Arrangement of the State Secretary for Economic Affairs of 5 February 2015, No WJZ/14108646, implementing Regulation 1305/2013 on rural development (Scheme implementing EAFRD programme period 2014-2020)

Having regard to:

Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 on common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for rural development and the European Maritime and Fisheries Fund and general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Maritime Affairs Fund, and fishing, and repealing Regulation (EC) No 148/EC, 1083/2006 by the Council (PbEU L347/320);

Regulation (EU) No 1305/2013 of the European Parliament and of the Council of 17 December 2013 on support for rural development (EAFRD) and repealing Regulation (EC) No 1305/2013 of 17 December 2013 on support for rural development (EAFRD) Council Regulation (EC) No 1698/2005 (PbEU L 347/487);

Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management and monitoring of the common agricultural policy and repealing Regulations (EC) No 1306/2013 of the European Parliament and of the Council of 17 December 2013 on the financing, management 814/2000, (EC) No 814/2000 1290/2005 and (EC) No Council Regulation (EC) No 485/2008 (PbEU L 347);

Regulation (EU) No Commission Regulation (EC) No 807/2014 of 11 March 2014 supplementing Regulation (EU) No 807/2014 1305/2013 of the European Parliament and of the Council on assistance for rural development from the European Agricultural Fund for Rural Development (EAFRD) and introducing transitional provisions (PbEU L 227);

and the Articles 15 and 19 of the Agricultural Act ;

Article 1

For the purposes of this arrangement:

  • - managing authority: Managing authority as referred to in point (a) of Article 65 (2) of Regulation (EU) No 1305/2013;

  • - Paying agency: recognised paying agency as referred to in Article 7 of Regulation (EU) No 1306/2013;

  • - certification body: certification body as referred to in Article 9 of Regulation (EU) No 1306/2013;

  • - concrete action: concrete action as referred to in Article 2 (9) of Regulation (EU) No 1303/2013;

  • - Minister: Minister for Economic Affairs;

  • - rural development programme: Rural development programme as referred to in Article 6 (1) of Regulation (EU) No 1305/2013, as for the Netherlands with respect to the programming period 2014-2020 approved by the European Commission, including the amendments to this programming document approved by the European Commission;

  • - Provincial Administration: Provincial government as referred to in Article 5 (a) of the ProvincieAct ;

  • - Rijksdienst for Enterprise Netherlands: the Directorate-General for National Service for the Internal Market of the Netherlands of the Ministry of Economic Affairs;

  • - Regulation (EU) 1303/2013: Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 on common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for rural development and the European Maritime and Fisheries Fund and general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Maritime Affairs Fund, and fishing, and repealing Regulation (EC) No 148/EC, 1083/2006 by the Council (PbEU L347/320);

Pursuant to Article 65 (2) of Regulation (EU) No 148/ 1305/2013 are designated:

  • a. as managing authority: the Minister;

  • b. as a accredited paying agency: the National Service for the Netherlands;

  • c. as a certification body: the State Audit Service of the Ministry of Finance.

Chapter 2. Delegations to the Management Authority

Article 3

  • 1 The Minister is responsible, in accordance with Article 66, second paragraph, of Regulation (EU) No 248/62. 1305/2013, the management and implementation of operations covered by Articles 14, 17, first paragraph (a), (c) and (d), 28, 35, 42 to 44 of Regulation (EU) No 1305/2013, 1305/2013 and Articles 33 to 35 of Regulation (EU) No 1305/2013, 1303/2013, eligible for support, to the provincial board of the respective provinces.

  • 2 For the purposes of the management and execution of operations referred to in paragraph 1, the following shall be understood as:

    • (a) the setting of conditions for the operations which may be eligible for aid;

    • b. It is in accordance with Article 49 of Regulation (EU) No 1305/2013 establish criteria for the selection of concrete actions to be carried out by the province concerned;

    • c. the ex ante assessment of the verifiability and controllability of the measures referred to in Article 62 of Regulation (EU) No 1305/2013;

    • d. the assessment of the verifiability and controllability of the measures during the implementation of the rural development programme referred to in Article 62 of Regulation (EU) No 1305/2013;

    • (e) implementation of Article 66 (c) (h) and (i) of Regulation (EU) No 1305/2013;

    • f. the establishment of a Committee pursuant to Article 33, third paragraph, of Regulation 1303/2013 ;

    • g. to make available adequate information to the Minister for implementation of Article 50 of Regulation (EU) No 1303/2013.

At the request of the managing authority, the provincial management of the respective provinces shall provide the information necessary for the implementation of point (a), (b), (d), (f) and (g) of Article 66 of Regulation (EU) No 248/67. 1305/2013.


Article 5

The provincial management of the respective provinces shall, in accordance with Article 2 of Regulation (EU) No 807/2014, specific conditions regarding access to aid for a young farmer for the purposes of the management and implementation of operations as referred to in Article 4 (2) of the EC Treaty.   • 1 The provincial management of the various provinces shall ensure that Article 33 and Article 34, second paragraph, of Regulation (EU) No 2461/17 of the EC Treaty are implemented. 1303/2013.

  • 2 The Provincial Executive of the Distinguished Provinces may, in the performance of the tasks referred to in Article 3 , implementation of Article 70, second paragraph, of Regulation (EU) No 3248/ 1303/2013.

Chapter 4. Monitoring Committee

  • 1 In implementation of Article 47, first paragraph, of Regulation (EU) No 1303/2013 and Article 74 of Regulation (EU) No 1305/2013, there is a Committee of Supervision.

  • 2 The Committee of Supervision shall consist of the following members:

    • (a) The Minister or his/her representative, also Chairman;

    • b. Members entitled to vote, namely:

      • 1 °. representation appointed by the Minister;

      • 2 °. represented by the representatives of the Member States of the respective provinces.

    • c. Advisory members, namely:

      • 1 °. a representative appointed by the Association of Dutch Municipalities;

      • 2 °. a representative designated by the Union of Waterboards;

      • 3 °. a representative appointed by the social and economic partners;

      • 4. a representative designated by nature and environmental organisations;

      • 5 °. a representative appointed by the agricultural organisations;

      • 6 °. a representative appointed by the European Commission.

  • 3 The appointment of a representative on the basis of paragraph 2, which is not made by the Minister and the appointment of the Deputy Chairman, shall be communicated to the Minister by the designating organizations.

  • 4 The Secretary of State shall designate the Secretariat of the Supervisory Committee.

For the implementation of Article 54 of Regulation (EU) No 1305/2013, there is a Network of Rural Platland, which will be accommodated by the managing authority.

This arrangement shall enter into force from the day following the date of issuance of the Official Journal in which it is placed.
