substantial processing there

G)
placement services:

I)
negotiation or organization of transactions with respect to the purchase, sale or supply of goods and technology or of financial and technical services, including from a third country to another third country or

Ii)
sale or purchase of goods and technology or of financial and technical services, including when they are in third countries with a view to transfer to another third country

H)

Technical assistance: any technical support related to repairs, development, manufacture, assembly, testing, maintenance or any other form of technical service, regardless of whether the aid granted in the form of instruction, advice, training, transfer of operational knowledge or skills or consulting services; technical assistance also includes verbal assistance

I)

Negotiable securities: the following categories of securities that can be traded on the capital market, except means of payment:

I)
shares in companies and other securities equivalent to shares in companies, partnerships or other entities, and depositary receipts for shares

Ii)
bonds or other debt instruments including depository receipts for such securities

Iii)
any other securities giving the right to buy or sell such transferable securities

J)

Money Market Instruments: instruments normally traded on the money market, such as treasury bills, certificates of deposit and commercial paper, except means of payment

K)

Credit institution, enterprises whose business is to receive from the public deposits or other funds repayable, and the provision of credit for reinsurance

L)

Requirements: any disputed or undisputed claim under or in connection with a contract or transaction, especially

I)
requirement fulfillment of any obligation which has arisen pursuant to or in connection with a contract or transaction

Ii)
claim for extension or redemption of a bond, financial guarantee or counter-guarantee, whatever form

Iii)
claim for compensation in respect of a contract or transaction

Iv)
counterclaim

V)
demands for recognition or enforcement, including by eksigibilitet, of a judgment, an arbitration award or an equivalent decision, wherever it is handed down or hit

M)

Investment services, the following services and activities:

I)
reception and transmission of orders related to one or more financial instruments

Ii)
execution of orders on behalf of customers

Iii)
own account trading

Iv)
portfolio management

V)
investment advice

Vi)
guarantees for financial instruments and / or placing of financial instruments on the basis of a firm commitment

Vii)
placement of financial instruments without firm commitment

Viii)
any service related to admission to trading on a regulated market or trade in a multilateral trading system.

N)

Unit in Crimea or Sevastopol: any company registered as domiciled or has its central administration or principal place of business in the Crimea or Sevastopol, which have subsidiaries or affiliates under its control in the Crimea or Sevastopol or have branches or other devices that operate in the Crimea or Sevastopol.

Chapter 2. Financial restrictions

§ 3. Requirement to freezing and prohibition against making available funds, etc.. All money and assets belonging to, held or controlled by the natural or legal persons listed in Annex I shall be frozen.
No money or assets shall be made available, directly or indirectly, for the benefit of natural or legal persons listed in Annex I.
Appendix I includes

A)
natural persons who are responsible for, actively supporting or conducting actions or policies that undermine or threaten Ukraine's territorial integrity, sovereignty and independence or stability or security of Ukraine, or that prevent work of international organizations in Ukraine, as well natural or legal persons associated with these individuals,

B)
legal persons materially or financially support actions that undermine or threaten Ukraine's territorial integrity, sovereignty and independence,

C)
legal persons in the Crimea or Sevastopol whose ownership is transferred contrary to Ukrainian law, or legal persons have benefited from such assignment, or

D)

Natural or legal persons who actively provide material or financial support or benefits from Russian decision makers responsible for the annexation of the Crimea and Sevastopol or the destabilization of eastern Ukraine.

E)
natural or legal persons who carry out transactions with separatist in the Donbass region of Ukraine.

§ 4. Exceptions to cover basic needs, etc. Ministry may grant exemptions from the provisions of § 3 and issue permits under the conditions the Ministry considers appropriate, to release or ask certain frozen money or assets available when it is determined that the money or the assets

A)
necessary to meet the basic needs of the natural or legal persons listed in Annex I and family members these natural persons dependents, including payment of foodstuffs, rent or mortgage, medicines and medical treatment, taxes, insurance premiums and municipal taxes,

B)
solely to go to the payment of reasonable fees or reimbursement of expenses in connection with legal assistance,

C)
solely to go to the payment of fees and administrative fees for routine storage or management of frozen money or assets, or

D)
necessary to cover extraordinary expense.

§ 5. Exemption for payments under judicial or administrative decisions Ministry may grant exemptions from the provisions of § 3 and give permission to release certain frozen money or assets provided that

A)
money or the assets are subject to an arbitration award rendered before the date of the natural or legal person was listed in Annex I or to a judicial or administrative decision in Norway or the EU, or a judicial decision that is enforceable in Norway or the European Union, before or after this date,

B)
money or the assets to be used exclusively to repay debts that are secured by or recognized as valid in such a decision, within the limits established by applicable law and regulations on such claimants rights

C)
decision is not in favor of natural or legal persons listed in Annex I and

D)
recognition of the decision is not contrary to the fundamental rule of law.

§ 6. Exceptions obligations matured before the entry in cases where natural or legal persons listed in Annex I shall pay amounts due under a contract, agreement or obligation that competent physical or legal person has entered into or incurred before the date they were listed in Annex I, Ministry of Foreign Affairs grant exemptions from the provisions of § 3 and issue permits under the conditions the Ministry considers appropriate, to release certain frozen money or assets if payment is not in conflict with § 3, second paragraph.

§ 7. Transfer to frozen accounts provision in § 3 second paragraph shall not prevent financial or credit institutions from crediting frozen accounts when they receive money transferred by a third party to an account belonging to scheduled natural or legal persons provided they credited amounts also freeze. Financial or credit institution shall immediately inform the Foreign Ministry about such transactions.
Provision in § 3, second paragraph does not amount supplied frozen accounts in the form of

A)
interest or other returns on these accounts,

B)
amounts due under contracts, agreements or obligations that were concluded or arose before the date on which the natural or legal person referred to in § 3 was included in Annex I, or

C)
amounts due according to the legal, administrative or arbitration decisions that have been taken in Norway or the EU or that are enforceable in Norway or the European Union, when these rates or other earnings and payments are frozen in accordance with § 3 subsection.

§ 8. Reporting obligation subject to the applicable statutory rules concerning reporting, confidentiality and confidentiality should be natural and legal persons

A)
promptly provide information that may promote compliance with the provisions of this chapter, including information on accounts and amounts frozen in accordance with § 3, to the Foreign Ministry, and

B)
cooperate with the Ministry about any verification of this information.

Any information given or received pursuant to this section shall be used only for the purpose it is given or received for.


§ 8a. Exemption from liability by freezing or withholding If money and assets frozen or not made available and this is done in the belief that such action is in accordance with this Regulation shall not incur any responsibility for the natural or legal person who carries out the measure, or for their officers or employees, unless it can be proved that the money or the assets were frozen or withheld as a result of negligence.

Chapter 3. Restrictions apply Crimea and Sevastopol

§ 9. Prohibition on import of goods from the Crimea and Sevastopol is prohibited

A)
importing goods originating in Crimea or Sevastopol,

B)
to provide, directly or indirectly, financing or financial assistance as well as insurance and reinsurance in connection with the importation of goods referred to in subparagraph a.

§ 10. Prohibition on certain investments in the Crimea or Sevastopol is prohibited

A)
to acquire or expand existing ownership interests in real estate in Crimea or Sevastopol,

B)
to acquire or expand existing ownership interest in or control of a legal person in the Crimea or Sevastopol, including full acquisition of such legal person or acquisition of shares and other securities in the nature of capital interest in a such legal person,

C)
allocating or participating in schemes aimed at awarding loans or credits, or otherwise provide financing, including equity, to a unit in Crimea or Sevastopol or a documented purpose of financing a such legal person,

D)
creating joint enterprises in the Crimea or Sevastopol and to enter into joint venture with a unit in Crimea or Sevastopol,

E)
provide investment services that are directly related to the activities referred to in subparagraphs a to d.

Prohibitions and restrictions of this provision shall not apply to legitimate business operations conducted with legal persons outside Crimea or Sevastopol, where its investments are not intended for legal persons in the Crimea or Sevastopol.
The prohibitions in subsection shall not affect the fulfillment of an obligation under a contract signed before 11 April 2015 or ancillary contracts necessary to fulfill such a contract, provided that the competent authority has been notified no later than five working days in advance .

§ 11. Prohibition of export etc. goods and technology to the Crimea and Sevastopol It is prohibited to sell, supply, transfer or export of goods and technology listed in Annex II

A)
to natural or legal persons in the Crimea or Sevastopol or

B)
for use in the Crimea or Sevastopol.

Annex II shall include certain items and technologies that are adapted for use in the following key sectors:

I)
transport

Ii)
telecommunications,

Iii)
energy

Iv)
exploration, extraction and production of oil, gas and mineral resources.

It is forbidden

A)
directly or indirectly to provide technical assistance or mediation services related to goods and technology listed in Annex II, or the supply, manufacture, maintenance and use of such products, to natural or legal persons in the Crimea or Sevastopol or for use in the Crimea or Sevastopol,

B)
directly or indirectly to provide financing or financial assistance related to goods and technology listed in Annex II, to natural or legal persons in the Crimea or Sevastopol or for use in the Crimea or Sevastopol.

The prohibitions in subsections get, when they are attached to subsection b, is not applicable where there are likely to be established that the goods and technology or services listed in the second paragraph shall be used in the Crimea or Sevastopol.
The prohibitions in subsections shall not affect the fulfillment by 12 July 2015 of an obligation under a contract signed before 11 April 2015 or ancillary contracts necessary to fulfill such contracts, provided that the State Department has been notified no later than five business days in advance.

§ 12. Prohibition of technical assistance and placement services It is prohibited to provide technical assistance or dissemination, building or construction services and engineering services that are directly related to infrastructure in Crimea or Sevastopol, in the sectors mentioned in § 11 first paragraph defined on the basis of Annex II, regardless of the goods and technology origin.
Prohibition in subsection shall not affect the fulfillment by 12 July 2015 of an obligation under a contract signed before 11 April 2015 or ancillary contracts necessary to fulfill such a contract.


§ 13. Prohibition to provide services related to tourism activities in the Crimea and Sevastopol are prohibited to provide services directly related to tourism activities in Crimea or Sevastopol.
It is prohibited for any vessel that provides cruise services to tarnish or be in the ports on the Crimean peninsula as listed in Annex III.
The prohibitions in subsections do not apply to ships for reasons of maritime safety emergency call at one of the ports listed in Annex III. Foreign Ministry shall be notified of such port calls within five working days.
The prohibitions in subsections shall not affect the fulfillment of an obligation under a contract or a related contract signed before 11 April 2015 or ancillary contracts necessary to fulfill such contracts, provided that the State Department has been notified no later than five business days in advance.

§ 13a. Exceptions § 10, § 11 and § 12 of Foreign Affairs may, under the conditions the Ministry considers appropriate, authorize relating to the activities referred to in § 10 first paragraph and § 11, second paragraph and to goods and technology referred to in § 11 first paragraph, provided that they

A)
necessary for official purposes of diplomatic missions or international organizations in the Crimea or Sevastopol who have immunity under international law,

B)
relate to projects where they used exclusively for support for hospitals and other public health institutions providing medical services, or for civilian educational institutions, in the Crimea or Sevastopol or

C)
are appliances or equipment for medical use.

Foreign Affairs may, under the conditions the Ministry considers appropriate, authorize relating to the activities referred to in § 10 first paragraph, provided that the transaction relates to maintenance to safeguard existing infrastructure's security.
Foreign Affairs may, under the conditions the Ministry considers appropriate, authorize relating to the activities referred to in § 10 first paragraph and § 11, second paragraph and to goods and technology referred to in § 11 first paragraph, the services referred to in § 12 if the sale, delivery , transfer or export of products or implementation of activities is required promptly to prevent or limit an event that could have serious and significant consequences for human health and safety, including existing infrastructure's safety, or the environment. Urgent and duly justified cases, sales, delivery, transfer or export is carried out without prior consent, provided that the exporter within five working days after the sale, delivery, transfer or export has taken place, informs the Ministry of Foreign Affairs and gives details of the relevant rationale for the sale, delivery , transfer or export has taken place without prior permission.

§ 14. Exceptions to § 9 prohibitions in § 9 shall not apply

A)
after complying by 17 November 2014 of trade contracts concluded before 16 August 2014 or the associated contracts as are necessary to carry out such contracts, provided that the natural or legal person who has to intends to fulfill the contract, no later than ten business days in advance have informed the Foreign Ministry about the activity or transaction to be performed

B)
for goods originating in Crimea or Sevastopol prepared for Ukrainian authorities for investigation, which satisfies the conditions for granted preferential treatment and who has been issued a certificate of origin for.

Chapter 4. Sector Initiatives

§ 15. Prohibition of export, import and transfer of defense-related goods is prohibited directly or indirectly to sell, supply, transfer or export of goods and technology listed in the "List I - defense-related products" in Annex I to Regulation June 19 2013 No.. 718 on the export of defense equipment, multi-purpose products, technologies and services to Russia, whether these originated in Norway or not. It is also forbidden to import, purchase or transport of such goods and technology from Russia.


§ 16. Prohibition against export of multi-purpose products and multi-purpose technology is prohibited directly or indirectly to sell, supply, transfer or export multi-purpose products and multipurpose technology listed in the "List II - multi-purpose products" in Annex II to Regulation 19 June 2013 no. 718 the export of defense equipment, multi-purpose products, technologies and services, whether these originated in Norway or not, to natural or legal persons in Russia or for use in Russia, if these products are completely or partly or may be intended for military use or military retail. If the end user is the Russian military, all multi-purpose products and technologies acquired by this, is considered to be intended for military use.
When Foreign Ministry makes decisions on applications for licenses, they shall not provide export permits to natural or legal persons in Russia or for use in Russia if the Ministry has reasonable grounds to believe that the end user can be military, or that the goods can be calculated military end use. Ministry may grant permission if exports comes the fulfillment of an obligation under a contract entered into before 16 August 2014 or ancillary contracts necessary to fulfill such a contract.

§ 16a. Prohibition of export of multi-purpose products and multi-purpose technology to persons listed in Annex VI is prohibited directly or indirectly to sell, supply, transfer or export multi-purpose products and multipurpose technology listed in the "List II - multi-purpose products" in Annex II to Regulation 19 June 2013 no. 718 the export of defense equipment, multi-purpose products, technologies and services, whether these originated in Norway or not, to natural or legal persons in Russia listed in Annex VI.
It is forbidden

A)
directly or indirectly to provide technical assistance, dissemination or other services related to goods and technology listed in the first paragraph or provision, manufacture, maintenance and use of such goods and such technology to natural and legal persons in Russia listed in Annex VI,

B)
directly or indirectly to provide financing or financial assistance related to goods and technology listed in the first paragraph, including grants, loans and export credit insurance, in connection with the sale, supply, transfer or export of such goods and such technology or the provision of associated technical assistance or affiliated mediation services or other services to natural and legal persons in Russia listed in Annex VI.

The prohibitions in subsections shall not affect the fulfillment of contracts signed before 11 October 2014, or ancillary contracts necessary to fulfill such contracts.
The prohibitions in subsections do not apply to the sale, supply, transfer or export of multi-purpose products and multi-purpose technology designed for the aerospace industry or the provision of associated technical and financial assistance to non-military use and to a non-military end-users.

§ 17. Prohibition against export of certain products for use in the oil industry requires prior approval for direct or indirect sale, supply, transfer or export of products listed in Annex IV, whether they originate in Norway or not, physical or legal persons in Russia, including Russia's exclusive economic zone and continental shelf, or in any other State, if the products are intended for use in Russia, including Russia's exclusive economic zone and continental shelf.
Appendix IV includes certain products adapted to these categories of exploration and production projects in Russia, including Russia's exclusive economic zone and continental shelf:

A)
oil exploration and production in waters more than 150 meters deep,

B)
oil exploration and production in waters north of the Arctic Circle, or

C)
projects that have the potential, using hydraulic fracturing, to produce oil from reserves located in shale formations; this does not apply to the exploration and development through shale formations for the purpose of locating or recovering oil from other reservoirs than shale reservoirs.

Exporters shall provide the State Department with all relevant information necessary in connection with their application for an export permit.

Foreign Ministry will not grant permission for the sale, supply, transfer or export of products listed in Annex IV if it would be likely to be established that the sale, delivery, transfer or export of products intended for any of the categories of exploration and development projects referred to in the second paragraph. Ministry may grant permission if the sale, delivery, transfer or export applies the fulfillment of an obligation under a contract entered into before 16 August 2014 or ancillary contracts necessary to fulfill such a contract. Foreign Affairs may also grant permission if the sale, delivery, transfer or export of products are required promptly to prevent or limit an event that could have serious and significant consequences for human health and safety or the environment. Urgent and duly justified cases, sales, delivery, transfer or export is carried out without prior consent, provided that the exporter within five working days after the sale, delivery, transfer or export has taken place, informs the Ministry of Foreign Affairs and gives details of the relevant rationale for the sale, delivery , transfer or export has taken place without prior permission.
If there are likely to be established that an already granted export permits are intended for projects mentioned in the fourth paragraph, the Foreign Ministry revoke, suspend, modify or revoke the permit.

§ 17a. Prohibition to provide certain services for use in the oil industry is prohibited directly or indirectly provide ancillary services necessary for the following categories of exploration and production projects in Russia, including Russia's exclusive economic zone and continental shelf:

A)
oljeleting- and extraction in water of more than 150 meters deep,

B)
oil exploration and production in waters north of the Arctic Circle, or

C)
projects that have the potential, using hydraulic fracturing, to produce oil from reserves located in shale formations; this does not apply to the exploration and development through shale formations for the purpose of locating or recovering oil from other reservoirs than shale reservoirs.

This paragraph is meant by "ancillary services":

I)
drilling

Ii)
well testing

Iii)
logging and completion

Iv)
delivery of specialized floating facilities

Prohibition in subsection shall not affect the fulfillment of an obligation under a contract or framework agreement concluded before 11 October 2014 or ancillary contracts necessary to fulfill such contracts.
Prohibition in subsection do not apply if those services are required promptly to prevent or limit an event that could have serious and significant consequences for human health and safety or the environment. It shall within five working days notify the Ministry of any activity undertaken pursuant to this paragraph, and provide further information about the relevant justification for the sale, delivery, transfer or export.

§ 18. Restrictions on technical assistance and financing are prohibited

A)
directly or indirectly to provide technical assistance related to goods and technology listed in the "List I - defense-related products" in Annex I to Regulation 19 June 2013 no. 718 on the export of defense equipment, multi-purpose products, technology and services, or related to the provision, manufacture, maintenance or use of goods listed in this list, to natural or legal persons in Russia or for use in Russia,

B)
directly or indirectly to provide financing or financial assistance related to goods and technology listed in the "List I - defense-related products" in Annex I to Regulation 19 June 2013 no. 718 on the export of defense equipment, multi-purpose products, technology and services, including in particular grants, loans and export credit insurance or -garanti well as insurance and reinsurance, related to the sale, supply, transfer or export of such products or the provision of associated technical assistance to physical or legal persons in Russia or for use in Russia ,

C)
directly or indirectly to provide technical assistance or mediation services related to "List II - multi-purpose products" in Annex II to Regulation 19 June 2013 no. 718 on the export of defense equipment, multi-purpose products, technologies and services or related to delivery, manufacture, maintenance and use of such goods or such technology, to natural or legal persons in Russia or for use in Russia, if these products are completely or partly or may be intended for military use or a military end-user

D)

Directly or indirectly to provide financing or financial assistance related to "List II - multi-purpose products" in Annex II to Regulation 19 June 2013 no. 718 on the export of defense equipment, multi-purpose products, technologies and services, including in particular grants, loans and export credit insurance , to sales, delivery, transfer or export of such products, or the provision of associated technical assistance to physical or legal persons in Russia or for use in Russia, if these products are completely or partly or may be intended for military use or a military retail.

The prohibitions in subsection shall not affect the fulfillment of contracts signed before 16 August 2014, or ancillary contracts necessary to fulfill such contracts, or the provision of assistance needed to maintain and safeguard existing capacities in Norway. The prohibitions of § 18 first paragraph a) and b) shall not apply to direct or indirect provision of technical assistance, financing or financial assistance related to the following operations:

A)
sale, supply, transfer or export as well as import, purchase or transport of hydrazine (CAS 302 1:02) in concentrations of at least 70 percent, provided technical assistance, financing or financial assistance relates to an amount of hydrazine calculated in accordance with the launch or launches or satellites substance is produced, and which does not exceed a total amount of 800 kg for each launch or satellite,

B)

sale, supply, transfer or export as well as import, purchase or transport of monometylhydrazin (CAS 60 34 4), provided technical assistance, financing or financial assistance relates to an amount monometylhydrazin calculated in accordance with launch or launches or satellites drug is manufactured for, in so far as the substances mentioned in a), b) and c) of this paragraph is intended for use in the launch equipment used by European suppliers of launch services by launches relating to European space projects or fuel for satellites manufactured by European manufacturers. Direct or indirect provision of technical assistance, financing or financial assistance related to the operations referred to in this paragraph a), b) and c) requires prior permission from the Foreign Ministry. Those who apply for prior authorization shall provide the State Department with all relevant information required.

The following shall be subject to permission from the Ministry of Foreign Affairs:

A)
provision of technical assistance or mediation services relating to products listed in Annex IV and delivery, manufacture, maintenance and use of these products, directly or indirectly, to natural or legal persons in Russia, including Russia's exclusive economic zone and continental shelf, or, if such assistance for products for use in Russia, including Russia's exclusive economic zone and continental shelf, to natural or legal persons in other states.

B)
financing or financial assistance related to products listed in Annex IV, including in particular grants, loans and export credit insurance, for the sale, supply, transfer or export of these technologies, or provision of associated technical assistance, directly or indirectly to natural or legal persons in Russia, including Russia's exclusive economic zone and continental shelf, or, if such assistance for products for use in Russia, including Russia's exclusive economic zone and continental shelf, to natural or legal persons in other states.

Urgent and duly justified cases referred to in § 17, fourth paragraph, the provision of services referred to in this paragraph is carried out without prior consent, provided that the service provider shall inform the Ministry within five working days after the services are rendered.
Permits under subsection can not be granted if there are likely to be established that the aid is linked to the fulfillment of obligations under the contract or agreement concluded after 15 August 2014 concerning the technology for use in projects relating to oil exploration and production in deep water, Arctic oil exploration and production or shale oil projects in Russia.

§ 19. Prohibition of trade in certain securities etc.. It is prohibited to directly or indirectly purchase, sell or provide investment services or assistance by issuing, or otherwise deal with, transferable securities and money market instruments with a maturity of over 90 days issued after 15 August 2014 up to and including October 10, 2014, or with a maturity of over 30 days issued after October 10, 2014 by

A)

A major credit institution or other large institution with the express mandate to promote the competitiveness and diversity of the Russian economy and to encourage investment, which is established in Russia with over 50% public ownership or control as of 1 August 2014 as listed in Annex V, or

B)
a legal person established outside Norway and the EU which are directly or indirectly more than 50% owned by a legal person listed in Annex V, or

C)
a legal person acting on behalf of or at the direction of a legal person referred to in subparagraph b in this paragraph or in Annex V.

a legal person established in Russia and controlled by the state or where the state owns over 50%, if total assets are estimated at more than 1 trillion Russian rubles, and where at least 50% of the estimated revenues derived from the sale or delivery of crude oil or petroleum products, as listed in Annex VIII,

C)
a legal person established outside Norway and the EU which are directly or indirectly more than 50% owned by a legal person referred to in subparagraph a or b of this paragraph or

D)
a legal person acting on behalf of or at the direction of a legal person referred to in subparagraph a, b or c in this paragraph.

It is forbidden to directly or indirectly create or participate in arrangements with a view to providing new loans or credits with a maturity of over 30 days for legal persons mentioned in the first or second paragraph by 10 October 2014.

The prohibition in subsection does not apply to use of credit option or payments made under a contract entered into prior to 11 October 2014, provided that

A)
all terms that apply to such credit utilization or such payments,

I)
was agreed prior to 11 October 2014

Ii)
not been modified on or after that date, and

B)
it before 11 October 2014 provided for a contractual maturity date for a full refund of all money that is made available, and for repeal of all commitments, rights and obligations under the contract.

Terms that apply to the use of credit opportunity and payments referred to in subparagraph a, shall include provisions regarding the length of the repayment period for each credit utilization or payment, the applicable interest rate or interest calculation method as well as the maximum amount.

Chapter 5. Final provisions

§ 20. avoidance is prohibited intentionally to participate in activities that have the purpose or effect to circumvent the prohibitions of this regulation.

§ 20a. Requirements relating to contracts or transactions No claims relating to contracts or transactions where execution is affected, directly or indirectly, in whole or in part, by the measures imposed by this Regulation, including claims for damages or other claims of this kind, as a claim for compensation or claim under a guarantee, in particular claims for extension or redemption of a bond, guarantee or counter-guarantee, particularly a financial guarantee or counter-guarantee, in whatever form, shall be met if it is made of

A)
natural or legal persons listed in Annex I, as regards the measures in chapters 2 and 3

B)
legal persons mentioned in § 19 first paragraph b or c and subsection c or d, or in Annex V, VI, VII and VIII, or other Russian people, as regards measures Chapter 4

C)
natural or legal persons acting through or on behalf of persons referred to in subparagraph a or b in this paragraph

D)

Natural or legal persons in accordance with a decision of an arbitral tribunal, a court or an administrative body has violated the prohibitions set out in Section 3

E)
natural or legal persons, provided that the claim relates to goods in accordance with § 9 are prohibited to import.

In connection with any matter relating to the recovery of a claim, it is incumbent upon the natural or legal person who is trying to claim recovered, to prove that the fulfillment of the claim is not prohibited by the provision in the first paragraph.
This paragraph shall not affect the right of natural or legal persons referred to in the first paragraph to the courts to get tested the legality of non-fulfillment of contractual obligations in accordance with this Decision.

§ 21. Exemption of Foreign Affairs may in special cases grant exemptions from these regulations if it gets a clear unintended effect, and assuming it does not conflict with Norway's international obligations or objectives behind the restrictive measures.

§ 22. Punishment Violation of the provisions of these regulations is punishable by law on 27 April 2001 no. 14 on iverksetjing of international, non-military measures in the form of disruption or limitation of economic or other relations with third countries or movements § 3.

§ 23. Amendment of Regulations of Foreign Affairs may change, suspend and revoke the regulation.

§ 24. Entry into force These regulations enter into force immediately. From the same date, the Regulations on 21 March 2014 no. 301 on restrictive measures related to actions that undermine or threaten Ukraine's territorial integrity, sovereignty and independence.
