For the purposes of this arrangement:

  • General Block Exemption Regulation: Regulation (EU) No 651/2014 of the Commission of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 (PbEU 2014, L 187);

  • generic business agent: 'business agent' where only a particular environmental performance is required and the product is not defined specifically;

  • SME: small or medium-sized enterprises within the meaning of Annex I of the General Group Exemption Regulation, the Agriculture Groepsexemption Regulation and Fisheries Group Exemption Regulation;

  • Agriculture Block Exemption Regulation: Regulation (EU) No Commission Regulation (EEC) No 702/2014 of 25 June 2014 providing for certain categories of aid in the agricultural and forestry sector and in rural areas under Articles 107 and 108 of the Treaty on the Functioning of the European Union market is declared compatible (PbEU 2014, L 193);

Article 1a. Random Depreciation of Environmental Investment [ Expaed by 01-01-2019]

As environmental assets as referred to in Article 3.31, first paragraph, of the Income Tax Act 2001 shall be designated the assets or components thereof, included in the Annex in this arrangement, where:

  • a. They are in accordance with the destination indicated in the Annex to this Regulation; Annex in this arrangement;

  • b. They have not been used before;

  • c. They consist of the Annex This arrangement with regard to those assets or components of such assets;

  • (d) aiming at the improvement of the natural environment or animal welfare; and

  • (e) if the farm equipment or its components are in agricultural holdings, it shall not be targeted at a production increase for which no normal market outlets can be found on the market.

By way of derogation from the Articles 1a and 2 the assets or their parts thereof, or investments in assets or components thereof, shall not be designated if:

  • (a) as a result of the granting of State aid by the public authorities or by the European Commission on the basis of this scheme and on the basis of other grounds, such an advantage would be granted, that the total allowable benefit under the rules of the The provision of the European Union shall be exceeded;

  • (b) the investment is made by an undertaking in respect of which a recovery order has been granted, pursuant to Article 1 (4) (a) and (b) of the General Group Exemption Regulation, Article 1 (5) of the Agriculture Block exemption regulation or Article 1, third paragraph, part e of the Fisheries Group Exemption Regulation, or

  • 1. This Annex is cited as: Environmental investment deductible and random depreciation of environmental investments 2016.

  • 2. Investments in operating assets of which the code begins with:

    • -F or G, belonging to Category I of the environmental investment deduction, shall be eligible for an investment deduction of 36% of the investment;

    on a request from the Minister for Infrastructure and the Environment, it shall be shown that the aid for the investment reported in a commercial vehicle for environmental protection complies with the requirements of the General Block exemption regulation.

    An investment in a generic business asset is eligible for environmental investment deduction and random depreciation of environmental investments, if this investment is subject to Article 36, first and second paragraph, of the General Block exemption Regulation, whereby:

    • -investments in forestry, energy, fisheries and aquaculture are not covered by the generic assets;

    • -protection of the environment shall mean any measure aimed at preventing, reducing or repairing the natural environment or natural resources by the economic operator's own activities or at the encouragement of a natural environment. more rational use of these resources;

    • -the investment goes beyond the established or inoperative legal standards in the Netherlands in respect of the protection of the environment or the level of environmental protection is increased in the absence of legal standards,

    • -the investment goes further than the current state of the art. 1 ;

    • -the investment does not result in the costs of combating pollution not being borne by the person causing the pollution; and

      As regards the use of a generic agent for recycling and re-use of waste produced by third parties pursuant to Article 47 of the General Group Exemption Regulation, it is also applicable that:

    • -the investment does not only increase the demand for the material to be recycled without increasing collection of that material, and

    • -under the current state of the art, a process in which the re-use of a waste product to produce a final product is an economically profitable normal practice.

      The aid which may be obtained by means of an environmental investment deduction and arbitrary depreciation of the environment for an investment in an industrial resource shall not exceed 30% of the additional investment costs. The additional investment costs are the costs directly related to achieving a higher level of environmental protection compared to a comparable, less environmentally friendly investment that would have been incurred in the absence of an investment. aid. The comparable, less environmentally friendly investment can generally be equated with the usual alternative in the sector concerned.     • 6. In respect of investments in farm equipment for agricultural production included in point 2 under 'Food and agricultural production' and investments relating to fisheries and aquaculture, the following shall apply:

      • -an investment of an undertaking which is active in the production of primary agricultural products, fishery products or aquaculture products under Article 1 of the Agriculture Groepsexemption Regulation and the Fisheries Block exemption Regulation is eligible only for environmental investment deductions and random depreciation of environmental investments if the undertaking is an SME;

      • -investments in farm resources linked to primary agricultural production under Article 4 (1) (a) of the Agriculture Groepsexemption Regulation shall be eligible for a maximum of € 500,000 in aid per undertaking by investment project;

      • -investments in farm resources for fisheries or aquaculture under Article 2 (1) of the Fisheries Aid Regulation shall be eligible for a maximum of € 1,000,000 in aid per undertaking per year;

      • -in the case of investments in farm equipment on board fishing vessels, Article 25 and 38 of Regulation (EU) 508/2014 are taken into account;

      • -in the case of investments made by start-up aquaculture operators Article 46 of Regulation (EU) 508/2014 is taken into account.

    • 7. Business instrument F 3410 (Electric or hybrid powered mobile machine) shall meet the requirements of the air-sided emissions specified in paragraph 2 by the fuel consuming engine of the business agent.

      The EC type-approval certificate and a certificate of conformity shall demonstrate compliance with the air-sided emissions requirements specified in paragraph 2 by the fuel consuming engine of the farm. The EC type-approval certificate shall include the emission values of the farm product on the basis of the Type-approval decision type assessment air pollution tractors and engines for mobile machinery indicated. Electrically powered or hybrid cars are not eligible under enterprise A 0001. See business resources G 3110 and D 3111 for these cars. Solar panels are not eligible under enterprise A 0001.

F 0100 Sustainable product development software
  • a. Intending for: the preservation of products based on design software, by an SME, which makes at least four of the following environmental parameters insightful:

    • -Phosphate emission,

    • -SOx emission,

    • -NOx emissions,

    • -CO2 emissions,

    • -water use,

    • -energy use; or

    • -reuse of materials or components,

  • b. consisting of: design software.

The operating agent shall be eligible for environmental investment deduction and random depreciation of environmental investments up to a maximum of € 6,500 of the amount of investment.

Comments: SME is intended to be a small or medium-sized enterprise.

F 1100 Production equipment for biomass-based products
  • a. For the purpose of: the processing of biomass into a product by an undertaking which is not active in the production of fishery or aquaculture products as referred to in point 6 of paragraph 1 of this Annex, where:

    • -the product is not a foodstuff or energy carrier such as fuel, heat or electricity,

    • -biomass is not manure,

    • -the requirements set out in point 5 of paragraph 1 of this Annex are met,

    • -the residual product or not has an energy or food application, and

      • 1. the product is non-gang-type, or

      • 2. the product is common but the biomass used is not common as raw material for the product,

  • b. consisting of: (adaptation of) production equipment for the processing of biomass up to a product, including pre-processing equipment.

The operating agent is eligible for maximum investment allowance and random depreciation of environmental investments for up to € 5,000,000 of the amount of investment.

This means, for example, for refining biomass streams (such as grass), biochemistry or application of natural fibres, provided that it is not a common application.

  • b. consisting of: (adaptation of) production equipment which is technically necessary for the production of (products of) bioplastics.

Comments: Structure improvement of (products of) bioplastics with natural fibres also falls under farm product F 1110. For the processing of biomass by producers of fishery or aquaculture products, see the farm resources F 2600, F 2610, F 2611, F 2612 and F 2613.

F 1112 Algae-, kroos-or incense reactor fermentation facility
  • a. For the purpose of: the fermentation of organic residual flows, other than manure, by an undertaking which is not active in the production of fishery or aquaculture products as referred to in point 4 of paragraph 1 of this Annex, where:

    • -the thin fraction of the digeal state as a feed is used for the algae, kroos or incense reactor,

    • -the algae produced, croolar or seaweed are used as (green raw material for) fodder, biofuel or for high-value applications; and

    • -the residual product is given an energy application or not,

  • b. consisting of: a digester, a production system for algae, kroos or seaweed and whether or not the following components: pre-processing equipment, a treatment unit for recirculation or recycling of the food solution, an eye-watering system, equipment for raw material processing, a gas engine, a generator and biogas reprocessing equipment.

A 1113 Algae, algae or croofish system for waste water treatment
  • a. For the purpose of: the processing of waste water by biological degradation caused by algae, algae or croos by an undertaking which is not active in the production of fishery or aquaculture products as referred to in point 6 of paragraph 1 of this Annex; where the algae, whores, or the single-minde/dandelas are harvested,

  • b. consisting of: a liquid-dense basin, an abrapene or pump, a continuous measuring system, harvesting equipment, and pre-separation equipment.

The business agent is eligible for maximum investment allowance and random depreciation of environmental investments for up to € 4,000,000 of the amount of investment.

Comments: Two key requirements apply to this business. The culture of the insect species should be permitted by law. In addition, the food on which the insects are grown must also be permitted by law. The culture of insects on food (partly) consisting of fish is ineligible due to the non-sustainable nature of this food.

This might, for example, cover a farm of insects for human food products, animal feed, pharmaceuticals or biological control. The breeding of insects is also understood to be the breeding of insects.   • a. For the purpose of: abrading, weeding or administering fertilizers, plant protection or decidation equipment, taking into account local conditions by measuring the stock of fertilisers present in the soil, or the in- the crop of weeds, or of disease, where:

F 2650 Manure treatment plant with phosphate recovery and nitrogen
  • a. For the purpose of: the processing of animal manure, where:

    • -the phosphatic and nitrogenous concentrates from the manure are applied separately and recovered,

    • -the aqueous fraction shall be reused or discharged to surface water or sewer,

    • -no retreading fermentation products shall be added when a manure collection plant is applied; and

Comments: Only manure separation in a thick and thin fraction by, for example, a screw press or a more decanter is not sufficient to qualify under farm product F 2650. The thin fraction should be processed into a nitrogenous concentrate and an aqueous fraction after separation. Also after fermentation, an enabled technique for further processing of the manure or the digestant is necessary to qualify under this farm product.

The thin fraction shall mean the nitrogenous concentrate. The watery fraction does not belong to the thin group. The aqueous fraction has been tested after processing and must be discharged on the surface water or on the sewer. The fat fraction is the phosphatic concentrate.

A 2651 Algae, algae or croofish system for manure processing
  • a. Intending for: the processing of animal manure by biological degradation by algae, algae or single-mindets, where the algae, algae or the kroos are harvested;

  • b. consisting of: a liquid-dense basin, an abrapene or pump, a continuous measuring system, harvesting equipment, and pre-separation equipment.

    • 1. CO2 emissions of 0 grams per kilometre for a vehicle with a registration plate; or

    • 4. a combination of 1, 2 or 3,

      where natural gas is also understood to mean biogas which is of natural gas quality or better, and where the methane slip of an applied gas engine is not more than 4,0 grams per kilowatt hour by a relevant measurement report drawn up by an accredited and independent measurement institute,

  • b. consisting of: an engine built into the ship and, whether or not the following components: a gas tank, a fuel cell, lithium-containing batteries and a charging station.

The hull of the ship:

    • 1. consists of plastics or is equipped with an environmentally friendly anti-fouling, as referred to in farm equipment F 3331;

    • 2. has smooth finished anchors and safes if the ship is fitted with vault anchors,

    • 3. has a corrosion protection system that does not contain sacrificial anodes, such as oppressed current, if a protection system is used against corrosion; and

    • 4. has a plastic or steel belly denning, if an abdominal denning is applied,

  • b. consisting of: a metal or plastic hull of the inland waterway vessel and whether or not the following parts: an environmentally sound anti-fouling, a corrosion protection system and an abdominal dentification.

The operating agent is eligible for maximum investment in investment and random depreciation of environmental investments, up to a maximum of € 500,000 of the investment.

F 3331 Environment-friendly protection system for ship-houses
  • a. Intended for: protecting the ship's skin against corrosion and growth through an initial anti-fouling, which is bicidism-free, copper-free and non-toxic to aquatic organisms, where:

    • -the PEC/PNEC ratio for at least 2 ecosystem measuring aquatic organisms, according to the Plant protection and biocidal products scheme , not more than 1, and

    • -a certificate or a measurement report shall show that the protection system does not contain biocides, copper or other toxic substances for aquatic organisms,

  • b. consisting of: a brushable hard coating, a 'non-stick' soft coating, or a 'non-stick' film.

The operating agent is eligible for environmental investment deduction at 50% of the amount of the investment.

For example, a mobile machine is a dozer, dumper, excavator, high-worker, loading shovel, farming machine, coal piston, crane, tractor, or forklift. If no such noise is included in the table in paragraph 1 of paragraph 1 of this Annex, the requirement referred to in point (a) (1) of this service may not be fulfilled.

B 3460 Dust-poor wipe (suction) machine

Comments: For business resources, a minimum reporting amount of € 2,500 is applicable. For example, at a cost of € 250 per battery, at least 10 batteries are purchased and reported at the same time.

    • -combustion plant does not mean a boiler with a rated power of less than 1 megawatt,

    • -the combustion plant has been put into service before 1 April 2010, and

    • -the emission of NOx, SO2, total dust and CxHy in the waste gases comply with the emission limit values in Section 3.2.1 of the Environmental Management Decision , measured according to a measurement method that meets the requirements of the Activity decision on the environment ,

Comments: Information on the Activity decision on the environment is located at www.infomil.nl. Under the thermal power, the input power of the installation is understood. From 1 January 2017, existing medium combustion plants (less than 50 megawatts) will have to meet new emission requirements pursuant to the Activity Decision. The requirements apply not only to new combustion plants, but to all boilers, steam boilers, diesel and gas engines and gas turbines. These combustion plants are not eligible for the above code.

For offshore installations or for gardeners who involve external CO2, a transitional period shall be valid until 1 January 2019. This latter category will be eligible for environmental investment deductions and random depreciation of environmental investments.

A 4140 Bioreactor with reduced sludge retention for nitrogen removal (adjust existing situation)

  • b. consisting of: a halogen-free refrigerant and adjustment of the existing refrigeration plant or heat pump, which is technically necessary for replacing the cold medium.

Any adjustment of the existing refrigeration plant or heat pump shall not exceed € 200 per kilowatt of cooling capacity from the existing cooling plant or thermal pump thermal pump to be eligible for environmental investment deduction.

F 4220 Hydrocarbon emission reducing technique (at least 75% reduction)
  • a. intended to: reduce the emission of hydrocarbons from the flue-gases of stationary gas or diesel engines, reducing hydrocarbon emissions by at least 75%, and with the maximum emission of hydrocarbons 1,200 milligrams per normal cubic metre (at 3% O2),

Non-regular operations are intended to: malfunction, maintenance to the (cleaning) techniques and start up and stop of installations or processes.
