Decision of 18 July 1973, providing for reimbursement of the costs of a meal to officials engaged in overtime

On the nomination of our Minister of Home Affairs of 5 June 1973, No AB73/U776, DirectorateGeneral Public Affairs Policy, Directorate-general For Public Affairs, Main Financial Conditions Of Employment;

Article 72 of the Constitution and the Articles 125 , 1st Member and 134, first member of the Civil Service Act 1929 ( Stb. 530);

having regard to the further report of our Minister of Home Affairs of 10 July 1973, No AB73/1072, DirectorateGeneral Public Affairs Policy, Directorate-general For Public Affairs, Main Financial Conditions Of Employment;

Article 1

For the purposes of this Decision, the following definitions shall apply:

  • a. Our Minister: which is understood to be equivalent to or equivalent to Travel expenses decision 1989 .

  • b. Official: the person, who is in civil service of the realm or any of his services, companies or institutions;

  • c. Overtime; which is understood to be in the Remuneration Decision Civil and civil servants 1984 .

  • ed. a meal: a simple hot meal consisting of at least a master dish;

  • e. -a public meal: a meal, whether or not to be provided in the form of free payment, or by intermediary of the competent authority on behalf of the Kingdom.

  • 1 If, on the day on which overtime is to be carried out, the official's daily working time is extended by at least two overtime hours and, as a result, the service's interest in the judgment of the competent authority does not allow him to have his meal At the time required for this purpose, the rules set out in the following paragraphs shall apply to the place where it is normally used.

  • 2 If possible, a public meal shall be provided to the official, except that if he has had to pay him the costs incurred shall be reimbursed to him up to the amount of the allowance calculated on the basis of the Third paragraph, point A .

  • 3 Where a provision as referred to in the second paragraph is not possible, the official shall:

    • a. which has demonstrably used and paid a meal in a given opportunity, a fee equal to the actual expenses incurred up to a maximum amount equal to the fee for an evening meal on mission expenses in Netherlands due to the Travel decision domestic ;

    • b. which has not been demonstrably granted a meal in a given occasion and paid, € 2.27.

The decision shall not apply where and in so far as a different scheme provides for reimbursement of the costs referred to in this Decision.

  • 1 Our Minister is empowered to derogate from the rules laid down in this Decision in cases where such rules do not, in his opinion, be reasonably or reasonably foreseen.

  • 2 Our Minister is empowered to apply this decision in a similar manner to situations of work comparable to that of overtime.

This decision may be cited as the decision to pay overtime in overtime.


Article 6

This Decision shall enter into force from the second day following the date of issue of the State Sheet , where it's placed.

Our Ministers, as far as he is concerned, are responsible for the implementation of this Decision, which is State Sheet will be placed and copies of which will be sent to the Council of State and to the Court of Auditors.
