On the nomination of Our Ministers for Economic Affairs and of Agriculture and Fisheries of 26 November 1973, No (CAS No 673/639 W.J.A.;
Whereas provision should be made for the recovery of funds to be applied in order to combat the costs associated with the implementation of the provisions of the Distribution Act 1939 ( Stb. 633);
Having regard to Article 10, first paragraph, of the said Act ;
The Council of State heard (opinion delivered on 28 November 1973, No 3);
Having regard to the detailed report of the Ministers of Justice of 29 November 1973, No (CAS No 673/665 W.J.A.;
Have found good and understand:
For the purpose of this decision and the relevant provisions, our Minister for Economic Affairs is understood to be the Minister of Economic Affairs.
1 To combat the costs incurred in the implementation of the Distribution Act 1939 ( Stb. 633) are connected, Our Minister can claim:
a. contributing to the issue of licences for distribution of distribution products under that law;
b. contribute to the award of documents under that law.
2 The measure to which the provisions of paragraph 1, A The said contributions shall be calculated by our Minister. This measure may be different for different categories of cases. The contribution may not exceed 1½% of the sales value of the goods concerned.
3 The paragraphs in the first paragraph, B These contributions shall be determined by our Minister. They shall not exceed € 4,54.
1 The in Article 2 (a) or (b) Where the person concerned is authorized, the person responsible for the authorization shall be awarded the same document.
2 Our Minister shall determine at which institution the dates at which and how payment of the sums due shall be made.
1 of him, who regularly Article 2 (a) (a) Where payment has been made, the institution may, where the payment is made, order the deposit of an advance. The amount of the advance is determined by the institution; it may exceed € 9800,-not exceed it.
2 The contributions payable by the person concerned shall be offset against the advance paid by him.
(3) The person concerned shall, as soon as the application of the second paragraph has fallen below a limit to be fixed by the institution as a result of the application of the second paragraph, supplement the amount of the advance to the amount determined under the first paragraph.
4 As soon as it is established that the person concerned no longer pays regular contributions as provided for in paragraph 1, the institution shall return to him the advance payment or any portion thereof.
Our Minister can from the obligation to pay any under Article 2 the contribution provided for, whether or not subject to conditions, exemption and, at the request of the latter, grant a derogation.
This decision may be cited as: Distribution cost decision 1973.
This Decision shall enter into force from the second day following the date of issue of the State Sheet , where it's placed.
Burdens and orders that this decision in the State Sheet will be placed and copies will be sent to the Council of State and to the Court of Auditors.
