Whereas the revision of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, on 7 July 1995 makes it necessary to set out the provisions relating to the training and certification of seafarers; Reaffirming the provision of seafarers serving on Dutch-Antillean and Aruban ships, also implementing the provisions on the crew of seagoing ships of the International Convention for the Safety of Life at the Sea of the Sea sea, 1974, subject to compliance with the relevant provisions of the Code of Commerce of the Netherlands Antilles, Netherlands. Chapter 1. Definitions and scope

Article 1

For the purposes of this Decision and the provisions based thereon, the following definitions shall apply:

  • a. Head of the Shipping Inspection: the Head of the Shipping Inspecting of Aruba, Curaçao, and the Netherlands of Sint Maarten, respectively;

  • Captain: the commander of a ship;

  • crew: the master, the ship's officers and the bachelors, as well as the other persons who are on the sample, who are referred to in the sample role;

  • d. appropriate: any person who is on board;

  • e. Ship manager shall mean the owner or the representative referred to in Article 3 (4) of the Marine Act of Curaçao, 1933, the owner or the representative, as referred to in Article 3 (1). Article 2 of the Sea letterdecision of Curaçao and Sint Maarten or the bareboat charterer or his representative, intended to Article 6 of the Sea letterdecision of Curaçao and Sint Maarten ;

  • f. competability: the power to serve in one or more functions on board a ship;

  • g. professional requirements: the required knowledge, understanding and skills requirements for a function to which this Decision applies;

  • h. Experience: the service period in years, in a particular function on board the sailing vessels, counted from the day of embarkation up to and including the day of embarkation;

  • (i) certificate of competency: a document issued by the head of the Shipping Inspection (ship) inspection document showing the competence;

  • Crew certificate: a certificate issued by the Head of the Shipping Inspection, carrying out the minimum number of crew members and their functions on board the ship concerned;

  • (k) propulsion power means the maximum power, expressed in kilowatts, that is specified on the valid crew certificate;

  • L. tankers: a ship constructed or modified and used for the transport in bulk of liquid products;

  • Oil tanker: a tanker constructed and used for the transport in bulk of petroleum or petroleum products;

  • n. Chemical tanker ship: a tanker constructed and used for bulk transport of liquid products listed in Chapter 17 of the International Code on the Carriage of Chemicals in Bulk, belonging to the SOLAS Convention;

  • o. 'gas tanker' means a tanker ship constructed and used for bulk transport of liquefied gas or other products included in Chapter 19 of the International Code on the transport of liquefied gas, in the form of a gas tanker. SOLAS TREATY;

  • (p) passenger ship means a ship intended or used for the commercial transport of more than 12 passengers;

  • q. ro-ro passenger ship: an ro-ro passenger ship as referred to in Regulation II-2/3 of the SOLAS Convention;

  • r. High speed craft: a ship capable of moving at a speed, in metres per second, equal to or greater than 3,7 ° 0,1667, with a means of water movement in m 3 on the design waterline;

  • SOLAS Convention: the International Convention for the Safety of Life at Sea, 1974 (Trb, was established in London on 1 November 1974. (2) 1976, 157);

  • w. GT means the gross contents of the ship, determined in accordance with the laws of Aruba, Curaçao, or Sint Maarten, on the measurement of seagoing vessels;

  • x. High Speed Craft Code: the International Code of Safety for High Speed Craft of 20 May 1994, listed in the Annex to the Conditions of HSC-Code;

  • (y) travelling near the coast: the use of a ship of less than 500 GT gross tonnage and a propulsion power of less than 3000 kW, in a sailing area extending up to 250 nautical miles from the coast of Aruba or up to 250 nautical miles from the coast of Aruba the coast of any island belonging to Curaçao or up to 250 nautical miles from the coast of any island belonging to Sint Maarten;

  • z. Our Minister: Our Minister of Aruba, Curaçao, or Sint Maarten, responsible for shipping.

  • 1 This Decision shall apply in respect of ships sailing, equipped with an Aruban, Curaçao, or Sint Maartense sea letter.

  • 2 This Decision shall not apply in respect of:

    • (a) ships fitted with a certificate of soundness for the transport of goods without a means of transport;

    • Lifeboats; and

    • c. fishing vessels.

  • 3 In the case of or under national decree, general measures of Aruba, Curaçao and Sint Maarten were to be adopted derogating from the provisions applicable to national vessels.

  • 4 The proposal for a national decision as referred to in paragraph 3 shall be made by our Minister of the country concerned, responsible for shipping, in agreement with our Minister responsible for the responsibility of the Minister responsible for the matter. National vessels.

  • 1 The ship manager shall ensure that all crew members assigned as chief of guard referred to in Section A-VIII/2, Part 1 of the STCW Code, as well as crew members who are in service as a waiting unit, do not have less than 70 hours of rest are given during each seven-day period.

  • 1 The exercise of competencies may be carried out only on board of oil tankers, chemical tankers, gas carriers, steamships or any other category of vessels to be allocated by way of a national decision, including general measures, if such is expressly indicated in the certificate of competency.

A certificate of competency or a supplement thereto may be renewed if, in the five-year period preceding the date of the application for renewal, the holder has been in service in a head judgment for at least one year. the function which is relevant to the Shipping Inspection and which is required to be performed by the holder on the basis of the powers conferred on him or in any of the following functions:

  • a. For the functions of Captain and Steering man:

    • -looting, working in Aruba, Curaçao or Sint Maarten;

    • -nautical expert of a class office,

    • -representative of nautical inspections of shipping companies, and

    • -official of the Shipping Inspection, insofar as it is actually involved in the surveillance of seagoing vessels and at least holds the diploma as a third mate of commercial shipping or the 'secondary maritime officer' knowledge certificate;

  • b. For the function of the ship engineer:

    • -technical expert of a class office;

    • -representative of technical inspections of shipping companies;

    • -official of the Shipping Inspection, insofar as actually involved in the supervision of seagoing vessels and at least holds the diploma as a ship engineer A or the knowledge proof "intermediate maritime officer", and

    • -mechanical engineer in an electricity station or in a water plant;

  • c. for the function of maritime officer:

    • -nautical-technical expert of a class office in possession of at least the knowledge certificate "mediable maritime officer", and

    • -official of the Shipping Inspection, insofar as actually involved in the supervision of seagoing ships and in possession of at least the knowledge certificate "intermediate maritime officer";

  • d. for the function of radio operator: radio operator working in the operational service of the Coast Guard and business personnel involved in the operation, installation or repair of radio communications and radio navigation equipment.

For the renewal of an additional note in the certificate of competency valid for the service on board of one of the following categories of ships, the applicant shall provide evidence that he complies with the requirements of each category of vessel. Requirement:

  • a. oil tankers: the service has been carried on board oil tankers or chemical tankers for at least one year in a period of five years prior to the date of the application for renewal;

  • b. Chemical tankers: have served at least one year of service on board of chemical tankers or product vessels for at least one year in a period of five years prior to the date of the application;

  • c. gastankships: having served at least one year in a period of five years prior to the date of application for renewal, on board ships;

  • (d) steamships: having served at least one year of service on board steamships for at least one year in a period of five years prior to the date of the application;

  • (e) passenger ships: having served at least one year of service on board passenger ships for at least one year in a period of five years prior to the date of the application;

  • f. ro-ro passenger ships: having served on board ro-ro passenger ships for at least one year in a period of five years prior to the date of the application for renewal.

  • 1 In a case of renewal as intended Article 28 , the original certificate of competency renewed, taken or, if necessary, invalidated shall be invalidated.

§ 5. Revocation of competencies

  • 2 Our Minister shall inform the holder of a certificate of competency, which shall be subject to a presumption of incompetence to the exercise of his post. He is obliged to submit to an inquiry on the first occasion, subject to the instructions given by our Minister.

  • 3 In case of a presumption of incompetence to the carrying out of a function on board, the examination referred to in paragraph 2 shall be established by an expert appointed by Our Minister at the foot of Chapter 4.
