Decision of 21 February 1972, implementing Article 11a of the Special Pension Act 1940-1945

We JULIANA, at the grace of God, Queen of the Netherlands, Princess of Orange-Nassau, etc., etc., etc.

On the nomination of the Secretary of State for Culture, Recreation and Social Work of 12 January 1972, Section of Extraordinary Pensions and General Criminal Accidents Scheme Indonesia (A.O.R.), No U 7310, also on behalf of Our Minister of Finance and the State Secretary for Social Affairs;

Having regard to the Articles 3 , 11 A and 46 of the Law of Extraordinary Pension 1940-1945 ( Stb. 1947, H 313);

Having regard to the opinions of the Extraordinary Pensions Board and the Foundation 1940-1945;

The Council of State heard (opinion delivered on 26 January 1972, No 16);

Having regard to the further report by the Secretary of State, cited above, of 18 February 1972, No 7563;

Have found good and understand:


Article 1

For the purpose of this Decision:

the law: the Law Extraordinary Pension 1940-1945 ( Stb. 1986, 575);

Our Minister: Our Minister of Welfare, Health and Cultural Affairs;

the Social Insurance Bank: the Social Insurance Bank, named in Chapter 6 of the Act implementing organisation of work and income ;

the person concerned: the participant in the resistance within the meaning of Article 1, first paragraph, of the Act , as well as the person belonging to one of the categories of persons referred to in Article 1, second paragraph, of the Act.

The treatment and care provided for in Article 11 A In addition to medical and surgical provisions, provisions of a medical-social nature and all that may be considered appropriate for the restoration, maintenance or promotion of suitability for works, Fitness has been reduced as a result of injury, mutilation, diseases or defects which have resulted in the right to an extraordinary pension.

  • 1 The costs of the Article 2 be reimbursed only if and to the extent that the person concerned cannot claim, on the basis of other provisions or in accordance with the agreement, full or partial reimbursement of such costs. In so doing, the fixed fee referred to in paragraph 3 shall not be taken into account.

  • 2 Subject to the flat rate referred to in paragraph 3, the compensation for treatment and care shall be granted in accordance with rules laid down by Our Minister.

  • 3 For the purpose of combating the cost of medical services, the person concerned, who shall enjoy an increase provided for in Articles 10 and 11 of the Law, shall be entitled to a fixed fee of € 1361.34 each year. This fee shall be paid in monthly instalments of € 113,45. Entitlement to this allowance shall take effect on the first day of the month in which it is granted, and shall end by the end of the month in which the person concerned has died.

This Decision shall enter into force from the second day following the date of issue of the State Sheet , in which it is placed, and works back to 1 January 1970.

Our Minister of Culture, Recreation and Social Work is in charge of the implementation of this decision, which is State Sheet will be placed and copies of which will be sent to the Council of State and to the Court of Auditors.
