On the nomination of Our Minister of Justice of 17 September 1964, No 332/664, Department of Private Law Staff Law, also on behalf of Our Ministers of Finance and of Traffic and Water State;
Having regard to Article 22 of the Motor Vehicle Liability Insurance Act ;
Hearing the Council of State (opinion delivered on 7 October 1964 No 26),
Having regard to the detailed report of 20 October 1964, Staff Section, Private Law, No 387/664,
Have found good and understand:
For the purposes of this Decision, the following definitions shall apply:
a. Act: the Motor vehicle liability insurance law ;
b. Motor vehicles: which is understood to be Article 1 of the Act.
1 The sum for which the insurance of liability is covered by Article 3, first paragraph, of the Act , for a motor vehicle at least to be closed, the following shall be:
a. for damage to persons € 5,600,000 per event;
b. for damage to cases € 1,120,000 per event.
2 By way of derogation from the first paragraph, introductory wording and point (a), for a motor vehicle designed to carry more than eight persons, including the driver, the sum insured shall be at least € 10,000,000 per event.
The sum, for which the insurance of liability is intended Article 3a, first paragraph, of the Act , at least for a motor vehicle to be closed, it shall be € 10,000,000 per event.
In addition, for a motor vehicle, which is used for transport under a valid licence as referred to in Article 1, Article 4 of the Passenger Transport Act 2000 , the sum insured for damage to cases, which belong to the persons transported under that licence, shall not be less than € 40,000 per event.
1 This decision may be cited as: Decision amounts to motor vehicle liability insurance.
2 It shall enter into force with effect from 1 January 1965.
Our Ministers of Justice, Finance and Transport and Water State are entrusted with the implementation of this Decision, which is in the State Sheet will be placed and copies of which will be sent to the Council of State.
