Regulation of the Minister for Agriculture, Nature and Food Quality of 17 August 2007, No TRCJZ/2007/2706, establishing the Rules of Procedure of the Plant Health Service, KCB, BKD, Nakhorticulture and NAK (Scheme for Plant Health Service and Certifying Services)

Having regard to Article 13 (d) of Directive No 2002/89 of the Council of the European Union of 28 November 2002 (PbEG L 355) amending Directive 2000 /29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community, and Article 6a of the Law on Plant Health (Stb. 1951, 96);

Article 1

For the purposes of this arrangement:

  • a. Minister: Minister for Economic Affairs;

  • b. Commission: Commission of the European Communities;

  • c. Regulation 1756/2004 : Regulation (EC) 1756/2004 Decision of 11 October 2004 laying down detailed conditions for the directions required and the criteria relating to the type and level of the restriction of plant health checks on certain products listed in Annex V, Part B, to Directive 2000 /29/EC plants, plant products or other objects referred to in the Council (PbEG L 316);

  • ed. Directive 2000 /29/EC : Directive 2000 /29/EC the Council of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community (OJ 2000 L 169);

  • Directive 2008 /61/EC: Commission Directive 2008 /61/EC of 17 June 2008 laying down the conditions under which certain harmful organisms, plants, plant and vegetable products listed in Annexes I to V to Council Directive 2000 /29/EC products and other materials used for experiments or scientific purposes and for selection work in the Community, or in certain protected areas thereof, or transferred to another place (PbEU L 158);

  • f. Party: number of units of a product forming part of a consignment, recognisable by the homogenous composition and origin;

  • g. consignment: quantity of goods which is accompanied by a single document for the purposes of customs or other formalities, such as a phytosanitary certificate or other document or other mark; a consignment may consist of one or more lots;

  • h. applicant: the person applying for the inspection or other activities of the NVWA or the inspection department, and in so far as the import is concerned the importer or his customs representative;

  • (i) Member State: shall mean the European Community, excluding the French overseas departments, the Canary Islands, Ceuta and Melilla;

  • j. generally recognised holidays: New Year's Day, Christian Second Paas-and Pentecost, both Christmas Days, Ascension Day, Day on which the Queen's birthday is celebrated and 5 May:

  • k. office hours: from Monday to Friday, with the exception of generally recognised public holidays, from 07.00 a.m. to 5 p.m.;

  • l. NVWA: Dutch Food and Warenauthority, benefits-expense service of the Ministry of Economic Affairs;

  • m. KCB: Stichting Kwalality-Control-Bureau, established in The Hague;

  • n. BKD: Stichting BloembollenInspection Service, established in Lisse;

  • o. Nakhorticulture: Stichting Nederlandse General Quality Dienst Horticulture, based in Roelofarendsveen;

  • p. NAK: Foundation of the Netherlands General Inspection Service for Seeds and seedlings of agricultural crops established in Emmeloord;

  • q. inspection service: KCB, BKD, Nakhorticulture or NAK;

  • CITES Convention: Convention on International Trade in Endangered Species of wild fauna and flora (Trb). 1975, 23);

  • Emergency sampling: sampling for which the best possible treatment is most rapidly applied;

  • (t) emergency investigations: research for which the most rapid treatment is possible;

  • u. quality inspections: inspections of plants and plant products on the basis of the Agricultural quality law or the Seed and Plant Law Act ;

  • CN code: a code as referred to in Annex I to Regulation (EEC) No 2028/EEC. Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (PbEG 1987, L 256),

  • Implementing Decision No 2013 /92/EU: implementing Decision No Commission Decision 2013 /92/EU of 18 February 2013 on the supervision, plant health checks and the measures to be taken in respect of wood packaging material used for the transport of specific goods originating in the European Union China (PbEU 2013, L 47).

This arrangement shall be based on the Articles 28, 1st paragraph , and Paragraph 37, Fifth paragraph of the Plant Protection Products Act and Biocidal Products .

Chapter 2. Rates of the NVWA

§ 2.1. Inspections and other activities

Article 2

  • 1 The applicant shall be charged the following rate as compensation for the costs of carrying out phytosanitary activities for consignments offered for import, export and trade in the trade:

    • a. if the work is carried out on request during office hours, a basic rate of € 194.32 per inspection application plus a tariff of € 1.62 per minute

    • b. if the work is carried out on request outside office hours, a basic rate of € 252,62 per inspection application plus a tariff of:

      • 1 °. € 388,64 if the inspection does not exceed 3 hours;

      • 2 °. € 388,64 plus € 2,11 per minute, in so far as the inspection exceeds 3 hours.

  • 2 As compensation for the costs of issuing a phytosanitary certificate and the conduct of the final examination for the purposes of that certificate as referred to in Article 15 of the Import, Export and Movement of Plants, the applicant shall be the Next fee charged:

    • (a) in the case of operations which, if it were not the specific phytosanitary activities mentioned in the chapeau, would be carried out by the SCI, the charges referred to in Article 9 , 14 , 15, second paragraph , 16 , 17 and 18 , where Article 19 is applicable mutatis mutandis;

    • (b) in the case of operations which, if it were not the specific phytosanitary activities mentioned in the chapeau, would be carried out by the BKD, the charges provided for in Article 20 , 23 , 25 , 26 and 27 , where the Articles 21 and 28 apply mutatis mutandis;

    • c. in the case of the work which, if it was not the specific phytosanitary activities mentioned in the chapeau, would be carried out by the Nakhorticulture, the tariffs referred to in Article 29 , 32 , 33, second paragraph , 34 , 35 and 36 , where the Articles 30 and 37 apply mutatis mutandis;

    • d. in the case of the work which, if it was not the specific phytosanitary activities mentioned in the preamble, would be carried out by the NAK, the tariffs as referred to in Article 38 , 41, second paragraph , 42 , 43 and 44 , where the Articles 39 and 46 apply mutatis mutandis.


Article 2a

In the case of reimbursement of the costs of issuing an import authorisation directive necessary for the issue of a phytosanitary certificate in a consignment for which a third country has issued an import licence, the applicant shall be entitled to the refund. a fee charged from € 199.99.


Article 2b

  • 1 The control rate for wood packaging material referred to in Implementing Decision No 2013 /92/EU of consignments originating in China:

    • a. With CN code 2514 00 00, 2515, 2516, 6908 or 7210 15%;

    • b. with CN code 6801 00 00, 6802 or 6803 00 shall be 50%.

  • 2 As compensation for the cost of phytosanitary activities as referred to in implementing Decision No 2013 /92/EU, the applicant shall be charged the following rate, with the weight of the consignment rounded up to the top of tons:

    • a. For a consignment originating in China imported into the European Union, with CN code 2514 00 00, 2515, 2516 or 6908, € 1,47 per tonne, with a minimum of € 7,35 and a maximum of € 1,470,00 per consignment;

    • b. For a consignment originating in China, imported into the European Union by CN code 6801 00 00, 6802 or 6803 00, € 7,79 per tonne, with a minimum of € 7,79 and a maximum of € 7,790,00 per consignment;

    • c. For a consignment originating in China imported into the European Union by CN code 7210, € 0,60 per tonne, with a minimum of € 6,00 and a maximum of € 600,00 per consignment.

  • 3 As compensation for the costs of processing inspection applications for wood packaging material as referred to in Implementing Decision No 2013 /92/EU of consignments originating in China which are not notified via the electronic pre-notification system CLIENT Import, shall be charged € 39,75 per consignment in addition to the tariff referred to in the second paragraph.


Article 3

If the person responsible for carrying out the work, is intended to Article 2, first paragraph If requested at a given time and place is present, but the work cannot be carried out under the circumstances of the person in charge of that work, the applicant shall be charged as a cost taking into account:

As compensation for the costs of withdrawing a cultivation ban as referred to in Article 4 (1) of the EC Treaty Article 2 of the Combating Harmful Organisms Scheme The applicant shall be charged a fee of € 25.45 for the purpose of administrative handling.


§ 2.2. Laboratory studies

If, in the course of the proceedings, Article 2 , where laboratory testing is necessary, the applicant shall be charged € 165.10 per sample taken in excess of the allowance provided for in that Article.


§ 2.3. Certificates, licences and exemptions

The applicant shall be charged € 63,60 per certificate for the purpose of which licence or non-inspection consignments are to be certified.

  • 1 For the treatment of an application for approval as referred to in Article 2, first paragraph, of Directive 2008 /61/EC, the applicant shall be charged € 1,125,44 per application.

  • 2 If an initial risk analysis is carried out, a starting rate of € 194.32 per visit plus a rate of € 1.62 per minute shall be charged. Where costs are incurred by third parties, they shall be charged, in addition to the rates set out in this paragraph.

  • 3 By way of derogation from the first paragraph, for a minor amendment to the approval provided for in Article 2 (1) of Directive 2008 /61/EC, € 242,90 shall be charged.

  • 4 If it is necessary for the assessment of the application referred to in paragraph 1 to check the relevant material for the presence of harmful organisms, the applicant shall be charged € 165,10 per sample for the purpose of such checking. shall be taken

  • For verification of compliance with the conditions attached to the licence referred to in paragraph 1, the applicant shall be charged € 1,125,44 per licence per year.

  • 6 For the purpose of examining an application for a licence as referred to in Article 2, second paragraph, of Directive 2008 /61/EC, the applicant shall be charged € 111,72.

  • 7 Where multiple licences as referred to in Article 2 (2) of Directive 2008 /61/EC are applied for at the same time, the applicant for one licence shall, by way of derogation from the fifth paragraph, € 111,72 and, for each other, equal € 54,88 charged.

§ 2.4. Payment and recovery

  • 1 For letters sent by the NVWA under this scheme, a payment period of two weeks shall apply from the date of the notes.

  • 2 The debtor is in default if he has not paid within the period laid down in the first paragraph.

  • 4 Legal interest shall not be payable if the amount of the statutory interest is less than € 20,00 by some or last payment.

  • The Inspector General of the NVWA shall make the debtor the debtor who is in default in writing until payment within two weeks from the day following that on which the notice was sent.

  • 6 The notice of formal notice states that in the event of a non-timely payment, it may be enforced by means of recovery measures to be carried out at the debtor's expense.

  • 7 As a fee for a formal notice as referred to in paragraph 5, a tariff shall be charged to:

    • a. € 6,00 if the debt is less than € 454,00;

    • b. € 14,00 if the debt is € 454,00 or more.

  • 8 If the debtor is in default, the debtor may be determined as long as it is not satisfied that the performance of the work or the supply of materials can be effected only if a Minister is a good person. For a period of two years, the bank institution to be approved shall deposit the amounts due in respect of that amount.

  • 9 For existing claims, judicial recovery may be made.

  • 10 In cases to be determined by the Minister, cash payment of the work referred to in the proceedings may be made by the official responsible for the work Article 2 , be required.

  • 11 Where chargeable, the turnover tax is deemed to be included in the tariff.

Chapter 3. Fees of the SCI

§ 3.1. Inspections and other activities

Article 9

The applicant shall be charged the following rate in order to compensate for the costs of carrying out phytosanitary activities in respect of consignments offered for import, export and trade in trade:

  • a. If the work is carried out on a request on Monday, Tuesday, Wednesday, Thursday or Friday in the period from 06.00 a.m. to 8 p.m., a starting rate of € 47,68 per inspection application plus a rate of € 1.49 per minute;

  • b. if the work is carried out on request on Saturday or Monday, Tuesday, Wednesday, Thursday, Thursday or Friday in a period other than the period specified in subparagraph (a), a starting rate of € 71,52 per inspection application plus a Rate of € 2,24 per minute;

  • c. if the work is carried out on request on Sunday or on a publicly recognised public holiday, a starting rate of € 95,36 per inspection request plus a tariff of € 2,98 per minute;

  • d. A fee for the control of documents of € 10.43 per import consignment;

  • e. a fee for the verification of the declaration in CLIENT Import and transport documents at a submitted inspection of € 5.96 per import consignment;

  • f. if an export certificate or certificate for authentication of an electronic certificate is requested via CLIENT Export, an amount of € 5.28 for the issue of the certificate or the code.

  • 1 For inspection of cut flowers, for which the Commission complies with Article 2 of the Regulation No 1756/2004 reduced inspection frequencies on import, as recorded in the Annex in this arrangement, the applicant shall, by way of derogation from Article 9 , the following rate charged when required handling of the inspection on Monday, Tuesday, Wednesday, Thursday or Friday in the period from 06.00 am to 8 p.m.:

    • a. A fee for the control of documents of € 10.43 per consignment;

    • (b) per lot a tariff per 1000 steal, with the number of stolen goods rounded up in units of 1000, which is related to the inspection frequency established by the Commission, with a minimum rate and a maximum rate for each lot, as shown in the table below:

  • 1 For inspection of cut flowers, for which the Commission complies with Article 2 of Regulation No 1756/2004 reduced inspection frequencies on import, as recorded in the Annex in this arrangement, the applicant shall, by way of derogation from Article 9 , the following rate charged upon desired handling of the inspection outside the period specified in Article 10, first paragraph :

    • a. A fee for the control of documents of € 10.43 per consignment;

    • b. on Saturday or Monday, Tuesday, Wednesday, Thursday, or Friday in any period other than the period specified in Article 10, first paragraph , per lot a tariff per 1000 steal, whereby the number of stolen goods is rounded up to units of 1000, which is related to the inspection frequency established by the Commission, with a minimum rate and a maximum rate per lot, as shown in the following table:

  • 1 For the inspection of fruit and vegetables, for which the Commission complies with Article 2 of Regulation No 1756/2004 reduced inspection frequencies on import, as recorded in the Annex in this arrangement, the applicant shall, by way of derogation from Article 9 , the following rate charged when required handling of the inspection on Monday, Tuesday, Wednesday, Thursday or Friday in the period from 06.00 am to 8 p.m.:

    • a. A fee for the control of documents of € 10.43 per consignment;

    • b. per party a rate per ton, with the lot weight rounded up in tons, which rate is related to the inspection frequency set by the Commission, with minimum rate per lot as shown in the the table below:

  • 1 For the inspection of fruit and vegetables, for which the Commission complies with Article 2 of Regulation No 1756/2004 reduced inspection frequencies on import, as recorded in the Annex in this arrangement, the applicant shall, by way of derogation from Article 9 , the following rate charged upon desired handling of the inspection outside the period specified in Article 12, first paragraph :

    • a. A fee for the control of documents of € 10.43 per consignment;

    • b. on Saturday or Monday, Tuesday, Wednesday, Thursday, or Friday in any period other than the period specified in Article 12, first paragraph , per party a rate per ton, with the lot weight rounded up in tonnes, which rate is related to the inspection frequency set by the Commission, with minimum rate per lot as shown in the the table below:

  • 2 For an inspection request relating to a lot which was part of an already approved consignment, the applicant shall be the tariff referred to in Article 9 charged.

  • 3 For inspection of fruit and vegetables covered by the provisions of Directive 2000 /29/EC in all cases, an import inspection should be made, Article 9 applicable.


Article 13a

In the case of the reduced inspection frequencies on import as included in the Annex This scheme differs from the reduced inspection frequencies of imports as included in the list referred to in Article 2 (2) of Regulation (EC) No 1756/2004, shall be subject to the reduced inspection frequencies as set out in the list provided for above.

For processing inspection requests that are not notified through the electronic pre-login system CLIENT Export and CLIENT Import respectively, in addition to the rate specified in Article 9 Respectively Articles 10 to 13 , a base rate of € 22,35 per consignment charged, plus a tariff of € 0.75 per consignment to be exported respectively.

  • 2 For the purpose of facilitating the phytosanitary export certification of a consignment of plants or plant products by a Member State other than the Member State of origin, for the purpose of facilitating the phytosanitary export certification of a consignment of plants or plant products, the Commission shall, at the request of the applicant, be applicant for each document the tariff referred to in Article 33, second paragraph charged.


Article 16

If the person responsible for carrying out the work, as provided for in the Articles 9 to 13 , if requested at a given time and place is present, but the work cannot be carried out under the circumstances of the person in charge of that work, or if fewer consignments or lots are ready The applicant shall be charged an amount of € 137.08 for inspection purposes than the inspection application to which the inspection application relates.


§ 3.2. Laboratory studies

  • 2 By way of derogation from the first paragraph, instead of: Article 4 rate of duty, for laboratory testing of Ditylenchus dipsaci in Allium spp. the amount plus the tariff referred to in Article 35, part e -, per conducted research.

  • 3 In derogation from the first paragraph, for laboratory examination of Radopholus similis in potted plants the tariff is intended to be used in Article 35, part f , charged per conducted survey.


§ 3.3. Certificates

  • 1 For the purpose of marking and issuing an export certificate, for the purposes of inspection and non-inspection consignments, the applicant shall be charged € 7,45 per certificate.

  • 2 As a fee for making a business visit to mark certificates, the applicant shall be the starting rate in accordance with Article 9, parts a, b or c ............

  • 1 For the notes sent by the SCI under this scheme, a payment period of two weeks shall apply from the date on which the notes were dated.

  • 4 Legal interest shall not be payable if the amount of the statutory interest is less than € 20,00 by some or last payment.

    • d. if the work is done on request on Saturday or Monday Tuesday, Wednesday, Thursday or Friday in a period other than the period specified in part a, a basic rate of € 73,73 per inspection application plus a Rate of € 2,00 per minute;

    • e. if the work is carried out on request on Sunday or on a publicly recognized public holiday, with the exception of 5 May, a basic rate of € 98,30 per inspection application plus a tariff of € 2,66 per minute;

    • f. if an export certificate has been applied for via CLIENT Export, an amount of € 5.28 for the issue of the certificate plus a rate of € 5.00 per certificate for the exchange of phytosanitary data through the Chain Register For the purposes of electronic issuing of the export licence.

  • 2 For the reimbursement of costs for the provision of other plant health activities other than those referred to in this Chapter, the rates referred to in paragraph 1 shall apply.

  • f. To format a certificate whose data is not supplied via the CLIENT Export electronic system, is used in addition to the basic rate of Article 20 , a rate of € 25.20 per certificate charged.

    • e. if the inspection request is notified via the electronic pre-login system CLIENT Import, an amount of € 2,00 per consignment;

    • f. if an export certificate has been requested via CLIENT Export, an amount of € 5.28 for the issue of the certificate.

  • 2 By way of derogation from the first paragraph, no inspection may be requested for Monday, Tuesday, Wednesday, Thursday and Friday from 10 p.m. to 5.00, on Saturday from 4.30 a.m. to 8.30 p.m., and on Sunday or on a generally recognised public holiday of 16.30 hours until 8.30.

      • 1 °. in the case of seed potatoes, a tariff per inspection request of € 51,15 where the plant health inspection coincates with the quality inspection, and € 119.25 when the phytosanitary inspection takes place separately;

      • 2 °. for ware potatoes and other products a starting rate of € 73,20 per inspection request for the first batch on location, plus a rate of € 1,95 per minute for inspecting this lot and all parties ware potatoes and other products which are inspected at the same time during the same visit to the first batch.

    • c. If the work is carried out on request on Sunday or on a publicly recognized public holiday, with the exception of 5 May,

      • 1 °. for seed potatoes, a tariff of € 68,20 where the plant health inspection coincates with the quality assessment, and € 159,00 when the phytosanitary inspection takes place separately;

      • 2 °. for ware potatoes and other products a starting rate of € 97.60 per inspection application for the first batch on location, plus a rate of € 2,60 per minute for inspecting this lot and all parties ware potatoes and other products which are inspected at the same time during the same visit to the first batch;

    • d. If the proceedings are not requested before 11 a.m. to be carried out on the same day, which is a working day, between 1 p.m. and 6 p.m., or not before 5 p.m. be requested to be carried out on the following working day between 7 a.m. and 1 p.m., by way of derogation from the starting rates mentioned in parts a and b, a starting rate of € 97.60 per inspection request.

  • 2 The rates referred to in paragraph 1 for ware potatoes and other products shall also apply in the case of inspection applications only for administrative checks and related activities.

    • a. Brown rot and ring rot research € 33,80 for a sample of 1 to 20 tubers, € 40,50 for a sample of 21 to 40 tubers, € 60,50 for a sample of 41 to 100 tubers and € 93,80 for a sample of 101 to 200 tubers;

    • b. Brown or brown-rot research € 27,20 for a sample of 1 to 20 tubers, € 33,90 for a sample of 21 to 40 tubers, € 53,90 for a sample of 41 to 100 tubers and € 87,00 for a sample of 101 to 200 tubers;

    • c. Brown or brown-rot research on vitromaterial € 41,20 for a sample of 1 to 20 tubers, € 55,20 for a sample of 21 to 40 tubers, € 69,20 for a sample of 41 to 60 tubers, € 83,30 for a sample of 61 to 80 tubers, € 97,30 in a sample sample from 81 to 100 tubers and € 168.30 in the case of a sample of 101 to 200 tubers;

    • d. Brown rot and ring rotation research on vitroplants, € 57,80;

    • e. € 12,95 administration fees per application and a rate of € 1.00 per sample of treatment costs.

  • 4 As compensation for the costs of changing the sampling status for brown rot or ring rot afterwards, a tariff of € 111,00 is charged.

  • 1 As compensation for the costs of the investigation for the purpose of issuing a statement as intended Article 12b of the Combating Harmful Organisms Decision , the applicant shall be charged the following rate:

    • a. For research into potato fatigue:

      • 1 °. for AMEX 200 cc 1/3 ha and a result within two weeks € 70,70 per hectare, a result within six weeks of € 56,55 per hectare, a result for 1 April of next year of € 52,65 per hectare and a result before 1 September of next year of € 49,90 per hectare;

      • 2 °. for AMEX 600 cc 1 ha and a result within two weeks € 54,70 per hectare, a result within six weeks of € 43,75 per hectare, a result for 1 April of next year of € 40,70 per hectare and a result for 1 September of next year € 38,55 per hectare;

      • 3 °. for AMEX 500 cc 1/3 ha and rash within two weeks € 72,00 per hectare, rash within six weeks € 57.60 per hectare, rash before 1 April next year € 53,65 per hectare and rash before 1 September next year € 50,80 per hectare.

    • b. For the rates referred to in point (a), a minimum of three times the rate payable per hectare shall apply.

    • c. For emergency sampling and rash with results within 5 working days, a supplement of € 52,30 per application and € 10,45 per sample shall be charged.

  • 2 The following rate shall be charged for administrative processing:

    • a. For an investigation as referred to in the first member requested by the NAK Window, € 21,10 per parcel or parcel section;

    • b. For an investigation referred to in the first paragraph not requested electronically via the NAK Window, € 26,10 per parcel or parcel portion;

    • c. for the restoration of notified contaminations of wrongly notified, € 55,45 per parcel or parcel portion;

    • d. For sampling operations at 600cc per hectare, € 62,75 per parcel or parcel portion;

    • e. For copying an AM file, € 15,70 per file.

  • 3 As compensation for the cost of determining the type of potato cysts, a tariff of € 49,95 per parcel shall be charged.

  • 4 As a fee for the issue or renewal of a research statement, a rate of € 26,10 per application shall be charged.

  • 5 As compensation for the costs of the additional AM research on pending land, a rate of € 9.95 per sample shall be charged.


§ 6.5. Payment and recovery

  • 1 For the notes sent by the NAK pursuant to this scheme, a payment period of 14 days shall apply from the date of the notes.

  • 2 The debtor is in default if he has not paid within the period laid down in the first paragraph.

  • 4 Legal interest shall not be payable if the amount of the statutory interest is less than € 20,00 by some or last payment.

  • 5 The Head of the Finance Department of the NAK maant the debtor who is in default in writing to pay for payment within two weeks from the day following that on which the notice was sent.

  • 6 The notice of formal notice states that in the event of a non-timely payment, it may be enforced by means of recovery measures to be carried out at the debtor's expense.

  • 7 For existing claims, judicial recovery may be made.

  • 8 In cases to be determined by the Head of the Finance Department of the NAK, cash payment of the works referred to in this Chapter may be required by the work officer in charge of the work.

  • 9 As far as tax is payable, the turnover tax is deemed not to be included in the tariff.

The rules of application shall remain in force before the entry into force of this Regulation, applicable at the time of the generation of the payment obligations.
