On the nomination of Our Minister for Foreign Affairs of 9 April 2010, No DJZ-IR 2010-034;
Having regard to the Articles 2 and 4 of the national exclusive economic zone ;
Heard the Council of State of the Kingdom (opinion of 12 May 2006, No W02.10.0140/II/K);
Having regard to the further report of our Minister of Foreign Affairs of 21 May 2010, No DJZ-IR 2010-113;
Having regard to the provisions of the Statute for the Kingdom of the European Union,
Have found good and understand:
Without prejudice Article 2 the external border of the exclusive economic zone of the Kingdom for Aruba, CuraƧao, Sint Maarten and the public bodies Bonaire, Sint Eustatius and Saba is formed by the line, each point of which is situated at a distance of two hundred nautical miles, which is 370 kilometers and 400 meters, measured seaways from the baselines from which the breadth of the territorial sea is measured.
1 Where a border with other States has been agreed which is wholly or partly inland from the line, intended in Article 1 , this boundary line is the external border of the exclusive economic zone.
2 Where no border line has yet been agreed with other States and the line, intended Article 1 , further away from the basic lines than the midline, of which each point is equally distant from the nearest points of the baselines from which the breadth of the territorial sea of each of the two States is measured, is the external border of the exclusive economic zone this midline.
1 The Rijkswet Establishment exclusive economic zone shall enter into force for Aruba and the Netherlands Antilles at the time of entry into force of this Decision.
2 This Decision shall enter into force as from the first day of the second calendar month following the date of issue of the Official Journal in which it is placed.
This decision is referred to as: 'Limits of the Caribbean Exclusive Economic Zone'.
Charges and orders that this decision with the corresponding note of explanatory note in the Official Journal, will be placed in the Official Journal of the Netherlands Antilles and in the Afkoning sheet of Aruba.
