Decision of 26 September 2006 laying down the Decision on the objective and funding of the education background policy 2006-2010

On the nomination of Our Minister of Education, Culture and Science of 5 July 2006, no. WJZ/2006/27322 (2635), Management of Legal Affairs and Legal Affairs;

Having regard to the Articles 165 and 168, first paragraph, of the Law on Primary Education ;

The Council of State heard (opinion delivered on 3 August 2006, No W05.06.0275/III);

Having regard to the further report of Our Minister of Education, Culture and Science, of 21 September 2006, No WJZ/2006 /27324 (2635), Directorate of Legal Affairs and Legal Affairs;

Have found good and understand:


Article 1. Conceptual provisions

The conceptual provisions of the Law on primary education shall apply.

For the purpose of this Decision:

  • a. circuit class: a group or group of pupils as intended in the Articles 166 and 166a of the Law on Primary Education ;

  • b. preschool education: a programme which is provided by qualified staff in nurseries and nurseries for target group children of 2 and 3 years;

  • c. Early school education: a programme which is provided in Group 1 and 2, other than a circuit class, from an elementary school for target group children of 4 and 5 years;

  • d. Target group child: child with educational background that is based on the Article 6 is eligible to apply for pre-school education or child with educational background for whom a weight has been established on the basis of Article 27 of the Decision financed by the WPO As was the case on 31 July 2006, and which is eligible for early school education.


Article 2. Objective of educational background

Educational background policy in schools and in municipalities has the aim of early warning and combating of educational background in children, with the detailed conditions for local authorities in the field of education and training. Articles 4 to 7 Apply.


Article 3. Grant of the specific benefit to municipalities for combating educational background

If the sum of the school weights is: Article 27 of the Decision financed by the WPO As of 31 July 2006, from the main premises and branches of primary schools to the extent that they are situated in the territory of a municipality, based on the numbers of pupils on 1 October 2004, 11 is to be added to the (b) A specific benefit is granted for the control of educational background. This benefit is fixed for the school years 2006-2007 until 2009-2010. The benefit is calculated by adding the school weights together and multiplying the result by an amount to be fixed by ministerial arrangement.


Article 4. Use of specific benefit

  • 1 The municipality devotes the specific benefit to preschool education and/or to link classes to combat educational background, with the exception that up to 15% of the specific benefit provided in that year can be spent on coordinating and/or other activities related to the educational background policy.

  • 2 If the municipality offers preschool education, the municipality spends the specific benefit in the 2009-2010 school year at least to establish its own contribution from parents to the costs of receiving target group children. preschool playrooms which corresponds to or lower than the own contribution parents pay for children ' s shelter within the meaning of Law childcare and quality standard playrooms a maximum child care surcharge based on the Childcare supplement and concessions on childcare costs will be received.


Article 5. Adjustment period

  • 1 In the 2006-07 school year, the municipality may, in addition to the 15% of the specific benefit, referred to in Article 4 , 20% of the specific benefit given in that school year is devoted to preparing for the setting up of contact classes.

  • 2 The municipality, for the period 2006-2010, can spend part of the amount of the specific payment on early school education in the 2006-2007 school year. In the second and third years, spending on early school education is reduced, and in the fourth year, 2009-2010, spending on early school education has been reduced to zero.


Article 6. Preschool education conditions

In pre-school education, the following conditions apply:

  • a. The mayor and the municipality of a municipality shall indicate on the basis of which criteria a target group child qualifiers for the following of pre-school education;

  • b. Preschool education shall be given at least three day-parts per week for one year;

  • c. By way of derogation from Article 6 (b) , the municipality can spend the specific benefit, in the school year 2006-2007, in pre-school education, if it is given at least two daily parts per week for one year.


Article 7. Condition Class conditions

On link classes, the following conditions apply:

  • a. if the education in the circuit class takes place in conjunction with education in the regular group, as intended in Article 166 of the Law on Primary Education , the number of hours of education given in the switchboard class is at least 8 hours per week.

  • b. if the education in the circuit class takes place after the regular school term, intended in Article 166a of the Law on Primary Education , the number of hours of education given in the circuit class shall be a minimum of 100 hours per school year.


Article 8. Indexation specific benefit

The multiplication amount referred to in Article 3 , is adjusted annually based on the development of the genormed average staff reductions of primary school teachers, as mean in Article 120, sixth paragraph, of the Law on Primary Education The multiplication amount is published annually in the Official Journal.


Article 9. Adjustment specific benefit

The specific benefit and its adaptation, as referred to in the Articles 3 and 8 , may be amended on an annual basis, in whole or in part, to the extent that the situation of the State makes it necessary.


Article 10. Review

A national evaluation will take place after the 2007-2008 school year. Municipalities and competent authority bodies are involved in this request. The evaluation shall cover:

  • (a) cooperation between municipalities and competent authorities of schools in that municipality;

  • b. the manner in which municipalities have implemented preschool education;

  • c. the manner in which municipalities are set up as intended Article 1 (a) They've arranged it.


Article 11. Entry of

This Decision shall enter into force on a date to be determined by Royal Decree and shall be operational until 1 August 2006. This Decision shall expire with effect from 1 August 2010.
