Decision of 19 January 1982 adopting a general measure of management as referred to in Article 1 of the Law conversions in gold units of account

On the nomination of Our Minister of Justice of 5 November 1981, Staff Section, Private Law, No 521/681;

Having regard to Article 1 of the Law conversion into gold units of account expressed ( Stb. 1981, 295);

The Council of State heard (opinion of 8 December 1981, No 811202/ 6);

Having regard to the further report of our Minister of Justice, a.i. of 5 January 1982, Staff section of Private Law Legislation, No 006/682;

Have found good and understand:


Article 1

The method of conversion into Dutch money, referred to in Article 1 of the Law conversion into gold units of account expressed ( Stb. 1981, 295) shall be applied to the units of account defined in the following provisions:

  • a. Article 4, fifth paragraph, Ed -the International Convention on the establishment of certain uniform rules concerning the bill of lading adopted in Brussels on 25 August 1924, as amended by the Protocol to this Convention, adopted in Brussels on 23 February 1968 ( Trb. 1953, 109 and Trb. 1979, 26);

  • b. Article 469 A , fourth paragraph, of the Commercial Code , as amended by the Law of 11 March 1981 ( Stb. 206);

  • (c) The sixth paragraph of Article 3 of the International Convention on the limitation of the liability of owners of seagoing ships, adopted in Brussels on 10 October 1957 ( Trb. 1958, 46), and Article 740 Ed , fourth paragraph, of the Commercial Code ;

  • d. Article 3, second paragraph, of the Law of 24 October 1973 ( Stb. 536), dealing with the legal liability of operators of nuclear vessels;

  • (e) Article V, ninth paragraph of Article V of the International Convention on Civil Liability for Oil Pollution, adopted in Brussels on 29 November 1969 ( Trb. 1970, 196 and Trb. 1971, 77), and Article 4, third paragraph, of the Liability of oil tankers ( Stb. 1975, 321);

  • (f) Article 1 (4) of the International Convention for the Establishment of an International Fund for Compensation for Oil Pollution Damaged ( Trb. 1973, 101);

  • (g) Article 22 (4) of the Treaty establishing unity in Warsaw, adopted on 12 October 1929, in certain provisions relating to international air transport ( Stb. (a) and Article 22 (5) of the Convention, as amended by the Protocol to this Convention, adopted on 28 September 1955 in The Hague ( Stb. 1933, 365 and Trb. 1956, 26);

  • h. Article 30, sixth paragraph, of the Law of 10 September 1936 ( Stb. 523) laying down provisions for air transport;

  • (i) Article 23, third paragraph, of the Convention on the International Carriage of Goods by Road (CMR;) reached in Geneva on 19 May 1956; Trb. 1957, 84);

  • (e) Article 57, first paragraph, of the International Convention on the carriage of goods by railway (CIM;), adopted in Berne on 7 February 1970; Trb. 1970, 172);

  • Article 53, paragraph 1, of the International Convention on the Carriage of Passengers and Luggage By Rail (CIV;), adopted in Berne on 7 February 1970; Trb. 1970, 173);

  • (l) Article 21 of the Additional Convention to the International Convention on the Carriage of Passengers and Luggage By Rail (CIV) of 7 February 1970, on the liability of the railway for the death and injury of passengers (Additional Convention of 26 February 1966 as amended by Protocol II, signed in Berne on 9 November 1973; Trb. 1966, 174 and Trb. 1974, 92);

  • m. Article 7, point B -the Convention on Civil Liability in the Field of Nuclear Power, adopted in Paris on 29 July 1960, as amended by the Additional Protocol to this Treaty, adopted in Paris on 28 January 1964 ( Trb. 1964, 175);

  • n. Article 3, point G (b) of the Treaty of 31 January 1963 in Brussels supplementing the Treaty of Paris of 29 July 1960 on civil liability in the field of nuclear energy, as amended by the Treaty of Paris on 28 January 1964, and Additional Protocol to this Convention ( Trb. 1964, 176).

This Decision shall enter into force on a time to be determined by Us.

Burden and order that this Decision, together with the accompanying note of explanatory note to the State Sheet will be placed and copies thereof will be sent to the Council of State.
