In order to promote the social and political aspects of transformation processes, the Minister may grant a subsidy to a democratic and market-oriented system for activities which are not based on any of the other aspects of the process. Provisions of this subsidy scheme may be eligible for, or appropriate to, the following:

  • (a) establishment and strengthening of plurality, democratic constitutional states;

  • b. the construction of civil society or civil society;

  • c. the process of accession to the European Union; or

  • d. The strengthening of central governments.

With a view to and within the framework of the objectives mentioned in: Article 2.2 , eligible activities shall be targeted at, or in support of:

  • (a) the empowerment and organisation of citizens, the pluralism of civil society, the possibilities of engagement of citizens in the establishment of their society and the private initiative;

  • b. the functioning of the rule of law, the quality of legislation, law enforcement and justice, and the legal protection of citizens;

  • (c) the democratic content and improvement of the functioning of public authorities, the transparency of public intervention and the accessibility of public authorities;

  • d. the centralisation of central and decentralised authorities for their role in the accession to the European Union and the promotion of the adjustments necessary for this purpose;

  • e. the structure, capacity, quality and administrative power of central governments; or

  • f. knowledge transfer, financial support of students and the development and implementation of training courses, courses, training courses and traineeships.

The Minister may grant aid for activities which are intended or useful for the alleviation, restriction or prevention of human needs arising from conflicts, natural disasters or other emergency situations.

With a view to and within the framework of the objectives mentioned in: Article 3.1 , eligible activities shall be targeted at, or in support of:

  • a. providing direct assistance to meet the primary needs of victims, in particular the most vulnerable among them, in the field of:

    • -lodging;

    • -food and food security;

    • -health care, including reproductive health care;

    • -water and sanitation;

    • -protection;

    • -return and resettlement of refugees and displaced persons, and

    • -other humanitarian focus areas identified by the United Nations,

  • (b) strengthening institutional capacity, including the promotion of expertise, internationally, in the Netherlands and in affected or vulnerable areas, aimed at the alleviation of acute human needs and preparings for disasters;

  • (c) promotion of the targeting and efficiency of aid; and

  • d. Limitation of humanitarian emergency and material damage caused by disasters;

Grants shall not be eligible:

  • a. Identification emissions for the exploration of the needs;

  • b. Activities which:

    • -be paid in whole or in part by the United Nations Joint Emergency Aid Funds,

    • -relating to education in crisis situations, or

    • -to generate income as the principal objective, and

  • c. Applications for an amount of less than € 300,000, except for applications related to activities, referred to in Article 3.2 (b) .

Eligible legal persons shall only be eligible for subsidy on the basis of this Section:

  • a. objective and actual work are aimed at a wide range of activities;

  • b. In the case of emergency aid, are attached to and act in accordance with the Code of Conduct for the International Red Cross and Red Crescent Movement and Non-Governmental Organizations in Disaster Relief, or equivalent Code;

  • c. possess experience and a good record of service in the relevant area;

  • d. possess demonstrable knowledge and expertise with the problems involved;

  • e. have sufficient organisational and implementation capacity; and

  • f. to be actively involved in the United Nations local coordination mechanism with respect to humanitarian aid, as appropriate, or through a local partner, as appropriate.

In addition to the Articles 3.2 and 3.3 It is clear from applications for subsidy under this section that:

  • a. The activities comply with international humanitarian aid principles;

  • b. The application relies on an analysis of the needs and focused on a clearly defined target group;

  • c. the activities are linked to clearly and realistically defined results, targets, instruments and indicators;

  • d. Attention shall be given to bridging the gap between acute emergency aid and rehabilitation;

  • e. is provided in an exit strategy;

  • f. attention to the HIV/AIDS problem;

  • g. attention is given to the problems of gender and sexual and reproductive health and rights; and

  • h. the budget is clear and balanced and is linked to the activities.

Applications will be assessed according to the following criteria:

  • a. speed, nature, scale and connection of the proposed intervention on identified needs;

  • b. Dissemination of donor activities in relation to identified needs;

  • c. where there is a long-term crisis, continuation of adequately implemented relevant activities is a priority over subsidisation of new activities;

  • d. avoidance of adverse effects of humanitarian aid, including in order to ensure the sustainability of results; and

  • e. complementarity and added value in relation to other initiatives in the same area.

Grants may be awarded for activities that have already begun if:

  • (a) the activities are so urgent that the applicant cannot reasonably be required to have submitted his application prior to the beginning of the operation;

  • (b) the applicant has informed the Minister, at the start of the activities, of the intention to submit a grant application; and

  • c. The grant application has been submitted within four weeks of the start of operations.

  • 1-and transfers between items in the budget for activities for which grants have been awarded pursuant to this paragraph do not need to be submitted to the Minister for approval if:

    • a. The occasional and overruns are the result of altered or unforeseen circumstances in a situation of acute distress;

    • b. The amount of off-and exceeable amounts not more than 25% of the relevant items; and

    • (c) the total of the budget shall not be exceeded.

  • 2 The first paragraph shall not apply to allowances for expatriates and the procurement of transport equipment and communications equipment.

  • a. Tracking of safety straits and

  • 1 Subsidy under paragraph 2 may be granted only to private organisations operating in high-risk areas which are financed from the budget of the Ministry of Foreign Affairs.

  • 2 A grant may be granted up to a maximum of 50% of the costs of the eligible activities. Subsidy is not granted for travel expenses.

  • In each case, grant applications shall contain:

    • a. A list of participants;

    • b. indication of the countries or regions where these participants are, or will be, employed;

    • c. a description of the activities for which subsidy is claimed;

    • d. Where appropriate, the intended providers of the activities; and

    • e. a clear and closing budget that is linked to the activities.

For the purposes of this Section, the following shall be added:

  • - strategic partnership: a cooperative partnership of the Minister with a civil society organisation or more civil society organisations in an alliance, which is embedded in a cooperation agreement;

  • - alliance: a partnership between civil society organisations which have concluded a cooperation agreement and at least an organisation with legal personality under Dutch law;

  • - social organisation: a non-profit-driven, non-governmental or de facto-related organisation, incorporated or established by a public authority, which has legal personality in civil law;

  • - Pener: one of the parties in an alliance acting for the alliance as a grant applicant;

  • - low and low-middle income countries: countries as such in the List of Recipients or Official Development Assistance Assistants adopted by the Development Assistance Committee (DAC) of the Organisation for Economic Cooperation and Development (OECD).

  • 1 The Minister may grant grants within the framework of a strategic partnership for activities that extend or serve sustainable growth and inclusive development in low and low middle income countries through support of ... in the case of civil society in the field of advocacy and influence.

  • 1 For subsidy under this section, only those civil society organisations which are part of a strategic partnership and which are established in the Netherlands or in a low or low-middle income country and which are established in the Netherlands, shall be eligible:

    • a. engaged in cooperation with civil society organisations in low and low-middle income countries for inclusive growth and development for all, to fight poverty and injustice;

    • b. possess relevant experience, capacities and expertise;

    • (c) pursue a policy of remuneration that does not increase the remuneration of directors and employees over the standard of service provided in the service.

  • 2 The recipient or the alliance shall include at least 25% of its income from sources other than:

    • a. Grants and contributions granted by the Minister and

    • b. Contributes provided by organizations funded by the budget of Foreign Affairs or Foreign Trade and Development Cooperation, at the expense of that grant.

  • 3 If grant is granted for the benefit of activities carried out in an alliance, the grant may be granted only to the pener. The captain shall rest all the obligations attached to the grant, any of the parties in the alliance shall in fact be responsible for the execution of the related activities.

  • 4 A social organisation may act as a pilot for the purposes of this Section only and, in addition, as a non-pilot of a maximum of another alliance. Civil society organisations based in a low or low-middle income country can only qualify in an alliance for grants.

  • 3 The assessment of applications takes place in two stages. The first phase is aimed at the selection of partners with which the Minister wishes to enter into a strategic partnership. The second phase focuses on the provision of grant to civil society organisations in the partnerships.

  • 4 After the first stage, the Minister will announce the subsidy ceiling for the application of this section.

  • 1 The assessment in the first phase includes in addition to a key to the criteria, mentioned in Article 4.3 , an assessment of the quality of the request from a track record and a theory of change.

  • 2 The track record includes a factual and substantiated description of the experience and achieved results of the organisation or alliance in the field of advocacy and influence.

  • 3 In any event, the theory of change shall include the vision of the organisation or the alliance on the societal changes envisaged in the framework of the strategic partnership, and its role in it, the analysis underlying it, the a description of the factors determining success and the risks identified as well as the measures envisaged to mitigate the risks envisaged by the intervention, the method of determining the effects and results thereof.

  • 2 Grant for activities referred to in subparagraph (a) and (b) of the first paragraph may be granted only to sector institutes with an international task designated by the Minister for Education, Culture and Science and to the Funds referred to in Article 2 (2) of the Treaty.   • 1 For Subsidy for the purposes of and within the framework of the objectives referred to in Article 8.1, points (b), (c) and The following shall be eligible:

    • a. activities aimed at the creation of cultural expressions, particularly in developing countries by artists and cultural institutions, from or working in developing countries,

    • b. Stageprogrammes targeting artists or sportsmen and women from developing countries;

  • 2 Subsits for activities referred to in paragraph 1 may only be awarded to institutions whose objective and method of operation are designed, in whole or in particular, to promote and disseminate cultural expressions, in particular in the form of a developing countries, by artists or cultural institutions, from or employed in developing countries, and on collaborative sports institutions with experience in developing countries.

For the purposes of this Section, public private cooperation shall mean a grouping of one or more parties originating in the public sector and one or more private organizations, without 'business' or 'business parties', aimed at the realisation of jointly endorsed objectives by carrying out activities in such a way that each of the parties is a part of the necessary carry out efforts and bear part of the risks involved.

  • 1 The Minister may grant a grant for the purpose of carrying out activities under this scheme, carried out in the framework of public private cooperation.

  • 3 The grant shall be awarded in the form of an activity grant, where appropriate in addition to an institution grant already granted to the same consignee. The recipient of the subsidy shall ensure that the relevant grants are managed in such a way as to ensure that the subsidy is used exclusively for the activities for which it is intended and that it can be reported separately.

This arrangement shall enter into force as from 1 January 2006 and shall expire on 1 July 2017. If the State Official in which this Arrangement is placed is issued after 30 December 2005, this Arrangement shall enter into force from the second day following the day of the Official Journal of the Official Journal in which it is placed and shall work back to and with 1 January 2006.
