Having regard to Article 33, second paragraph, of the Law on Primary Education ; Article 33, second paragraph, of the Law at the centres of expertise , Article 38a, 2nd paragraph of the Secondary Education Act ; the Article 4.1.2, second paragraph , and 4.3.2, second paragraph, of the Education and Vocational Education Act ;
The Council of State heard (opinion of 9 November 2005, No W05.05.0487/III);
Having regard to the further report of Our Minister of Education, Culture and Science, of 21 November 2005, No AP/PSW/2005/52655 (B43), Directorate of Labour Market and Personnel Policy, released on behalf of Our Minister of Agriculture, Nature and Food Quality;
Have found good and understand:
1 By way of derogation from Article 7, first and second paragraph, of the Decision to meet the costs of sickness and incomes of education and research staff As those article members were published on 30 November 2005, the allowances, surcharges and additional supplements, covering the months of April 2005 to December 2005, are paid in December 2005.
2 The Decision to meet health costs and income supplement education and research staff shall be withdrawn, except that the Articles 7, third and fourth members , 8 , 10 , 10b and 10c As on 31 December 2005, the article members, such as those articles and articles thereof, shall continue to apply until 1 January 2007 to concessions, surcharges and additional allowances referred to in paragraph 1.
1 The Scheme for the provision of health care education and research staff shall be withdrawn, provided that the decision remaining in force on the day preceding the date of the withdrawal shall apply to concessions which:
-within the time limits specified in: Article 8 of the Staff Regulations on health and education as that stated on the day preceding the date of revocation, are or are requested in respect of a continuous period of 12 months referred to in Article 8 , as stated on the day preceding the date of repeal, which shall expire at the latest until December 2005;
-within the period referred to in paragraph 2, shall be applied for, for a period of time referred to in that paragraph.
2 If the period to which the application relates has been issued after 1 January 2005 at the latest, the application shall take place within 6 months of the date of withdrawal of the application. Scheme for the provision of health care education and research staff . The amount of the threshold referred to in: Article 9 of the Staff Regulations on health and education , as that article was stated on the day prior to the date of withdrawal, in that case, in proportion to the amount of the goods concerned.
This Decision shall enter into force on the date on which the Health insurance law enters into force. By way of derogation from the first sentence Article I, first paragraph , enter into force from the first day after the date of issuance of the Official Gazette, in which it is placed and shall operate back to 1 December 2005.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
