Regulation of the Minister of Social Affairs and Employment of 16 December 2005, Executive Board of Social Insurance, No. SV/F&W/2005/102687 laying down rules regarding the expiration of the second maximization clause in the Toeslagenwet
The Minister for Social Affairs and Employment,
Having regard to Article 44 of the Toeslagenwet , Article 63 of the Income Provision Act older and partially unemployed unemployed workers and Article 63 of the Income Provision Act older and partly disabled self-employed workers ;
Decision:
1 On the grounds of Article 44 of the Toeslagenwet At the time of the ministerial arrangement, the following shall be determined at
a. 31 December 2008 for persons who, on the day prior to the entry into force of Article 1.10, Section C, of the Act of Inlining and Financing Law Work and Income to Labor were entitled to a benefit on the basis of the Disease law or right to pay, intended in Article 629 of Book 7 of the Civil Code ;
b. 1 January 2006 for persons who, on the day prior to the entry into force of this Regulation, Article 1.10, Section C, of the Act of Inlining and Financing Law Work and Income to Labor were entitled to a benefit on the basis of the Incapacity for work insurance , the Law for incapacity for the self-employed , the Law on incapacity for work of young handicapped persons or the Law on incapacity for work in the military ;
c. 29 December 2005 for persons who, on the day prior to the entry into force of this Regulation, Article 1.10, Section C, of the Act of Inlining and Financing Law Work and Income to Labor were entitled to a benefit on the basis of the Unemployment law or on the basis of Chapter 3, Section 2, Section 1, of the Law of Work and Care .
2 By way of derogation from the first paragraph, section c, it shall be based on Article 44 of the Toeslagenwet time to be determined by ministerial arrangement on 3 April 2006 for persons who, on the day prior to the entry into force of this Regulation, Article 1.10. section C, of the Act Inlining and Financing Law Work and Income to Labor were entitled to a benefit on the basis of the Unemployment law and for whom Article 8, sixth paragraph, of the Toeslagenwet As it stands, after the entry into force of the Law Introduction and financing Act and income on work ability , applicable.
On the basis of Article 63 of the Income Provision Act older and partially unemployed unemployed workers the date of reference at ministerial level is to be fixed on 1 January 2006.
On the basis of Article 63 of the Income Provision Act older and partly disabled self-employed workers the date of reference at ministerial level is to be fixed on 1 January 2006.
This arrangement shall enter into force on 29 December 2005.
This arrangement will be set out in the Official Journal.
