Arrangement of the State Secretary for Social Affairs and Employment of 1 December 2014, 2014-0000177234, setting up Monitoring Committee ESF2 and ESF 2014-2020

The Secretary of State for Social Affairs and Employment,

Having regard to Article 63, first paragraph of Regulation (EC) No 148/62, Council Decision of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EEC) No 1083/2006 and repealing Regulation (EEC) No 1083/2006 and repealing Decision No Regulation (EC) No 148/EC 1260/1999 and having regard to Article 47, first paragraph of Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for the European Parliament and the European Parliament (European Agricultural Fund). rural development and the European Maritime and Fisheries Fund and general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Maritime Affairs Fund, and fishing, and repealing Regulation (EC) No 148/EC 1083/2006 of the Council;

For the purpose of this Decision:

  • a. Decision: the European Commission decision approving the Single Programming Document for the Netherlands for structural assistance under Objective 2 for the period 2007 to 2013;

  • b. Minister: Minister for Social Affairs and Employment;

  • c. Ministry: the Ministry of Social Affairs and Employment;

  • ed. Monitoring Committee: the Monitoring Committee ESF2 and the ESF 2014-2020 referred to in Article 63 of Regulation (EU) No 1083/2006 and referred to in Article 47 of Regulation (EU) No 1083/2006 1303/2013;

  • e. Implementing Decision: European Commission Implementing Decision of 18 September 2014 approving certain elements of the operational programme 'Operational Programme ESF 2014-2020' for support from the European Social Fund under the objective 'Investing in growth and employment' in the Netherlands;

  • f. Regulation (EC) No 148/EC 1083/2006: Regulation (EC), No Council Decision of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EEC) No 1083/2006 and repealing Regulation (EEC) No 1083/2006 and repealing Decision No Regulation (EC) No 148/EC 1260/1999 ; and

  • g. Regulation (EU) No 1303/2013: Regulation (EU) No 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Social Fund, the European Social Fund, the European Social Fund, the European Social Fund, Rural Development Fund and the European Maritime and Fisheries Fund and general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Fund for the European Union for the European Union for the European Union maritime affairs and fisheries, and repealing Regulation (EC) No 148/EC 1083/2006 of the Council.

  • 1 The Monitoring Committee shall be composed of the following members:

    • (a) three members, appointed by the Minister, including the President;

    • b. a member, appointed by the Minister, on a proposal from the Minister for Education, Culture and Science;

    • (c) a member appointed by the Minister, on a proposal from the Minister of the Interior and of the Kingdom of the Kingdom;

    • (d) a member appointed by the Minister, on a proposal from the Minister for Economic Affairs;

    • e. a member, appointed by the Minister, at the forethought of the Association for Dutch Municipalities;

    • f. two members, appointed by the Minister, on a proposal from the employers ' organizations represented in the Labour Foundation;

    • g. two members, appointed by the Minister, on a proposal from the workers ' organizations represented in the Labour Foundation;

    • (h) a Member, appointed by the Minister, on a proposal from the College of Human Rights.

  • 2 The members of the Monitoring Committee may be assisted by one or more advisers at the meeting.

  • 3 For each member, the Minister may appoint an alternate, as appropriate, upon nomination of the authority which has nominated the member to be replaced.

  • 4 A representative of the European Commission, acting on his own initiative or at the request of the Monitoring Committee, shall sit on the Monitoring Committee.

  • 5 The Secretariat of the Monitoring Committee shall be provided by the Ministry.

  • 1 The Monitoring Committee shall meet at least once a year.

  • 2 If necessary, the Monitoring Committee may use a written meeting procedure.


Article 5. Decision-making [ Expired by 01-01-2025]

The Monitoring Committee shall act by a majority of the votes in the meeting. In the event of a strike, the vote of the President shall be the result of the vote.


Article 6. Tasks related to ESF 2 [ Expats by 01-01-2025]

  • 1 Pursuant to Article 65 of Regulation (EC) 1083/2006 shall carry out the Monitoring Committee in respect of ESF2:

    • examine and agree the criteria for selecting the operations to be financed within six months of the adoption of the operational programme, and proposals for the revision of those criteria according to the criteria programming needs;

    • (b) periodically review, on the basis of documents provided by the managing authority, the progress made in achieving the specific objectives of the operational programme;

    • (c) to examine the results of implementation, in particular the achievement of the objectives to be attained by priority, and the third paragraph of Article 48 of Regulation (EC) No 248/EC, as amended by Article 4 (2) of the 1083/2006 evaluations;

    • (d) the examination and accords of the annual reports and the final report on the implementation referred to in Article 67 of Regulation (EC) No 248/62 of the EC Treaty; 1083/2006;

    • (e) to examine and agree on any proposal for a change in the content of the European Commission's decision on the contribution from the Funds.

  • 2 In accordance with Article 65 of Regulation (EC) No 143/ 2. 1083/2006 shall be notified to the Monitoring Committee of the annual control report or part of the report relating to the operational programme concerned, as well as any relevant comments to the European Parliament. The Committee may, after examining the report or that part of the report, make it.


Article 7. Functions with regard to ESF 2014-2020 [ Expats by 01-01-2025]

In accordance with Articles 49 and 110 of the Regulation, the Monitoring Committee shall perform the following functions with regard to ESF 2014-2020:

  • evaluation of the implementation of the operational programme and progress made in achieving its objectives;

  • b. Investigating:

    • 1 ° issues which affect the performance of the operational programme;

    • 2 ° the progress made in the implementation of the evaluation plan and the follow-up given to the findings of evaluations;

    • 3 ° the implementation of the communication strategy;

    • 4 ° actions to promote equality between men and women, equal opportunities and non-discrimination, including accessibility for people with disabilities;

  • (c) to examine and approve:

    • 1 ° the methods and criteria used for the selection of operations;

    • 2 ° the annual reports and the final report on implementation;

    • 3 ° the evaluation plan for the operational programme and any amendments to the evaluation plan;

    • 4 ° the communication strategy for the operational programme and any changes to the strategy; and

    • 5 ° proposals from the managing authority for amendments to the operational programme.


Article 8. Advisory Competence [ Expired by 01-01-2025]

  • 1 With respect to ESF2, the Monitoring Committee may propose to the managing authority any review or review of the operational programme aimed at Article 3 achieve the objectives defined in the Funds or improve the management of the operational programme, including financial management;

  • 2 The Monitoring Committee may, for the purpose of the managing authority, make comments on the implementation and evaluation of the operational programme, including measures to reduce the administrative burden of beneficiaries. The Monitoring Committee shall monitor the measures taken in response to its comments.

The Monitoring Committee may arrange for its work to be undertaken within the framework given by: Regulation (EC) No 148/EC 1083/2006 , or Regulation (EU) No 1303/2013, the Decision, or the Implementing Decision, and the ministerial decisions taken in implementation thereof.

  • 1 The management of the documents of the Monitoring Committee shall be carried out by similar means to the Ministry.

  • 2 The documents of the Monitoring Committee shall be entered in the archives of the Ministry after the completion of the activities of the Monitoring Committee.


Article 11. Entry Into Force [ Expired by 01-01-2025]

This arrangement shall enter into force at the time of the entry into force of the Regulation of the ESF Committees and shall expire from 1 January 2025.

This arrangement will be set out in the Official Journal.
