Rules of the Ministers of Transport and Water, and of Social Affairs and Employment, laying down rules for the implementation of the Working Time Decision Transport (Conditions of Employment and Rest Time)

The Ministers of Transport and the Water State and of Social Affairs of Employment,

Having regard to Regulations (EC) 1899/2006 and 8/2008 to change Regulation (EEC) 3922/91 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation, and in the field of civil aviation Articles 4.5:3 to 4.5:6 of the Working Time Order Transport ;

Decisions:


Article 1. Definitions

For the purposes of this arrangement:

  • -ground time means any period of time within the flight duty period which is not part of the block time;

  • -Regulation: Annex III of Regulation (EEC) 3922/91 of the Council of the European Communities of 16 December 1991 on the harmonisation of technical regulations and administrative procedures in the field of civil aviation (PbEG L 373);

  • -block time: block time as referred to in section 1.1095 of the Regulation;

  • -home base, as referred to in section 1.1095 of the Regulation;

  • -Decision: Working time decision transport ;

  • -horizontal rest: an adequate accommodation on board the aircraft which is shielded from both the flight crew compartment and the passenger compartment and can be darkened, and in which horizontal rest can be enjoyed;

  • -Class A seating position: a seat outside the flight deck which is at least as wide as an economy class seat, has more pitch than an economy class seat, gives a minimum of 40 ° recline and fully integrated support to legs and feet, and with effect has been shielded from the passengers by at least a curtain from 1 April 2009;

  • -seat class B: an economy class passenger seat, outside the flight deck, and with effect from 1 April 2009, shielded from passengers by at least a curtain; if this seating position is in the passenger compartment, a adjacent passenger seat shall be located in the passenger compartment. Seat not separated by a gangway, occupied by any other crew member, but not separated by any other crew member;

  • -cumulative duty hours: hours referred to in section 1.1100 of the Regulation.


Article 2 Maximum flight duty period

  • 1 In determining the flight duty period, ground time shall be taken into account in full.

  • 2 By way of derogation from the first paragraph, if within a flight duty period a one-ground time exceeds two and a half hours, the duration of the period shall be considered as intermission to a maximum of two-and-a-half hours, and may be the maximum of the period of time to be Flight duty period shall be extended for the duration of this break, provided that the crew member does not carry out any work on behalf of the air carrier during this break.

Article 3. Rest

If the time zone difference between the beginning and the end of a flight duty period is four hours or more, the following shall be:

  • a. At home base the minimum rest specified in section 1.1110, point 1.1, of the Regulation, plus the time zone difference between home base and the place where the previous flight duty period is caught, to a rest of at least 16 hours;

  • b. Outside the home base the minimum rest, referred to in section 1.1110, under 1.2, of the Regulation, increased by four hours, to a rest of at least 14 hours.


Article 4. Reduced rest period

  • 1 In order to implement Article 4.5:4, second paragraph, of the Decision , the minimum rest period at home base may be shortened, provided that:

    • a. the minimum period of rest provided for in point 1.1110 (1.1) of the Regulation shall be reduced by no more than two hours;

    • b. The flight duty period following an abbreviated rest period shall be shortened by number of hours; and

    • The rest period following the flight duty period referred to in subparagraph (b) is not less than the minimum rest period pursuant to section 1.1110, point 1.1, of the Regulation, plus the difference between the reduced rest period and the minimum rest period.

  • 3 For planning purposes, at the flight duty periods, listed in the table in Annex A , a margin of 30 minutes relative to the maximum flight duty periods after shortened rest.

  • 4 An abbreviated rest period of less than 7,5 hours starting outside the home base, and an abbreviated rest period of less than 10 hours starting at home base shall be considered as ground time.

  • 5 Only in the event that a crew member does not carry out or will carry out any work, the rest period may be shortened several times, it being understood that the difference between the reduced rest periods and the minimum rest periods In respect of parts 1.1 and 1.2 of section 1.1110 of the Regulation, it is to be compensated after the end of the last shift.

  • 6 A second local night may, by way of derogation from section 1.1095 (1.9) of the Regulation, commence at 8.00 p.m. local time if the weekly rest period, referred to in Section 1.1110 of the Regulation, is at least 40 hours.


Article 5. Renewal

  • 1 On a flight duty period following an abbreviated rest period as referred to in the first and second members of the Article 4 , no extension, as referred to in point 1.1105 (2) of the Regulation is applied.

  • 2 On a flight duty period following an abbreviated rest period as referred to in the first and second members of the Article 4 , renewals referred to in Parts 1.1115 and 1.1120 of the Regulation may be applied.


Article 6. Flight crew flight duty renewal

  • 1 In the case of the extension of the basic flight crew, the maximum flight duty period provided for in Section 1.1105 of the Regulation may be extended in accordance with the following table:

  • 2 Under the responsibility of the pilot-in-command, a repayment schedule shall be drawn up. The number of hours of rest for each flight crew member on board shall be at least equal to 50% of the extension of the flight duty period, with a minimum of 1 hour.

  • 3 The extension is possible only for flights consisting of a maximum of four sectors.


Article 7. Flight crew flight duty renewal period

  • 1 The maximum flight duty period for cabin crew, referred to in Section 1.1105 of the Regulation, may be extended in the case of the provision of rest period during flight with:

  • 2 Under the responsibility of the pilot-in-command, a repayment schedule shall be drawn up. The number of hours of rest for each cabin crew member on board shall be at least equal to 50% of the extension of the flight duty period, with a minimum of 1 hour.

Article 8. Standby

  • 1 If airport preparedness is immediately followed by a flight service, that airport standby shall be counted in full for the flight duty period from the time of notification.

  • 3 The maximum duration of each standby at a place other than the designated reporting point does not exceed a 12 hour period.

  • 4 The period between the end of preparedness and the start of a subsequent period of preparedness shall be at least eight hours.

  • 5 If a call for sign-on for a flight takes place within three hours of the start of preparedness, the flight duty period shall be determined in accordance with section 1.1105 or 1.1115 of the Regulation.

  • 6 If a call for sign-on for a flight takes place after the first three hours of standby and the time of notification occurs within eight hours of this call, the maximum flight duty period shall be determined in accordance with section 1.1105 or 1.1115 of the Regulation, shortened, depending on the time of notification. The reduction shall be determined in accordance with the table in Annex B , associated with this scheme.

  • 7 If the start time of a flight service is suspended, the time between the original reporting time and the actual reporting time shall be considered to be preparedness and the flight duty period shall be corrected in accordance with the table. in Annex B .

  • 8 Per local day, it is not allowed to be on standby for more than 12 hours.

  • 9 The maximum number of standby hours is 60 in each period of seven consecutive days.

  • 10 Per local day no more than one period of preparedness shall be included in a duty roster. The period mentioned in connection with the seventh paragraph shall be disregarded in this respect.

  • 11 Paraaing hours as referred to in point 1.1125 (2) of the Regulation shall be counted in half for the purposes of determining cumulative duty.

This scheme shall be reviewed one year after its entry into force.


Article 10. Entry of

This arrangement shall enter into force at the time of its entry into force. Operation Decision (Stb. 2006, (371) shall enter into force.
