Baby food commodity law scheme

The Secretary of State for Health, Welfare and Sport,

Having regard to Directive No 96 /5/EC from the Commission of the European Communities of 16 February 1996 on processed cereal-based foods and baby foods for infants and young children (PbEG L 49);

as well as Article 10, first paragraph, of the Regulation of the Department of Food and Food Products for special nutritional uses ;

  • The following definitions shall apply:

    • a. Infants: children less than 12 months of age;

    • b. toddlers: children from one to three years of age;

    • c. Processed food or drink products based on cereals:

      • 1º simple cereal products which are produced with milk or other appropriate food or drink products;

      • 2º grain products to which a protein-rich eatery has been added, and which are produced with water or any other liquid containing no liquid;

      • 3º pasta prepared for consumption in boiling water or other suitable liquids before consumption; and

      • 4º biscuits and biscuits which are used as such, or first crumbled and then mixed with water, milk or other suitable liquids;

    • ed. baby food: Foods intended for particular nutritional uses, with the exception of processed cereal-based food or drink-based products;

    • e. Pesticide residues: the residue in processed cereal-based eating or drinking products, and in baby food, of a plant protection product as referred to in Article 1 of the Plant Protection Products Act and biocidal products , including its metabolites, and products released at the time of degradation or reaction;

    • f. Regulation (EU) No 1169/2011: Regulation (EU) No Regulation (EC) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 148/EC and (EC) No 1925/2006 of the European Parliament and of the Council and repealing Directive 87 /250/EEC of the Commission, Directive 90 /496/EEC of the Council, Directive 1999 /10/EC of the Commission, Directive 2000 /13/EC of the European Parliament and of the Council, Directives 2002 /67/EC and 2008 /5/EC of the Commission, and Regulation (EC) No 148/EC 608/2004 of the Commission (PbEU 2011, L 304).

  • 2 This arrangement shall apply to processed cereal-based foods or drinking products and baby foods, which are:

    • -

      provide for the specific needs of infants and young children in good health; and

    • -

      are intended for consumption by infants during the period in which they are weaned, or toddlers to supplement their diet or gradually to allow them to become accustomed to ordinary food.

  • 3 This scheme shall not apply to milk intended for young children.

  • a. Use made of ingredients that have been shown to be suitable as a specific nutritional for infants and young children based on generally accepted scientific data;

Processed food or drink foods based on cereals, and baby foods, ready for immediate consumption or having been reconstituted according to the instructions of the manufacturer, contain no more than:

  • a. 0,003 mg/kg of residues of the individual pesticides listed in Annex VII;

  • b. The residues of the pesticides referred to in Annex VIII; and

  • c. 0,01 mg/kg of residue and of other individual pesticides.

Without prejudice to Regulation (EU) No 1169/2011, the following entries shall be applied to cereals and baby food at the time of eating or drinking:

  • a. An indication of the appropriate age from which the eatery, taking into account the composition, substance or other specific characteristics, may be used;

  • (b) information or the eating of gluten, whether or not containing gluten, if the age of which, according to an indication referred to in (a), can be used according to an entry referred to in (a) is less than six months;

  • c. the available energy value, expressed in kJ and kcal, and the protein, carbohydrate and fat content expressed in terms of figures, per 100 g or 100 ml of edible food as sold and, if applicable, by recommended consumption amount of the eater;

  • d. the average quantity of each mineral and any vitamin for which a specific quantity is mentioned in Annex II Other Annex IV , expressed in terms of figures, per 100 g or 100 ml of edible food as sold and, if applicable, per meal recommended for consumption, and

  • e. If necessary, a instructions for use of the correct preparation of the food, and a warning that such instructions should be followed.

Without prejudice Article 5 in the case of food-based drinking or drinking products and baby food, the following entries shall be used:

  • a. Food or drinking products which have been recommended to use from the age of four months: an indication that they are suitable for use as from that age, unless independent, in the field of medicine, nutrition or persons responsible for the care of mother and child, or persons from other professions responsible for the care of mother and child, shall be given a different opinion;

  • b. the average quantity of the Annex I In so far as such indication is not already used in accordance with Article 5 (d) , expressed in figures, per 100 g or 100 ml of the edible food as it is sold and, if applicable, per declared portion;

  • c. figures and information on Annex V Vitamins and minerals, expressed as percentages of the reference values indicated therein, per 100 g or 100 ml of the goods sold and, if applicable, by indicated portion, provided that the value of the products in question is quantities at least equal to 15% of the reference values.

Any methods of examination which, by exclusion, determine whether or not they have been satisfied with respect to the fixing or use of processed food or drink products on the basis of cereals or baby foods Article 3a , it is appropriate to designate standardised methods which are generally accepted.

Processed cereal-based eating or drinking products are mainly prepared from one or more ground cereals or other starch-containing root products.

The quantity of cereals or carrot product shall not be less than 25% (w/w) of the dry end mixture.

  • 2.3 For the Article 1, first paragraph, point (c), 4 , for those biscuits to which a protein-rich food is added and sold as such, the added protein content is not less than 0,36 g/100 kJ (1,5 g/100 kcal).

  • 1.1 If meat, poultry, fish, organ meat or any other traditional source of protein are the only ingredients mentioned in the designation of the food:

    • -

      consists of the total eatery for at least 40% (w/w) of the said meat, poultry, fish or offal or from the other traditional protein source mentioned;

    • -

      the total amount of protein from the said sources shall consist of at least 25% (w/w) of each type of meat, poultry, fish or offal or the other traditional protein source mentioned;

    • -

      the amount of protein from the said sources shall not be less than 1,7 g/100 kJ (7 g/100 kcal).

  • 1.2 If meat, poultry, fish, organ meat or any other traditional source of protein are first mentioned in the designation of the food, alone or in combination, whether or not the food is offered as a meal:

    • -

      consists of the total eatery for at least 10% (w/w) of the said meat, poultry, fish or offal or from the other traditional protein source mentioned;

    • -

      the total amount of protein from the said sources shall consist of at least 25% (w/w) of each such type of meat, poultry, fish or offal or other traditional protein source;

    • -

      the amount of protein from the said sources shall not be less than 1 g/100 kJ (4 g/100 kcal).

  • 1.3 If meat, poultry, fish, offal or any other traditional protein source are either only or combined, but not first, in the designation of the food, regardless of whether the food is offered as a meal:

    • -

      consists of the total eatery for at least 8% (w/w) of the said meat, poultry, fish or offal or from the said other traditional protein source;

    • -

      the total amount of protein from the said sources shall consist of at least 25% (w/w) of each such type of meat, poultry, fish or offal or other traditional protein source;

    • -

      the amount of protein from the said sources shall not be less than 0,5 g/100 kJ (2,2 g/100 kcal);

    • -

      is the total amount of protein in the eatery from all sources not less than 0.7 g/100kJ (3 g/100 kcal).

  • 1.3bis If cheese together with other ingredients is mentioned in the indication of a hearful commodity, regardless of whether the commodity is offered as a meal:

    • -

      the amount of protein from dairy sources shall not be less than 0,5 g/100 kJ (2,2 g/100 kcal);

    • -

      is the total protein content in the value of any source not less than 0,7 g/100 kJ (3 g/100 kcal).

  • 1.4 If the food label is labelled as a meal, but meat, poultry, fish, organ reading or any other traditional protein source are not mentioned in the designation of commodity, the total amount of protein is in the commodity from all sources. not less than 0,7 g/100 kJ (3 g/100 kcal).

  • 1.4a Points 1.1 to 1.4 do not apply to sauces presented as accompanous to a meal.

  • 1.4ter If dairy products are identified as the first or only part of the designation of a sweet dish, the amount of dairy protein shall be not less than 2,2 g/100 kcal. Points 1.1 to 1.4 shall not apply to any other sweet food.

  • 1.5 Amino Acids may only be added to increase the nutritional value of the proteins present in the food, and only in the quantities needed for that purpose.

The total amount of carbohydrates in fruit and vegetable juices and nectars, in fruit only, in desserts or in puddings, is not greater than:

  • -

    10 g/100 ml for vegetable juices and drinks based thereon;

  • -

    15 g/100 ml for fruit juices and nectars and drinks based thereon;

  • -

    20 g/100 g for dishes consisting solely of fruit,

  • -

    25 g/100 g for desserts and puddings;

  • -

    5 g/100 g for other non-milk-based drinks.

  • 3.1 For meat, poultry, fish, organ meat or any other traditional protein source.

    If meat or cheese are the only ingredients or first mentioned in the designation of a food, the total fat content in the eatery from all sources is not greater than 1,4 g/100 kJ (6 g/100 kcal).

  • 3.2 For all other eating or drinking goods, the total fat content is not greater than 1,1 g/100kJ (4,5 g/100 kcal) in the food from all sources.

  • 4.1 The final sodium content of the eatery is not higher than 48 mg/100 kJ (200 mg/100 kcal) or 200 mg/100 g. If cheese is the only component mentioned in the name of the food, the final sodium content of the eatery is not more than 70 mg/100 kJ (300 mg/100 kcal).

  • 4.2 Food-based drinking or drinking products and desserts and puddings are not added to sodium salts, unless technological reasons are used.
