On the proposal of Our Ministers for Public Business Organisation of 24 March 1955, no. B. 2496, Dir. W.J.A., of Agriculture, Fisheries and Food of 24 March 1955, no. J. 1085, Afd. W.J.Z. and from Economic Affairs of 24 March 1955, no. 23479, Dir. W.J.A.;
Whereas it is desirable to define the cases in which our Minister for Economic Affairs for the application of the Setup Law Product for Vegetable and Fruit ( Stb. 1954, 446) and of the Articles 94 , 100 , third member, and 104, 2nd paragraph, of the Law on Business Organization ( Stb. In the case of Fruit and Vegetable, the Ministry of Fruit and Vegetates shall be considered to be the Minister concerned;
Having regard to Article 13 of the abovementioned Law;
The Council of State heard (opinion delivered on 19 April 1955, no. 49);
In view of the further report of our abovementioned Ministers, of 13 June 1955, no. B. 2638, Dir. W.J.A., of 13 June 1955, no. J. 1086, Afd. W.J.Z. and of 13 June 1955, no. 23480, Dir. W.J.A.;
Have found good and understand:
For the purposes of the application of the Setup Law Product for Vegetable and Fruit ( Stb. 1954, 446) and of the Articles 94 , 100 , third member, and 104, 2nd paragraph, of the Law on Business Organization ( Stb. The Minister for Economic Affairs is considered to be the Minister of Economic Affairs of the European Communities in respect of the Product for Fruit and Vegetable. In so far as regards:
(a) Regulations which impose binding rules on the retail trade of fruit and vegetables, preserved fruit and preserved fruit or fruit or products thereof;
(b) Regulations governing the restriction of competition between those undertakings which undertakings in the fruit and vegetable processing industry or in the wholesale distribution of fruit and vegetables, preserved fruit and vegetables; Products obtained from fruit or vegetables.
This Decision shall enter into force on the date of entry into force of the Setup Law Product for Vegetable and Fruit .
Our Ministers for Public Service, Agriculture, Fisheries and Food and Economic Affairs are entrusted with the implementation of this Decision, which is to be implemented in the State Sheet will be placed, and copies of which will be sent to the Council of State.
