Having regard to the Articles 39, first and third paragraphs , and 40, third member, of the Personal Data Protection Act ;
The Council of State heard (opinion delivered on 27 March 2001, No W03.01.0049/I);
Having regard to the further report of the Minister of Justice of 5 June 2001, No 5101170/01/6
Have found good and understand:
For the purposes of this Decision, the following definitions shall apply: Personal data protection law .
1 The fee for the costs of the communication, referred to in Article 35 of the Act , amounts to € 0.23 per page up to a maximum amount of € 5,-for each individual notice.
2 The controller may charge a reasonable fee for the costs of the communication which is provided on a data medium other than paper, except that the latter shall not exceed € 5.
By way of derogation from Article 2 the responsible officer may charge a reasonable fee, except that it shall not exceed € 22,50 in the case of:
(a) the communication consists of more than one hundred pages;
(b) the communication consists of a copy of a data processing which is difficult to access because of the nature of the processing;
c. The communication consists of printing one or more x-rays.
The person responsible may pay for the costs of the treatment of a resistance as referred to in Article 4 (1). Article 40 of the Act to charge a reasonable fee, except that it shall not exceed € 4.50.
Until 1 January 2002, the rates shall be by way of derogation from:
(a) Article 2, first paragraph: f 0,50 and f 10,00 respectively;
(b) Article 2 (2): f 10,00;
c. Article 3: f 50,00; and
d. Article 4: f 10,00.
This Decision shall enter into force on the date on which the Personal data protection law enters into force.
This decision is cited as: Decision on charges for reimbursement of rights subject to Wbp.
