Aid scheme for the transport and transport of products
The Minister of Transport and Water,
Having regard to the Articles 2 , 3 and 4 of the Framework Law Grants Traffic and Water State ;
Decision:
The following definitions shall apply:
Minister for Transport and Water State;
the Connekt foundation;
the board of the Foundation Connekt;
the capacity of both public and private knowledge-oriented institutions to deliver relevant knowledge products to society;
the extension of general scientific and technical knowledge without industrial or commercial objectives;
research aiming at the creation of new knowledge with the aim of using this knowledge in the development of new products, processes or services, or significantly improving existing products, processes or services;
to convert the results of industrial research into plans, schedules or designs for new modified or improved products, processes or services, including the manufacture of a prototype, demonstration or model project, which is not may be used for industrial or commercial purposes;
actively storing, maintaining, unlocking and disseminating knowledge, which has been developed on the basis of basic strategic research, industrial research, pre-competitive development, and studies of the technical feasibility of industrial research or pre-competitive development.
1 The Minister may provide support for the implementation of an annual programme to improve the knowledge infrastructure for traffic and transport consisting of sub-programmes for:
a. Fundamental/strategic research;
b. industrial research;
c. pre-competitive development; or
d. Studies on technical feasibility for the preparation of industrial research, or of pre-competitive development, accompanied by Connekt, for which the Board has submitted an application for the grant of the subsidy.
2 Knowledge distribution is part of a sub-programme.
3 A subprogramme as referred to in the first paragraph
a. is expected to make a substantial contribution to the sustainable resolution of problems in traffic or transport; and
b. is co-financed by at least one private party, except that for research projects in the sub-programme basic/strategic research the governance may forego the co-financing.
4 The results obtained within a sub-programme as referred to in paragraph 1 shall not be subject to exclusive intellectual property rights. In order to actively disseminate knowledge in the area of traffic and transport, Connekt shall make available to each of the results of reimbursement of the cost of the delivery of the costs. The knowledge dissemination shall take place without delay after the completion of the research activity or development activity.
The subsidy ceiling for grants for the implementation of annual programmes shall be as follows:
a. € 4.084.022,00 for the period 1999 to 2002 for programmes to improve knowledge infrastructure in relation to underground logistics systems;
b. € 22,286,639,00, for the period 2000 to 2003;
c. € 1,200.000.00 for the period from 2004 to 2007 of which a maximum of € 300,000 per year.
1 The knowledge dissemination subsidy as part of a sub-programme as referred to in Article 2, first paragraph, shall be 100%.
2 The amount of the subsidy for the other part of the sub-programme shall be as far as it concerns:
a. strategic/basic research, up to 100% of the eligible costs;
b. Research on technical feasibility, in preparation for industrial research, of up to 75% of the eligible costs;
(c) industrial research, up to a maximum of 50% of the eligible costs;
d. examine technical feasibility for the preparation of pre-competitive development, up to a maximum of 50% of the eligible costs;
e. pre-competitive development, up to a maximum of 25% of the eligible costs.
3 The subsidy rates referred to in points (b) to (e) of paragraph 2 may be increased by up to 10 percentage points if the grants are to the benefit of small and medium-sized enterprises.
4 In the case of an increase in the subsidy rate, pursuant to paragraph 3, or in the case of overlapping with European grant programmes, the total subsidy for industrial research shall be at most 75% and for pre-competitive development of up to 50% of the eligible costs.
5 If other bodies of public administration contribute to the improvement of the knowledge infrastructure for transport and transport, Connekt shall contribute to the relevant sub-programme of the annual programme, in so far as it contributes to the Eligible costs, shall be deducted from the subsidy referred to in this Article.
The provision of grants is Section 4.2.8 of the General Administrative Law where this provision does not expressly derogate from this scheme.
1 The Steering Board shall submit an application for a grant for implementation of an annual programme, to the Minister before 1 November of the year, prior to the year on which the application for grant relates.
2 An annual programme and an annual budget shall be attached to the application referred to in paragraph 1.
3 It is clear from the documents mentioned in the second paragraph that Article 2 (3) , Article 4 and Article 7 shall be satisfied.
4 By way of derogation from paragraph 1, applications for grants for the year 2000 shall be submitted by 1 July 2000 at the latest.
5 By way of derogation from paragraph 1, applications for grants for the year 2001 shall be submitted by 31 December 2000 at the latest.
6 By way of derogation from the first paragraph, applications for grants shall be submitted for both 2004 and 2005 by 1 December 2004.
1 An annual programme as referred to in Article 6 (2) shall contain at least the following information:
a. an overview of the planned sub-programmes;
b. an overview of the relevant administrative bodies, companies and organizations by component.
2 A subprogram contains a description of topics:
a. to focus area;
b. Qualified by type of research as referred to in Article 2;
c. Provide planning and milestones;
(d) provide a description of the proposed method of implementation;
e. provide a description of the proposed guidance by Connekt;
f. provide a description of how content is given to the knowledge dissemination.
3 In any case, the budget shall indicate the contribution requested per activity within a sub-programme, specifying, by activity, the co-financing required under Article 4.
4 The following research and development costs referred to in Article 2, first paragraph, shall be regarded as eligible:
a. Costs of equipment, equipment, land or buildings, which are used exclusively and permanently, except where they are abandoned on a commercial basis, for research or development;
b. cost of personnel exclusively engaged in research or development;
c. costs of advice or similar services used exclusively for research or development;
d. costs related to the procurement of raw materials or materials and the like that are consumed in research or development; and
e. additional overhead costs, resulting directly from research activities or development activities.
5 If there is a co-financing in the form of goods or services, it shall be regarded as follows:
a. Goods on the basis of the current value;
b. Services based on demonstrable salary costs with a storage of up to 40%.
1 Within six weeks after the board has the data, intended Articles 6 and 7 The Minister's annual programme shall be assessed by the Minister.
2 If the assessment leads to the finding that the annual programme is in accordance with the requirements of this Arrangement, the Minister shall give a decision on the grant of subsidies.
3 A grant relating to a sub-programme which has a longer duration than the calendar year for which the grant has been requested is granted subject to sufficient funds for the remaining period. set by the industry and subject to the approval of the budget of the Ministry of Transport and Water State.
4 On request, the Minister may amend the decision on the grant of subsidies referred to in paragraph 2 during the calendar year to which it relates to the maximum amount of the subsidy ceiling provided for in the second paragraph of this Article. 1 At the request of the Board, the Minister may grant advance payments.
2 The Minister shall determine the amount of the advances on the basis of a submitted annual liquidity budget, broken down by calendar quarter, up to a maximum of 80% of the amount of the subsidy granted for the calendar year.
3 In the order for the grant of advances, the amounts for the various activities shall be included separately within a sub-programme.
The Minister may, on the basis of a revised annual liquidity budget, be subject to a review of the amount of the advance granted on an annual basis, broken down by calendar quarter.
5 By way of derogation from the second paragraph, the Minister may, for the year 2003, determine the amount of the advances up to a maximum of 100% of the amount of the subsidy granted for that calendar year.
1 The implementation of the annual programme shall start within the year for which the grant has been granted.
2 The requirement of co-financing shall, in any event, be fulfilled before the implementation of sub-programmes.
3 If the Steering Board makes a change to the objective, duration or financing of the annual programme or the implementation of a sub-programme, it shall immediately inform the Minister.
4 In the case of a difference of more than 20% between actual expenditure and revenue and the annual liquidity budget submitted, classified by calendar quarter, the Steering Board shall, on an annual basis, be subject to an amended annual liquidity budget. calendar quarter, in the minister.
5 The cash flow management of Connekt is limited to the risk-free setting and collection of cash in order to provide for its own liquidity needs.
6 The Board of Auditors shall grant access to the books of Connekt to the Minister and to the Court of Auditors.
7 The Steering Board shall ensure that participatory undertakings have access to the Court of Auditors, insofar as it concerns the contribution of Connekt.
8 Statuts of amendment and dissolution of Connekt need prior approval of the Minister.
1 The Steering Board shall submit an application for the determination of the grant before 1 June following the end of the financial year.
2 The application for the determination of the grant is accompanied by a statement from an auditor referred to in Article 393, first paragraph, of Book 2, of the Civil Code, which shows that the conditions laid down in this arrangement are fulfilled and obligations.
3 The auditor shall apply a control protocol set by the Minister.
The Minister shall fix the amount of the grant within eight weeks after the Steering Board has applied for the grant of the grant.
1 The Steering Board shall provide the Minister with a report each year containing information on the effectiveness and effects of this scheme in practice.
2 The Board shall, upon request, inform the Minister without delay of the information required for the performance of his task.
1 After the entry into force of this scheme, Article 2, first paragraph , from this scheme:
a. Grants in or for 1999 provided to the Centre for Transports Technology and the Bureau of Intelligent Transport Systems Netherlands; and
b. commitments in or for 1999 entered into by the Project Office, Integral Verkeers and Transport Studies, as they relate to 1999 or later years.
2 Connekt replaces the Centre for Transport Technology, the Bureau of Intelligent Transport Systems Netherlands and the project office Integral Verkeers-and Transport Studies, as far as it concerns eligible expenditure respectively. effects on cash records and commitments undertaken, insofar as they relate to 2000 or subsequent years.
This arrangement shall enter into force from the second day following the day of the Official Journal of the Official Journal in which it is placed and shall operate back to 1 January 2000.
This scheme is cited as: Aid scheme for the transport of knowledge and transport.
This arrangement will be set out in the Official Journal.
