Decision of 4 May 2009 laying down rules relating to the giving of driving instruction on driving of motor vehicles (Decree driving motor vehicles 2009)

Having regard to the Articles 5 , 9, first paragraph, parts a and b, and fifth member , 10, 1st Member , 12a, third member , 12b, third member , 12c, second member , 17, second paragraph , 21, first and third members , 22, 1st Member , and 23, 4th paragraph, of the Motor Vehicle Driving Law 1993 and Article 3, first paragraph, of the Vacationsdecision 1988 ;

The Council of State heard (opinion of 12 February 2009, No W09.08.0588/IV);

Having regard to the further report of Our Minister of Transport and Water State of 27 April 2009, No CEND/HDJZ-2009/411 AWW sector;

Have found good and understand:

Article 1

For the purposes of this Decision and the provisions based thereon,

Chapter II. Categories of certificates

Article 2

  • 1 Certificates shall be issued for the purposes of giving driving instruction for the following categories of motor vehicles:

    • a. Motor vehicles for driving of which driving licence A as specified in the Driving licences is required (category A);

    • b. Motor vehicles for driving of which driving licence B as specified in the Driving licences is required (category B);

    • (c) motor vehicles for the control of which driving licence C as specified in the Driving licences is required (category C);

    • d. Motor vehicles for driving of which driving licence D as specified in the Driving licences is required (category D);

    • (e) assembly of motor vehicle and towed vehicle for driving of which driving licence E in combination with driving licence B as specified in the Driving licences is required (category E to B);

    • (f) assembly of motor vehicle and towed vehicle for driving of which driving licence E in combination with driving licence C or D as specified in the Driving licences is required (category E at C or D);

    • (g) motor vehicles for driving of which licence T as specified in the Driving licences is required (category T).

  • 2 Licences issued for the purposes of giving driving instruction for the driving of category A motor vehicles shall also give the right to instruct driving for the driving of:

    • a. Vehicles of the AM category, mopeds, and theoretical driving instruction for the driving of the AM category, and

    • b. Vehicles of categories A1 and A2.

  • 3 Licences issued for the purposes of driving instruction for the driving of category B motor vehicles shall also give the right to provide driving instruction for the driving of the AM category, mop-mobiles, and the to provide theoretical driving instruction for the driving of the AM category.

  • Certificates issued for the purposes of driving instruction for the driving of category C motor vehicles shall also give entitlement to the instruction of driving instruction for the driving of motor vehicles of category C1.

  • 5 Certificates issued for the purposes of driving instruction for the driving of category D motor vehicles shall also be responsible for giving driving instruction for the driving of vehicles of category D1.

  • 6 Certificates for driving instruction for motor vehicles of category E to B also give the power to provide driving instruction for the purposes of controlling the composition of a motor of category B and a trailer or semi-trailer with a maximum permissible mass exceeding 750 kg, where the maximum permissible mass of the combination of tractor and trailer or semi-trailer is more than 3500 kg but does not exceed 4250 kg.

  • 7 Certificates issued for the purposes of driving instruction for driving vehicles of category E at C or E to D also give the power to provide driving instruction for the driving of category E motor vehicles with C1 E to D1, respectively.

The Article 5, first paragraph, of the Act Officials referred to at the Institute shall, for the purpose of maintaining the register, make known changes to the register of unqualified certificates as intended for the purposes of the Articles 14 and 19 of the Act .

Chapter III. Driving instruction

Paragraph 1. Pre-training

Article 4

  • 1 For the application for the examination of the test driving instructor, the applicant shall submit a documentary evidence to the institute certifying that it is a good result:

    • a. Training has been carried out at the level of at least secondary general secondary education, either lower than preparatory vocational education or individual vocational education, or

    • b. The suitability test as set out in Article 9 (4) of the Act has travelled.

  • 2 The provisions of paragraph 1 shall not apply to the applicant who already has a valid licence for the teaching of driving.

  • 3 Under ministerial arrangements, rules may be laid down concerning:

    • a. the establishment and the content of the fitness test; and

    • b. the assessment of the competences of the data subject and the manner in which that assessment takes place.

Article 5

The requirements of competence to provide driving instruction, which is to be found in: Article 9, first paragraph, part a, of the Act , are:

  • 1. Stage 1 Competent in traffic participation:

    • a. The driving instructor is able to participate safely, smoothly and environmentally conscious with a motor vehicle according to the driving procedure;

    • b. The driving instructor is aware of the task processes he runs during the running of the driving duties, and can understand these processes during the task execution in different teaching situations;

    • c. the driving instructor has as the second driver control over the teaching vehicle.

  • 2. Phase 2 Didactic conditions:

    • a. The driving instructor can establish and account for an individual subsequent curriculum for the learning process and for the lesson plan;

    • b. the driving instructor can prepare the lessons of content and teaching in such a way that a powerful learning environment is achieved for the students;

    • c. The driving instructor can plan and address teaching situations in such a way that:

      • -the training of teaching activities in fluency;

      • -disturbances can be prevented or resolved;

      • -the teaching and learning time available is devoted to the task of addressing the job;

    • d. the driving instructor can instruct the learner to carry out the various sub-tasks progressively more independently in connection with his current level of control;

    • e. the driving instructor can signal developments in the student learning process and support him and guide him in the self-employed and with confidence learning to tackle the driving tasks, and solving problems;

    • f. the driving instructor can assess the development in the learner 's ability to drive by checking the student' s assessment level, or by using the judgement of other driving instructors or examiners.

  • For the purposes of applying the first and second members, the applicant shall, in respect of the requirements laid down therein, satisfy in particular the requirements to the extent that such requirements relate to the category of motor vehicles for which the issue of a certificate is to be requested.

Detailed rules may be laid down in the case of ministerial rules concerning the requirements of the Article 5 .


Paragraph 3. Internship

The requirements of competence to provide driving instruction, which is to be found in: Article 9, first paragraph, part b, of the Act For the purposes of categories B, A, C and D, are:

Competent acting as a driving instructor in authentic teaching situations:

  • a. The driving instructor is able to instruct, during which the learner, in connection with his current level of control, gradually learns to carry out the various sub-tasks progressively more independently;

  • b. the driving instructor can signal developments in the student learning process and support him and guide him in the self-employed and with confidence learning to tackle the driving tasks, and solving problems;

  • c. the driving instructor can assess the development in the learner's ability to drive by checking the student's assessment level, or by using the judgement of other driving instructors or examiners.

  • d. the driving instructor can reflect on his act as a leader and evaluate to such an extent that the results of this act give guidance on the updating of that action.

Article 7 shall apply mutatis mutandis to the provision of driving instruction specified in Article 9, first paragraph, part b, of the Act for the purpose of category T, and for the benefit of 9a, second member, of the law .

  • 1 By ministerial arrangement rules may be laid down concerning:

    • a. the content, duration and possible extension of the internship in relation to particular circumstances, and the manner in which it is going through,

    • b. the assessment of the trainee and the manner in which the assessment takes place; and

    • c. The designation of stageconductors.

  • 2 The institute may, if the trainee does not act according to the in Article 12a, third paragraph, of the Act of the requirements referred to, the part of the placement which has been followed until the finding of that action is invalid.


Paragraph 4. Retraining

The person who follows further training as intended Article 12b of the Act , takes place during the period when his certificate as referred to in Article 13, introductory wording and part b of the Act , is valid, is part of six dayparts theoretical retraining in one of the categories for which he has the certificate. Each part of theoretical refresher training is unique in terms of content.

  • 2 The person whose second-day part-practice guidance has not been assessed as sufficient shall follow a third-day practical guidance in the period referred to in the first paragraph.


Article 11

Without prejudice Article 12b, first paragraph, second sentence, of the Act , the applicant shall, for the issue of a certificate in relation to the expiry of a certificate previously issued to the applicant, satisfy the requirements specified in the Articles 9 and 10 .

Under ministerial arrangements, rules may be laid down concerning:

  • a. the size, content and obligations of those who provide the certified courses,

  • b. the extent, content, duration and possible extension of the practical in-service training related to particular circumstances; and

  • c. the assessment of the competences of the person providing driving instruction and the manner in which that assessment takes place.


Paragraph 5. Reentry

  • 1 The reentry path, intended in Article 12c, first paragraph, of the Act , exists for the purpose of obtaining a certificate, Article 13, introductory wording and part b of the Act :

    • a. for the driving instruction in the category B driving licence category 1 and 2 for the category B, for the purposes of category B Article 5 ;

    • b. For the driving instruction in the driving category T from stages 1 and 2 for the category T, intended in Article 5 , if the applicant is solely in possession of a certificate not exceeding five years as intended Article 13, introductory wording and part b of the Act for the driving licence category T;

    • c. For the driving instruction in the driving category A from stage 1 for category A and stage 2 for category B, intended for the purpose of driving instruction in the Article 5 , if the driving instructor is solely in possession of a certificate for driving instruction in the driving category A for no more than five years;

    • d. for the purposes of driving instruction in the other categories of driving from the practical test from stage 1 for the category concerned, intended for the purposes of the Article 5 , and possession of a valid certificate for the driving category B.

  • 2 Under ministerial arrangements, rules may be laid down concerning:

    • a. the size and content of the reentry path; and

    • b. the assessment of the competences of the reentry and the manner in which that assessment is carried out.

Chapter IV. Education and training education and training alcohol final programme

Article 14

The main course of training, Article 17, second paragraph, part a, of the Act , where the possession of a valid diploma is required for the issue of a certificate for the provision of training education and training alcohol-final programme is an education at the level of scientific education or higher education. vocational education, which has been examinated in psychology, pedagogic, andragogics, information science, education or a similar profession.


Article 15

The professional experience required for the issue of a certificate for the provision of training and training for education and training as intended for the purpose of Article 17, second paragraph (b) of the Act , shall be at least two years.


Article 16

The additional requirements of competence for the provision of educational training intended for training Article 17, second paragraph (c) of the Act if the training is the mental or physical fitness of the holder of a driving licence:

  • 1. knowledge of the broad outlines of traffic legislation and of road traffic declarations;

  • 2. knowledge of problem behaviour and road traffic accidents in relation to psychological, social and medical factors;

  • 3. knowledge of problem behaviour and road traffic accidents in relation to vehicle and environment factors;

  • 4. knowledge and skill in organizing, giving, and evaluating education educational action.

The additional requirements of competence for training under the alcohol-final programme, intended to be carried out in the context of the Article 17, fourth paragraph, of the Motor Vehicle Driving Law 1993 is Article 16 applicable mutatis mutandis.

  • 2 When imposing the obligation to pass a test, the Institute shall identify the component or components of competence specified in this Annex. Article 5 , the key must be related.

By way of derogation from Article 7, first paragraph, of the Decree driving instruction motor vehicles as this was applicable before the entry into force of this Decision, the applicant for the first issue of the certificate for giving driving instruction relating to motor vehicles of the driving licence category A or B does not have to comply with the requirement mentioned in part 15 of Article 6 of the Decision driving instruction motor vehicles as this applied before the entry into force of this Decision.


Article 20

This decision is cited as: 'Motor vehicle driving decision 2009'.


Article 22

The Decision of 13 July 2006, No 06.002554 on the granting of a fixed remuneration to the President and members of the Commission of the profession under the Motor Vehicle Driving Law 1993 , is withdrawn.


Article 23

This Decision shall enter into force on a date to be determined by the Royal Decree, which may be adopted in a different way for the various articles or parts thereof.

Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
