Decision of 2 May 1961, renewed adoption of the general measure of administration provided for by Article 570 of the Commercial Code

We JULIANA, at the grace of God, Queen of the Netherlands, Princess of Orange-Nassau, etc., etc., etc.

On the nomination of Our Minister of Justice of 16 January 1961, Staff Section, No 019/661, also on behalf of our Minister for Transport and Water State;

Having regard to Article 570 of the Code of Commerce ;

The Council of State heard (opinion delivered on 28 February 1961, No 31);

Having regard to the further report of our Minister of Justice of 25 April 1961, No 145/661, also on behalf of our Minister for Transport and Water State;

Have found good and understand:

For the purposes of applying the provisions of the seventh title of the second book of the Commercial Code

The Dollart, the Eems, the Lauwerszee, the Wadden Sea and the IJsselmeer in their entirety, the Doorgraving, the Scheur, the Westgeul, the Old-and New Meuse and the Dordtse Kil, the Malle Gat and the Krabbegeul in their whole, as well as the other South Holland and Zeeland flows, bounded in the north by the northern bank of the Haringvliet, the Dirty Hole and the Hollands Diep to the railway bridge at Moerdijk, in the east by the mainland of North Brabant from the said railway bridge to the Dutch-Belgian border to the south by the Dutch-Belgian border in the Scheldt and through the mainland of Zeeland-Flanders,

be regarded as belonging to the sea and its beaches and its shores to be part of the sea-edge.

The waters referred to in the previous paragraph shall be understood to mean ports, provided that they are in free form.

The Royal Decree of 18 December 1933, Stb. 703 is hereby repealed.

Our Ministers of Justice and of Transport and Water State are in charge of the implementation of this decision, which is State Sheet will be placed and copies of which will be sent to the Council of State.
