Measuring instruments referred to in Article 5 of the Decision measuring instruments and economic operators and non-automatic weighing instruments as specified in Article 6 of the Decision measuring instruments and economic operators comply with the following requirements after the entry into service:

  • a. they are in a good condition of maintenance;

  • b. They are installed in accordance with the manufacturer's instructions and shall be used accordingly;

  • c. They are used exclusively for measurements according to their intended purpose;

  • d. They shall be taken to account in such a way that the rejection errors are as close as possible to zero.

Measuring instruments referred to in Article 5 of the Decision measuring instruments and economic operators comply with the essential requirements set out in Annex I to the Directive, following the entry into service of the Directive.

§ 3. Specific provisions on measuring instruments of the Directive measuring instruments

  • 1 Gas meters and volume retraining instruments shall comply with the applicable essential requirements set out in Annex IV to the Directive for measuring instruments, subject to the following provisions:

    • a. The maximum permissible error in the table in section 2.1 for gas meters each with a factor of 2, and for volume conversion instruments each time a factor of 1,5 is multiplied;

    • b. For domestic measurements, the meter meets the requirements of class 1,5 or a meter of class 1,0, provided that it has a Qmax/Qmin ratio equal to or greater than 150.

  • 2 Before the use of a gas meter in the intended place, the person taking care of the installation of the meter shall determine whether the meter is suitable for the conditions in order to ensure a correct measurement of the expected use.

  • 1 Kilowatt-of-course shall comply with the applicable essential requirements set out in Annex V to the Directive when it is put into service, except that:

  • 1 Liquid measurement equipment shall comply with the applicable essential requirements set out in Annex VII to the measuring instruments directive after its entry into service.

Automatic weighing instruments with a Article 2 (e) (2) of the Decision measuring instruments and economic operators shall fulfil the relevant essential requirements set out in Annex VIII to the Directive on measuring instruments, subject to the following provisions:

  • a. The maximum permissible deviation of each filling of the average for Class X (1), shown in Chapter III, Section 2.2, Table 5, is multiplied by a factor of 1,25;

  • For the calculation of the institution error referred to in Chapter III, Section 2.3, the percentage referred to in Section 2.2 of Chapter III of Chapter III shall be taken into account, without applying the multiplication factor mentioned in subparagraph (a) to this Regulation.

An automatic weighing instrument which does not fall into a higher accuracy class than, as regards:

  • a. Automatic drawbar weighers, precision class XIV or Y (b), as referred to in Chapter II, Section 1.2 of Annex VIII to the Directive, measuring instruments;

  • b. Automatic weighing machines for weighing: accuracy class X (2) determined in accordance with Chapter III, Section 1.2 of Annex VIII to the Directive measuring instruments,

  • c. Discontinuous totalisators: accuracy class 1 or 2, referred to in Chapter IV, Part 1, of Annex VIII of the Directive measuring instruments;

  • d. Continuous totalizers: accuracy class 1 or 2, referred to in Chapter V, Part 1, of Annex VIII of the Directive measuring instruments;

  • e. may be used only for:

    • 1 °. to determine the transport costs of postal packages;

    • 2. to determine, in the fields of undertakings for the exploitation of public transport means, the cost of transport of goods;

    • b. The registration number of the taxi concerned;

    • (c) the date on which conformity assessment has been carried out and the attribute of the body which carried out the conformity assessment;

    • d. The constant of the distance signal generator;

    • e. the stand of the numerator with which the change of the constant of the distance signal generator is recorded, at the time of a conformity assessment;

    • f. The type designation and the factory number of the taxameter concerned.

§ 4. Specific provisions concerning non-automatic weighing instruments

A non-automatic weighing machine used for weighing precious metals, pearls, precious stones or coins meets the requirements for weighing instruments with a precision class I or II as referred to in Section 2.1 of Annex I to the Directive non-automatic weighing instruments.


Article 19

A non-automatic weighing instrument which does not comply with a precision class than class IIII, referred to in Section 2.1 of Annex I to the Directive, shall not be used for automatic weighing instruments only for:

  • (a) to determine the transport costs of postal packages;

  • (b) to determine the transport costs of goods in areas of undertakings for the exploitation of public transport means;

  • c. weighing plants of asphaltic concrete, concrete mortar, masonry and similar products, and weighing materials for those plants in the manufacture of those products,

  • d. the weighing of waste and of sand, gravel and earth;

  • e. the weighing of fishery products on board a fishing vessel.
