On the nomination of Our Minister of Social Affairs and Employment of 17 November 2015, No 2015 -0000282214, done on behalf of the Secretary of State for Health, Welfare and Sport;
Having regard to Article 5 of the Law on Youth ;
The Department for the Advisory Board of the State (opinion of 9 December 2015, no. W12.15.0404/III);
Having regard to the further report of Our Minister of Social Affairs and Employment of 14 March 2016, no. 2016-0000025155, released on behalf of the State Secretary for Health, Welfare and Sport,
Have found good and understand:
For the purpose of this Decision:
holder: the person who maintains a youth residence;
Youth stay: establishment, not financed by a Dutch government or under a statutory provision, where at least four minors have been left or are expected to spend more than half of the time outside family or family-related periods for half a year or shall stay overnight.
The quality rules relating to the mission and vision of the youth area shall, in any event, contain the following elements:
a. the aims of the youth residence;
b. the standards and values to be used in the youth residence and which the holder wishes to give to the minors; and
c. a description of the target group to which the youth residence is focused.
The quality rules governing the position and involvement of the minors and their parents shall, in any event, contain the following elements:
a. opportunities for participation and involvement of minors and parents with regard to the policies of the youth residence;
Keep evaluation interviews with the parents at least once a year;
c. the manner in which the quality requirements are made available to the minors and their parents; and
d. the manner of publication in writing to parents and minors who is the confidential person of trust and how to achieve them, how the confidentiality and independence of this person is ensured and what the tasks and powers of these persons is person.
The rules on the quality of the complaints policy contain a complaint procedure for the parents and the minors, which is described in any case:
a. to whom a complaint is lodged;
b. that treatment of a complaint is made by a person who has not been involved in the conduct to which the complaint relates;
(c) within which period the complaint shall be dealt with;
d. that a written report on the handling of the complaints submitted is submitted annually; and
e. the means of ensuring that parents, minors, employees and volunteers are aware of the complaints policy.
The quality rules concerning the reporting of policies and objectives of the youth area shall contain a description of the manner in which the policy is assessed each year and, where appropriate, adjusted.
The quality requirements for the safe and healthy working and living environment shall in any event contain the following elements:
a. At any time, the presence of at least one employee or volunteer in the youth residence, who holds a valid first-aid degree;
b. a statement of reasons for the relationship between the number of volunteers or workers present at the same time, and the number of minors;
c. how to ensure a safe and healthy living environment for minors residing in the youth area;
d. In what way is to be used with:
1 °. Aggression and discrimination;
2 °. alcohol and drugs;
3 °. child abuse; and
4 °. bullying; and
e. the means of ensuring that the holder, or his replacement, is reachable at any time.
The quality rules governing personnel policy shall, in any event, contain the following elements:
a. the tasks and functions of the employees and volunteers of the youth residence, including the associated responsibilities and powers; and
b. the arrest policy, including what the desired competences are for new employees and volunteers, distinguishing between employees and volunteers.
The quality rules for the pedagogical policy and the pedagogical environment include a pedagogical policy plan, which describes the vision for young people in relation to the relationship with minors. In any case, the pedagogical policy plan shall contain in any case a description of the following:
a. the manner in which the emotional safety of minors within the youth residence is ensured;
b. the possibilities for minors to develop their personal and social competences;
c. the manner in which the formation of civic education is carried out;
(d) punish, suspend and remove the use of the measures; and
e. the use of social media.
The quality requirements shall be legible and understandable to workers, volunteers, minors and their parents and shall be made available to them.
This decision is cited as: Decision on youth residenes.
This Decision shall enter into force on the date on which the Law on youth stays enters into force.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
