Decision of 11 March 1991, implementing Article 983 of Book 8 of the Civil Code

On the nomination of Our Minister of Justice of 18 July 1990, Staff Section of the Legislation New Civil Code No 24355/690;

Having regard to Article 983 of Book 8 of the Civil Code ;

The Council of State heard (opinion delivered on 10 September 1990, No W03.90.0331);

Having regard to the detailed report by our Minister of Justice of 28 February 1991, Staff Section, New Civil Code, No 46950/91/6;

Have found good and understand:

  • (2) In the case where the compensation is determined in the form of an interest, the capitalised amount may not exceed € 137 000 per traveller.


Article 2

  • 1 The compensation, which may be due to the carrier in the event of a delay of a traveller and loss, damage or delay of his luggage, shall be limited to a sum of € 1 000.

  • 2 The compensation which the carrier may owe in the case of a vehicle or ship which is passed as baggage for the carriage of goods and the cases on board it is limited to an amount of € 9 100per vehicle or ship.

This Decision shall enter into force at the time of the entry into force of Book 8 of the Civil Code.

Burden and order that this Decision, together with the accompanying note of explanatory note to the State Sheet will be placed and copies thereof will be sent to the Council of State.
