Having regard to Article 3, fifth paragraph, of the General Assistance Act , Article 3, fifth paragraph, of the General Survivors Law , Article 1, sixth paragraph, of the General Old Age Act , Article 1, sixth paragraph, of the Coordination Law Social Insurance , Article 3, fifth paragraph, of the Income Provision Act, older and partially unemployed unemployed workers , Article 3, fifth paragraph, of the Income Provision Act, older and partly incapacitated self-employed workers , Article 1, sixth paragraph, of the Toeslagenwet -Article 1 (6) of the Wet incapacity for incapacity for work, Article 1, sixth paragraph, of the Disability Insurance Act (Wet op de Disability) -Article 1 (6) of the Law on incapacity for the self-employed persons, Article 1, sixth paragraph, of the Disabled Persons Act and Article 1, sixth paragraph, of the Law of the Health ;
The Council of State heard (opinion of 17 December 1997, No W12.97.0732);
Having regard to the further report of the Secretary of State for Social Affairs and Employment of 18 December 1997, Directorate-General for Social Insurance, No SV/AVF/97/5412;
Have found good and understand:
For the purpose of this Decision:
a. ANW: General Survivors Act ;
b. AOW: General Old-age Law ;
c. IOAW: Income Provision of the elderly and partially unemployed unemployed workers ;
d. IOAZ: Law on income provision older and partly incapacitated self-employed workers ;
e. TW: Supplements Act ;
f. Wajong: Law on incapacity for work of young handicapped persons ;
g. WAO: Incapacity for work insurance ;
h. WAZ: Law for incapacity for the self-employed ;
i. WIA Act: Law employment and income to work ;
j. Wmo 2015: Social Support Act 2015 ;
k. ZW: Disease law ;
l. IOW: Income Provision of the older unemployed .
This Decision shall apply to registrations within the meaning of:
a. Article 3, fourth paragraph, part d, of the Participation Act ;
k. Article 1.1.2, fourth paragraph, part d, of the Wmo 2015 ;
1 As registrations as referred to in Article 2 shall be designated the registration as:
a. Sustainable joint household based on:
b. joint house conduct based on:
c. sustainable common household by virtue of the sub-section 3 of Section 5 of Title 4 of Book 7 of the Civil Code ;
d. common household by virtue of:
1. Inheritance law 1956 ;
2. a right of residence pursuant to the Aliens Act 2000 for staying with partner;
e. durable relationship based on the Dutch law on the Dutch landscape .
2 A registration as referred to in paragraph 1 shall be present during the period during which, when the laws referred to in that paragraph are applied, legal effects are at any time linked to the existence of a durable common household, a a common household, a sustainable common household, a common household and a sustainable relationship respectively.
For the application of Article 3, second to fifth paragraph, of the Act of Participation , Article 1, third to seventh member, of the AOW , Article 3, second to sixth paragraph, of the IOAW , Article 3, second to sixth paragraph, of IOAZ , Article 1, third to seventh member, of the TW , Article 1:1, third to the seventh member, of the Wajong , Article 1, third to seventh member, of WAO , Article 1, third to seventh member, of WAZ , Article 2, second to sixth paragraph, of the WIA Act , Article 1, third to seventh member, of the Wmo , Article 1, third to seventh member, of the ZW and Article 2, second to sixth paragraph, of the IUU A registration as referred to in Article 3 Taking into account if:
a. The application for assistance, payment or provision is made;
b. has existed at any time in a period of two years prior to the application for assistance, payment or provision; or
(c) during the provision of assistance, payment or provision.
For the purposes of applying Article 3 (2) to (6) of the ANW, a registration shall be established for the purposes of determining entitlement to survivor's benefit, as provided for in Article 3 (2). Article 3 Taking into account if:
a. It exists on the day of death of the person with whom a joint household is held or has existed at any time during the two-year period preceding this day;
b. takes place during the provision of survivor's benefit.
This Decision shall be based on: Article 3, fifth paragraph, of the Act of Participation and Article 2, sixth paragraph, of the IOW .
This Decision shall enter into force from the date on which Articles XVII to XXXII of the proposal of 29 September 1997 on the amendment of a number of social security legislation and some of the social security funds submitted by the Royal Message of 29 September 1997 are amended. other laws, amending or withdrawing the Law On Unemployment Uniform definition of the term joint housekeeping and technical and any other changes ( Livestock Law SZW 1997 ; Chamber pieces 25 641) enter into force.
