On the nomination of Our Minister for Health, Welfare and Sport of 17 December 1997, DWJZ-U-971811, made on behalf of our Minister of Justice;
Having regard to Article 10, Fifth paragraph, of the Organ Donation Act ;
The Council of State heard (opinion of 15 January 1998, no. W13.97.0804);
Having regard to the further report of our Minister for Health, Welfare and Sport of 21 January 1998, DWJZ-U-9898, delivered on behalf of our Minister of Justice;
Have found good and understand:
For the purpose of this Decision:
a. Our Minister: Our Minister of Health, Welfare and Sport;
b. Donation form: the donor form, intended in Article 10 of the Organ Donation Act ;
c. Donation register: the donor register referred to in Article 10 of the Organ Donation Act .
The paper donor form contains the Annex 1 entered text. The digital donor form contains the Annex 2 entered text. Our Minister may add instructions to the text of the paper and digital donor form regarding the completion, date, signing and mailing.
1 Every year, after a consultation with our Minister of the Interior, our Minister sends a donor form to each resident as intended in the Basic registration law , which has reached the age of 18 years in the previous year and which at the specified time is not yet a statement on the removal of organs in the donor register.
2 Our Minister sends a donor form every year after a consultation with our Minister of the Interior and Kingdom Relations, to each resident intended for the purpose of the Basic registration law , who:
a. As at 31 December of the year preceding the registration, at least three years but not more than four years new as resident is registered or re-registered as resident in the basic registration;
b. on 31 December of the year of registration or registration as a resident in basic registration persons had reached at least the age of nineteen years; and
c. No statement of the removal of organs in the donor register has been made at the specified time.
(1) If a donor form is not, or is manifestly incorrect, recorded, the declaration of intent made by that form shall be deemed to have been made at the date of receipt of the donor register.
2 Upon registration of the will or a whole or partial revocation thereof, the person concerned shall, within six weeks of receipt of the completed donor form, receive a confirmation of the registration with the request. verify.
3 The declaration of intent cannot be consulted earlier than four weeks after the confirmation of the registration has been sent to the person concerned and it has not responded to the confirmation within that time limit.
1 The person concerned may revoke, in whole or in part, his declaration of intent to be included in the donor register by re-filling a donor form and by registering the donor register.
2 Change of data relating to a particular person, to whom Article 9, 2nd paragraph, of the Organ Donation Act The decision on the removal of organs may also take place by registering a declaration to that effect which has been signed and signed at least in its own right.
The donor register shall be accessible only to persons and institutions which are to be notified by our Minister and who comply with the rules laid down by our Minister on the method of consultation. If an institution is designated, through which consultation takes place, the Minister may, in addition, make provision for the appointment of rules relating to the organisation and supervision of that institution.
This Decision shall enter into force on a date to be determined by Royal Decree.
This Decision is cited as: Decision of the donor register.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
