Decision of 23 February 2007 amending the Statutory Unemployment Scheme for Education Personnel Primary and Secondary Education in relation to Change of the Unemployment Act

On the nomination of Our Minister of Education, Culture and Science, of 9 January 2007, No AP/PSW/2006/49035 (B51), Directorate for Labour Market and Personnel Policy, made on behalf of our Minister of Agriculture, Nature and Food Quality;
Having regard to Article 33, second paragraph, of the Law on Primary Education , Article 33, second paragraph, of the Law at the centres of expertise and Article 38a, 2nd paragraph, of the Law on Secondary Education ;
The Council of State heard (opinion of 25 January 2007, No W05.07.0004/1);
Having regard to the further report of Our Minister of Education, Culture and Science, of 16 February 2007, No AP/PSW/2007/5138 (B51), Directorate for Labour Market and Personnel Policy, released on behalf of our Minister of Agriculture, Nature and Food Quality;
Have found good and understand:
1 On the person concerned whose first unemployment day is as intended Article 1 of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education is located before 1 October 2006, remain the Articles 4 , 5 , and 8, 1st Member , as they were in place on 30 September 2006, applicable.
2 On the person concerned whose first unemployment day is as intended Article 1 of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education is located before 1 April 2007, remains Article 11 of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education As appropriate, as of 31 March 2007.
3 The person concerned whose first day of unemployment as referred to in the Article 1 of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education is located on or after 1 October 2006 and before 1 April 2007 and which does not fulfil the condition of Article 42, second paragraph, WW , after the expiry of his WW benefit, he is entitled to three months ' statutory benefit of up to 108% of the minimum wage per day. If 78% of the uncapped calculation basis is less than 108% of the minimum wage, the previous sentence shall read for '108% of the minimum wage': 78% of the uncapped calculation basis.
4 The person concerned whose first unemployment day is as intended Article 1 of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education is located on or after 1 October 2006 and before 1 April 2007 and which complies with the condition of Article 42, second paragraph, WW , after the expiry of the WW benefit, has the right to an above-statutory benefit whose duration is equal to the number of months that his WW allowance lasts shorter than the case would have been on the basis of the WW As it was on 30 September 2006. For the first 12 months of the first day of unemployment, the amount of this superstatutory benefit has been 78% per day, and then 70%, of the uncapped calculation basis. For the purpose of determining the duration of the period of 12 months referred to in the previous sentence, Article 43 WW in accordance with applied, and be subject to periods of supplement to the ZW benefit and to the WAZO benefit. If on the basis of Article 8 of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education (i) entitlement to a subsequent payment shall be the final benefit of the benefit referred to in this paragraph after the benefit has been paid.
5 The benefits referred to in the third and fourth paragraphs shall be regarded as a final benefit.
6 In this article the conceptual provisions of the Decision of the statutory unemployment scheme for teaching staff Primary and secondary education applicable.
This Decision, with the exception of Article I, Parts I and J , shall enter into force from the day following the date of issuance of the Official Gazette, in which it is placed and shall operate back to 1 October 2006. The Parts I and J of Article I enter into force with effect from 1 April 2007.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
