On the proposal of our Minister of Finance of 19 October 2000, No BGW2000/1839M, made on behalf of our Minister of Home Affairs and Kingdom Relations and the Secretary of State for Transport and Water State;
Having regard to Article 2, third paragraph, of the Financing of Local Authorities ;
Hearing the Council of State (opinion of 17 November 2000, W06.00.0494/IV),
Having regard to the further report of our Minister of Finance, released on behalf of our Minister of Home Affairs and Kingdom Relations and the Secretary of State for Transport and Water, of 13 December 2000, No FM2000/0251-M;
Have found good and understand:
Monetary loans can only be contracted or provided by public bodies and the fulfilment of obligations arising out of money loans in respect of the payment of interest and repayment may be guaranteed by public bodies only, where the mutual commitments are expressed in euro or in one of the national currencies of the Member States of the European Union participating in economic and monetary union.
Monetary loans can only be contracted or provided by public bodies and the fulfilment of liabilities arising out of money loans in respect of the payment of interest and repayment may be made by public entities only guaranteed, if the principal is not subject to any form of indexation.
This Decision shall not apply to:
a. Money loans with an average maturity of less than 10 years entered into before the entry into force of this Decision and whose principal is subject to any form of indexation;
(b) the fulfilment of obligations guaranteed for the entry into force of this Decision in respect of the payment of interest and repayment of loans of interest, with an average duration of less than 10 years and of which the principal is subject; some form of indexation;
c. Money loans granted before the entry into force of this Decision.
This Decision shall enter into force with effect from the date on which the Law financing decentralised authorities enters into force.
This decision is cited as: Decision lending conditions decentralised authorities.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
