Settlement of the main officers of the judiciary Maastricht and Roermond on the granting of mandate, power of attorney and authorisation to the regional manager of operations.

The Principal Officer of the Justice of Maastricht and, the chief officer of the Justice of Roermond;

Whereas by its Decision of 18 December 2009, number PaG/14389 granted the mandate, power of attorney and authorisation to the Chairman of the Management Board;

That the Regional Director shall have specific tasks and responsibilities regarding the operation of the business;

That there is reason to grant the Regional Director of business operations, power of attorney and authorisation to carry out his/her duties;

That the mandate, power of power and authorisation should facilitate the (regional) cooperation and give the Chairman of the Board and the Regional Director of the business operations together with the Chief Justice of the Justice Department. to give substance and form to that regional cooperation;

Having regard to the General administrative law , the General Civil Service Regulations , the Decision General Court Police , the Legal status of judicial officers , the Mandating arrangements for non-management issues of public ministry and the Mandateregulation management public ministry and the Mandatedecision public ministry (arrondissementsparkets) 2009 ;

Having regard to the opinion of the Works Council of 21 July 2010;

Article 1. Definitions

For the purpose of this Decision:

  • 1) Civil servants: the judicial and non-judicial officers of the Maastricht and Roermond districts of the arrondissementsps;

  • (2) Operations: service in the field of personnel, information, organisation, formation, business operating records, acquisition, housing and communication aimed at realizing the tasks and goals of the organisation, signaling and advise on the (internal) management and control of the primary and supporting processes and facilitating the planning and control cycle;

  • 3) Administration: the Executive Board of the Region, consisting of the Chief Officers of Justice, Regional Deputy Chief Officer and Chief Executive Officer,

  • 4) College: the College of Prosecutors-General;

  • 5) Permission: the power to conduct acts in the name of the Minister who are neither a decision nor a private law legal act related to the Public Prosecutor ' s Office;

  • 6) Mandate: the power to take decisions in the name of the Minister relating to the Public Prosecutor's Office;

  • 7) Minister: the Minister of Justice;

  • 8) Non-judicial official: the civil servants and the police officers;

  • 9) Police officers: Civil servants employed in the State Department pursuant to an appointment pursuant to the decision to police general status;

  • 10) Judicial officer: the one in the Law of the judicial organisation officials designated as such;

  • 11) Managing Director of Operations: the Director of the Management Board of the Maastricht Regional Court;

  • 12) (Regional) management team: the management team consisting of the chief officers of justice, the regional deputy chief officer of the judiciary, the managing director and the regional department heads;

  • 13) Rijksofficials: The officials appointed to the Maastricht and Roermond arrondissementbouquets on the basis of the General Civil Service Regulations ;

  • 14) Proxy: the power to carry out, in the name of the Minister for Private Law, legal acts relating to the Public Prosecutor's Office;

  • 15) Chairman of the Board: The Chief Prosecutor of the Court of Justice of the Arrondissementsparket in Maastricht.

Article 2. The powers of the Regional Director

  • 1) Power of private law, legal acts

    The Regional Director of the Management Committee is granted a power of attorney to conduct the business of the Maastricht and Roermond districts of the district:

    • a. Service agreements with the service organisation OM to be closed. The Regional Director shall act as a contract manager as such; and

    • b. To rent externs.

  • (2) Budgetary responsibility

    The management of the Regional Director shall be given a mandate to take decisions and to sign up to letters in so far as they concern the use and the exhaustion of the budget relating to the district labels Maastricht and Roermond, taking into account the budget allocated to Maastricht and Roermond, through the annual plan, to the instructions given to him by the Chairman of the Board, the detailed rules for the administration of the budget and the as intended in Article 3, third and fourth member of Mandate's Ministry of Public Prosecuting (Arrondissementbouquets) 2009 and the rules applicable to the budget holding.

  • (3) Management mandate (daily business)

    A mandate shall be granted to the Regional Director, unless otherwise provided for by a legislative rule, or the nature of the power to oppose it, to take decisions, to issue documents and to sign outgoing letters, which shall be relating to business operations, with the exception of the acts referred to in Article 3, second paragraph, introductory wording, part a, b and c .

  • 4) Personnel ate

    A mandate shall be granted to the Regional Director to:

    • (a) to take, forward documents and sign letters, whether or not with a legal effect, to the extent that the officials are concerned with the exception of the acts and/or acts referred to in Article 3, second paragraph, introductory wording, part a, b and c . These powers shall be exercised on the basis of the rules in force, on the established formation and on the personel budget allocated.

    • (b) Decisions granting an indemnity to civil servants up to the amount of € 5 000,-on an annual basis.

    • (c) Decisions granting officials a one-off or periodic supplement to the amount of € 5 000 per year, on an annual basis.

  • 5) Mandate working conditions

    • a. The Regional Director of Management is granted a mandate to coordinate and implement the work conditions policy, as is the case within the Public Prosecutor's Office. In so doing, it follows-as far as housing and material facilities are concerned-the labour resources policy for the public prosecutor.

    • (b) The Management Regional Director shall be mandated to exercise the powers which are required under the Working Conditions Act.

  • 6) Complaint handling

    The management of the Regional Director shall be mandated to deal with complaints as referred to in the Article 9.1 of the General Administrative Law to be acted upon, with the exception of complaints relating to the conduct of the regional director's business itself.

  • 7) National Ombudsman

    The Management Regional Director shall be mandated and authorised to take decisions and carry out any other act arising from matters of the National Ombudsman in the case of:

    • a. Sending receiving confirmations;

    • b. Sending intermediate messages, including deferrers, or;

    • (c) documents following efforts made by the national Ombudsman to promote, in order to avoid a complete investigation, that the complaint will be addressed to the complaint (interventions).

  • 8) Law open-to-board

    The Regional Director shall be mandated and authorised to take decisions on applications under the Open-ability Act, with the exception of those decisions which are important political, administrative or social effect.

Article 3. Conditions attached to the exercise of the mandate, power of attorney and authorisation

  • (1) The Regional Director shall exercise the powers of exercise of the obligation to comply with the basic principles of employment policy in order to promote the greatest possible security; the best possible protection of safety, the best possible protection of the health and well-being of officials working within the scope of its authority in relation to the work of the work.

  • (2) The management, budget and staff of staff are excluded:
