Having regard to Article 27, first and third paragraphs , and Article 28 (1) and (3) of the Decision on passenger transport 2000 and Article 14 of the General Law on Recognition of Vocational Training ;

The Central Bureau shall be designated as the examination institute responsible for the organisation and certification of the examinations referred to in Article 8 (1) of Regulation 1071 /2009/EC.

For the purposes of this paragraph, 'EC declaration of taxi transport' means an EC declaration issued under the EC declaration issued for the carriage of goods by a carrier as intended for the purpose of the operation of Article 10 of the General Law on Recognition of Vocational Training .

As a certificate, intended in Article 28, first paragraph, point (a) of the Decision on passenger transport 2000 The following shall be recognised:

  • a. The certificate of proficiency for taxi transport issued by the Central Office of the Department of Proficiency Certificates;

  • (b) the certificate provided for in Article 27 of the Transport Decision 2000 .

The examination competence for taxi transport shall be subject to at least the knowledge of the competent authorities. Annex said topics.

The application for the issue of an EC declaration of taxi transport shall be submitted:

Our Minister provides an EU declaration of taxi transport:

  • a. if, to the satisfaction of our Minister, it has been shown that the training received by the applicant is not substantially different from the training prescribed in the Netherlands;

  • (b) in the event that the training provided by the applicant in the opinion of Our Minister differs substantially from the training prescribed in the Netherlands, after, by choice, an aptitude test has been made, an adaptation period has been made to the discretion of the applicant followed, within the meaning of Article 11 of the General Act on Recognition of the EU Professional Qualifications ; or

  • (c) in the event that the applicant has not received training and during the 10 years preceding the application for three years, full-time or equivalent time, the occupation operator who has carried out taxi services, after an aptitude test has been made to the choice of Minister, an adaptation period has been followed, in the sense of Article 11 of the General Act on Recognition of the EU Professional Qualifications .

  • 1 When assessing the application, Article 6 Our Secretary of State may seek advice from the Central Bureau of Driving Licence.

  • 2 The opinion referred to in paragraph 1 shall contain an indication of the substantial differences which the aptitude test must cover as a result of the adaptation period and, in the case of an adaptation period, an indication of: the duration thereof.

(as intended) Article 5 of the occupational and occupational transport professional scheme)

The examination competence for the provision of taxi transport shall be subject to at least the knowledge of the following subjects.


Civil law

In particular, the applicant shall:

  • 1. have knowledge of the most important contracts used in the transport of persons and of the rights and obligations arising therefrom;

  • 2. are able to deal with a legally valid contract of carriage, in particular as regards the conditions of transport;

  • 3. are able to investigate a complaint made by his client in connection with damage or damage to their baggage suffered by travellers as a result of an accident during transport or in connection with damage caused by delay and may determine the consequences of the complaint for his contractual liability.


Commercial law

In particular, the applicant shall:

  • 1. knowledge of the conditions and rules governing the exercise of business and the general obligations of economic operators (registration, accounting, etc.) and of the consequences of bankruptcy;

  • 2. have the knowledge required of the different forms of enterprise and the related rules on the establishment and functioning of the works.


Social law

In particular, the applicant shall:

  • 1. to be aware of the role and operation of various social institutions in the field of road passenger transport (trade unions, works councils, staff representation, labour inspectorate, etc.);

  • 2. knowledge of the obligations of the employer in the field of social security;

  • 3. knowledge of the rules on employment contracts for the different categories of workers of passenger transport undertakings (form of agreement, obligations of the parties, working conditions and working time, holidays with a view to the the maintenance of pay, salary, termination of the contract, etc.);

  • 4. knowledge of the provisions concerning working time in transport, as well as the manner in which these provisions are applied in practice.


Tax law

The candidate shall, in particular, have knowledge of the rules governing:

  • 1. VAT on transport services;

  • 2. 'motor vehicle tax';

  • (3) the levies on certain vehicles used for the carriage of passengers by road, as well as tolls and user charges for the use of certain infrastructures;

  • 4. income tax.


commercial and financial management

In particular, the applicant shall:

  • 1. knowledge of the legal provisions and practices relating to the use of cheques, bills, promissory notes, credit cards and other means of payment or methods;

  • 2. knowledge of the different forms of credit (bank credit, documentary credit, deposits, mortgages, leasing, renting, factoring, etc.) and the related burdens and obligations;

  • 3. knowing what a balance sheet is, how a balance sheet is drawn up and should be interpreted;

  • 4. be able to read and interpret a profit and loss account;

  • 5. to analyse the financial situation and profitability of the undertaking, in particular on the basis of financial accounting;

  • 6. be able to draw up a budget;

  • 7. know how its cost is constituted (fixed costs, variable costs, operating costs, depreciation etc.) and can make calculations by vehicle, per kilometre, per trip or per person;

  • 8. an organisational chart for all employees of the company and work schedules etc. able to prepare;

  • 9. knowledge of the principles of market research (marketing), sales promotion for transport services, the setting up of customer files, advertising, public relations, etc.;

  • 10. knowledge of the different types of insurance that are relevant for transport activities (liability insurance, insurance of passengers, baggage) and the related safeguards and obligations;

  • 11. have knowledge of telematic applications in the field of transport;

  • 12. apply the rules relating to fares and pricing in passenger transport;

  • 13. may apply the rules governing the invoicing of passenger transport services.


access to the market

In particular, the applicant shall:

  • 1. have knowledge of the professional rules governing passenger transport by road on behalf of third parties, the renting of commercial vehicles, subcontracting, in particular the rules relating to the official professional organisation, access to the profession, permits for transport, as well as enforcement and penalties;

  • 2. have knowledge of the rules governing the setting up of a transport undertaking;

  • 3. knowledge of the various documents required for the implementation of transport services and control procedures may develop to ensure that they are met at the firm's office and on board the vehicles. corresponding documents shall be present in respect of each consignment of transport carried out, in particular the documents relating to the vehicle, the driver and the baggage;

  • 4. knowledge of the rules governing the organization of the market for the carriage of passengers by road;

  • 5. knowledge of the rules governing the introduction of new transport services and transport plans may be drawn up.


technical standards and exploitation

In particular, the applicant shall:

  • 1. have knowledge of the requirements concerning the weights and dimensions of vehicles;

  • 2. depending on the needs of the undertaking, the vehicles and their components may be chosen (chassis, engine, transmission systems, brake systems, etc.);

  • 3. have knowledge of the formalities relating to the approval, registration and technical inspection of the vehicles;

  • 4. are able to take the necessary measures against air pollution by emissions from motor vehicles and against noise pollution;

  • 5. To prepare periodic maintenance plans for vehicles and equipment.


Safety on the road

In particular, the applicant shall:

  • 1. to know which certificates the driving staff must have (driving licence, medical certificate, certificate of behaviour, etc.);

  • 2. may take measures to ensure that drivers comply with the applicable traffic regulations (speed limits, priority rules, rules on stopping and parking, use of lights, traffic signs, etc.);

  • 3. are able to draw up instructions for drivers on the control of safety standards relating to the state of the transport equipment, equipment and preventive measures to be taken;

  • 4. to establish procedures to be followed in the event of an accident and to apply the procedures necessary to prevent the recurrence of accidents or serious infringements;

  • 5. to have an elementary knowledge of the structure of the road network.
