Rules on the administration of and trade in protected animal and plant species
The Secretary of State for Agriculture, Nature Management and Fisheries,
Having regard to the Article 5, first paragraph, part c , and 18 of the Decision exemption protected animal and plant species ;
Having regard to the Article 10, third paragraph , 12, first paragraph, part c , 14, first paragraph, part b , 15, 4th Member , and 19, second paragraph, of the legislation on protected animal and plant species Flora and faunal law ;
Decision:
The following definitions shall apply:
Regulation (EC) 338/97 of the Council of the European Union of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (PbEC 1997, L 61);
Regulation (EC) 1808/2001 of the Commission of the European Communities of 30 August 2001 laying down detailed rules for the application of Regulation (EC) No 148/EC 338/97 of the Council on the protection of species of wild fauna and flora by regulating trade in the wild (PbEG L 250);
country of the European Union;
country not belonging to the European Union;
Attempt to comply with the criteria set out in Article 36 (5) of the Implementing Regulation;
specimens of an animal species that meet the criteria set out in Article 24 of the Implementing Regulation;
specimens of a plant species that meet the criteria set out in Article 26 of the Implementing Regulation.
2 The conceptual provisions of Article 2 of the basic Regulation and Article 1 of the implementing Regulation shall apply.
1 A registration shall be kept for specimens of the following species:
a. Live specimens of captive-born and bred birds belonging to protected indigenous and alien species listed in Annex A to the basic Regulation, with the exception of specimens born and bred in captivity of the species Annex VIII to the Implementing Regulation and its hybrids;
b. live specimens of captive-born and bred vertebrates other than birds belonging to protected exotic species listed in Annex A to the basic Regulation;
(c) live specimens of captive and wild animals belonging to protected exotic species listed in Annex B to the basic Regulation, with the exception of:
1. foiled birds, provided with a seamless pool, and
2. the species as mentioned in Annex 1 in this arrangement;
d. by way of derogation from subparagraph (c) (i), live specimens of captive-born and bred or wild birds of prey (order Falconiformes) or owls (order Strigiformes) belonging to protected indigenous or alien species, Listed in Annex B to the basic Regulation;
e. Live specimens of captive-born and bred animals belonging to protected alien species as designated under Article 4 (b) (b) of the Designation Protected Animal and Plant Species Flora and Faunal Act.
2 A registration is maintained for the following plant species:
a. Live specimens of artificially propagated plant species listed in Annex A to the basic Regulation,
(b) live specimens of artificially propagated hybrids of non-annotation species listed in Annex A to the basic Regulation to the extent that they are subject to a phytosanitary certificate as provided for in Article 8 of the basic Regulation. implementation regulation has been issued.
1 A registration as referred to in Article 2, first paragraph , where appropriate, contain the following information:
a. Scientific species name and number;
b. Date and place of procurement;
the name, address and country of the supplier;
d. country of origin of the specimens, if different from sub-section c;
e. CITES document number associated with it;
f. Date and place of estrangement;
g. name, address and country of the customer;
h. CITES document number associated with it;
i. date of birth of and number of offspring;
Identification of data and code of marks;
k. Date of marking;
l. per specimen date and place of mortality.
2 The registration referred to in paragraph 1 shall, where appropriate, keep records, records, registers or other means of proof, including letters, manifaries and other means of proof, relating to the registration of the product concerned, which are not covered by the registration of the product concerned. to be in place, to receive, sell or deliver specimens, intended to Article 2, first paragraph .
1 A registration as referred to in Article 2, second paragraph , where appropriate, contain the following information:
a. Scientific species name and number;
b. Date and place of acquisition, if imported from third country;
(c) supplier's name and address and country, if imported from third countries;
d. country of origin of the specimens, if different from sub-section c;
CITES document associated with a number.
f. Date and place of export to third country;
g. CITES document or phytosanitary certificate number associated with it as referred to in Article 8 of the Implementing Regulation;
h. customer's name, address and country in third countries.
2 In the case of registration provided for in paragraph 1, all notes and documents, including letters, manifaries and other means of proof, books, registers or other means relating to the entry into service, shall be kept as appropriate. or exports to or from third countries as well as the application, issue and use of a CITES document or a phytosanitary certificate as referred to in Article 8 of the Implementing Regulation.
1 The registrations provided for in Article 2, first and second paragraphs , each page, as well as per page, contain a continuous numbering.
2 The data referred to in Article 3, first paragraph , and Article 4, first paragraph , shall be completed on paper in indelible writing.
3 The registrations provided for in Article 2, first and second paragraphs , be filled in full and in truth.
4 The original registrations and the notes provided in Article 3, second paragraph , and Article 4, second paragraph , shall be kept for at least three years from the date of the last amendment or supplement made to the register.
1 A registration, as intended Article 2, first paragraph , is maintained by any person who has, or has, carried out acts of specimens of species referred to in that Article as intended by Article 13, first paragraph, of the Act .
2 A registration, as intended Article 2, second paragraph It shall be maintained by any person who, within the meaning of that Article, is responsible for exporting to a third country or importing or exporting specimens of these species from or to a third country.
Each person shall, upon request, inspect the registrations provided for in Article 2 -to the Minister by virtue of Article 104 of the Act designated officials.
This arrangement shall enter into force at the time of Article 18 of the Decision exempting animal and plant species enters into force.
This scheme is cited as: the administration of and trade in protected animal and plant species.
This arrangement will be set out in the Official Journal.

Explanation of characters:
+ = The species shall be bred in captivity at such a large scale that it may be considered excluded that imports of wild specimens are still being carried out.
-+ = The species is bred in captivity, but imports from wild animals are still being imported. However, specimens of this species within the European Community are in such a large scale that it may be excluded that specimens are intentionally imported illegally.
-= As far as the type of breeding in captivity is concerned, it is very modest. However, specimens of the species concerned are introduced on such a large scale and are in such a large scale legally available within the European Community, which may be considered as being excluded intentionally illegally.
