Decision of 8 February 2010 establishing a single payment 2009 and amending any decisions under the labour conditionality agreement for the Defence Sector for the period from 1 March 2009 to 28 February 2010

Upon nomination of the Ministry of Defence, 19 November 2009, No P/2009017614;
Having regard to Article 125, first paragraph, points (a), (c), (d) and (e) of the Civil Service Act as well as the Articles 12, point a, g, h and m , and 12d, under a of the Military Staff Act 1931 ;
The Council of State heard (opinion of 16 December 2009, No WO7.09.0507/II);
Having regard to the further report of the Secretary of State of Defence of 2 February 2010, No BS/20100000605;
Have found good and understand:
1 The following parties are entitled to a one-off payment of up to a size of 0,35% of the 12-fold basis of the calculation basis for them:
a. The military engaged in professional personnel with a rank lower than Vice Admiral or Lieutenant General who was in real service on 1 August 2009, and the official appointed on 1 August 2009 in civil public service to assist in the event of a to operate as a spiritual attendant on an ongoing basis;
b. the military personnel assigned to the reserve staff who have been in real service with their entitlement to pay during the period from 1 January 2009 to 31 August 2009;
c. engaged in civil public service employed by the Ministry of Defence on 1 August 2009;
d. the former military officer with a lower rank than Vice Admiral or Lieutenant-General and the former official, who on 1 August 2009 were in the enjoyment of waiting money under Article 18 (6) of the Decision on social security benefits in respect of the Defence Sector ;
e. the former soldier who enjoyed a benefit on 1 August 2009 based on the Military former military personnel as well as the former official who, on 1 August 2009, enjoyed a benefit on the basis of the Decision on benefits due to functional age-dismissal civil servants defence ;
f. the former military officer and the former official who, on 1 August 2009, are entitled to a suppletion on the basis of the Suppletion scheme, part of the Ministry of Defence incapacity .
2 The basis of calculation referred to in paragraph 1 shall be as follows:
(a) in the case of the persons referred to in paragraph 1 (a), the salary received in the month of August 2009, according to what is understood by the following: Military personnel revenue decision ;
b. The persons referred to in point (b) of the first paragraph of the first paragraph of the period from 1 January 2009 to 31 August 2009 shall be remuneated in accordance with what is understood by the following: Military personnel revenue decision ;
(c) the salary referred to in paragraph 1 (c) on the month of August of the year 2009 according to what is understood by the following: Revenue and civil servants ' defence ;
d. In the case of persons referred to in paragraph 1 (d), in the month of August 2009, in the case of waiting money, after application of the funds referred to in paragraph 1 (d) above, Article 18 (6) the reduction in terms of income from or in relation to employment or business;
e. for the persons concerned referred to in the first paragraph, point (e) on the month of August 2009, after the application of the benefits provided for in the Decision on benefits due to functional age-dismissal civil servants defence , applicable reduction in terms of income from or in relation to labour or business;
f. to those concerned referred to in the first paragraph, point (f), one-eighth part of the supplementation received over the period from 1 January 2009 to 31 August 2009, following the application of the Suppletion scheme, part of the Ministry of Defence incapacity the reduction in terms of income from or in relation to labour or business.
3 The single payment 2009 shall not be included in the remuneration for the purposes of the Military personnel revenue decision nor does it form part of the pension base or income within the meaning of the Military former military personnel or the Military Pensions Framework Law .
4 The one-off payment 2009 makes for the official engaged in civil service, as well as for the former civil servant, who is entitled to this benefit, is part of the pension base.
This Decision shall enter into force from the day following the date of issuance of the Official Journal, where it is placed on the understanding that:
a. Article 7. Part F , shall work back until 1 October 2006;
b. Article 7 (B) shall work back to 1 January 2008;
c. Article 1 , Article 2 Parts A, D and E , the Articles 3 and 4 , Article 5 Parts A, D and E , Article 6 , Article 7 (A), (C) to (E), (G) and (H) and the Articles 8 and 9, Parts A, B, C, D, under 3 and 4, and E back to and including 1 March 2009;
ed. Article 9 (D) (1) and (2) back to and including 1 April 2009.
e. Article 2 Parts B and C and Article 5 Parts B and C back to and including 1 July 2009.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
