Having regard to Article 33, second paragraph, of the Code of Civil Procedure ;
The Council of State heard (opinion of 8 May 2008, No W03.08.0125/II);
Having regard to the further report of the Secretary of State for Justice of 27 June 2008, Directorate-General for Legislation, No 5551627/08/6;
Have found good and understand:
The reliability and confidentiality of the electronic transmission of requests and communications related to the role shall be subject to the following requirements:
a. A dish uses a data processing system that is able to identify the consignor and verify that a message is authentic and actually comes from the consignor;
b. A court uses a data processing system that is capable of verifying that the message is complete and has not been modified to an unauthorized person;
c. A dish uses a data processing system that is equipped according to national and international standards for information security.
A court shall, without delay, electronically confirm the receipt of electronically transmitted requests and communications regarding the role.
This Decision shall enter into force on the date on which the Abolition of procurate law and introduction of electronic messaging enters into force.
Charges and orders that this Decision will be placed with the corresponding Note of Note in the Official Journal.
