Decision of 22 August 2011 laying down rules on equalisation of costs related to the limitation of the quantity of CO2 emissions established for greenhouse horticulture (Decision on the reduction of CO2 emissions from cost equalisation)

On the nomination of the State Secretary for Infrastructure and the Environment of 20 January 2011, no. BJZ2011034896, Directorate of Administrative and Legal Affairs, acting on behalf of the State Secretary for Economic Affairs, Agriculture and Innovation;

Having regard to the Articles 15.52 and 15.53, first, second and third paragraphs, of the Environmental Protection Act and Article 2.22, third paragraph, part e of the General Provisions Act ;

The Department for the opinion of the Council of State heard (opinion delivered on 24 February 2011, No W14.11.0015/IV);

Having regard to the further report of the State Secretary for Infrastructure and the Environment dated 15 August 2011, No IENM/BSK-2011/107484, Chief Executive of Administrative and Legal Affairs, released on behalf of the State Secretary for Economic Affairs, Agriculture and Innovation;

Have found good and understand:

For the purposes of this Decision the following definitions shall apply: Environmental Environment Act .

The amount of the fee due by the person who is responsible for the establishment of an establishment Article 15.51 of the Act drive is the result of the formula:

V = ((Et-Er) x P) x (Eb/Et),

Where proposed:

V: the fee payable by the establishment;

Et: the establishments referred to in the Annex Article 15.51 of the Act , in the calendar year, the amount of CO2 emitted collectively, expressed in tonnes;

There is the amount of emissions specified by our Minister in accordance with our Minister for Economic Affairs, Agriculture and Innovation, as set out in Article 15.51 of the Act , expressed in tonnes;

P: the amount of CO2 emitted per tonne of CO2;

Ebb: the amount of CO2 emitted by the establishment in the calendar year expressed in tonnes.
