List of wastes pursuant to Article 1 (2) of Directive 2006 /12/EC on waste and Article 1 (4) of Directive 2006 /12/EC Directive 91 /689/EEC on hazardous waste

Introduction

This is a harmonised list of wastes that will be periodically reviewed in the light of new data and in particular new research results, and will be adapted as necessary in accordance with Article 18 of Directive 2006 /12/EC. However, the inclusion of a material in the list does not mean that this material is also a waste in all circumstances. This is only the case where the definition of waste referred to in point (a) of the first paragraph of Article 1 of Directive 2006 /12/EC has been fulfilled.

For the waste listed in the list, the provisions of Directive 2006 /12/EC shall apply, unless Article 2 (1) (b) of this Directive applies.

The different types of waste included in the list are defined entirely by the code of six figures for the waste and the code of two and four digits above the chapters. This means that a waste substance can be found in the list as follows:


3.1

Find the origin of the waste in Chapters 01 to 12 or 17 to 20 and determine the corresponding six-digit code for the waste (except for the codes in these chapters ending on 99). It can be noted that the activities in a specific installation can be covered by different chapters. For example, the waste from a motor vehicle plant depends on the process step in Chapter 12 (waste of machining and surface treatment of metals), Chapter 11 (inorganic metallic wastes of treatment and coating of metals). metals) and chapter 08 (waste of use of coatings).

NB: separated collected packaging waste (including mixtures of different packaging materials) is to be classified under 15 01, not 20 01.


3.2

If a suitable waste code cannot be found in Chapters 01 to 12 or 17 to 20, it is necessary to search for the code of the waste in Chapters 13, 14 and 15.


3.3

If none of these waste codes are applicable, the definition of the waste code should be determined according to Chapter 16.


3.4

If the waste is also not included in Chapter 16, the code '99' (not elsewhere called waste) should be used in the part of the list corresponding to the activity determined at the first step.

A waste substance listed and labelled with a * is a hazardous waste in accordance with the requirements. Directive 91 /689/EEC on hazardous waste. Such waste shall be subject to the provisions of that Directive, unless Article 1 (5) of that Directive applies.

For the purposes of this Decision, 'dangerous substance' means any substance which, in accordance with Directive 67 /548/EEC , as modified, dangerous or to be classified; 'heavy metal' means any connection of antimony, arsenic, cadmium, chromium (VI), copper, lead, mercury, nickel, selenium, tellurium, thallium and tin, as well as these metals in metallics In so far as they are classified as dangerous.

If a waste is classified as hazardous by a general or specific reference to hazardous substances, the waste is only dangerous if these substances are present in such high concentrations (i.e. by a weight of weight) that the waste is waste substance one or more of the substances listed in Annex III to this Regulation. Directive 91 /689/EEC has properties listed. With regard to points H3 to H8, H10 and H11, Article 2 of this Decision shall apply. For the characteristics H1, H2, H9 and H12 to H14, Article 2 of this Decision does not currently contain any specifications.

According to the Preamble of Directive 1999 /45/EC , where a further evaluation is required for alloys because it may not be possible to determine its exact characteristics by using the available conventional methods, it is necessary to assess the need for further evaluation. Article 4 of the European List of Waste Regulations does not apply to pure metal alloys (non-hazardous substances). This will continue to be the case pending the implementation of the further work undertaken by the Commission and the Member States for a specific classification method for alloys. The classification of the waste expressly mentioned in this list remains unchanged.

For the numbering of the items in the list, the following rules are used: for waste which has not been modified, the code numbers of Decision 94 /3/EC are used. The codes of modified waste have been deleted and are not used again to avoid confusion after the introduction of the new list. Waste which has been added has received a code which has not been used in Decision 94 /3/EEC and Decision 2000 /532/EC.
