Having regard to the Articles 5d, 1st and 2nd Member , 5f, fourth member , 5g, third member , 7, third member , 9, second paragraph , 19a , 19b and 54 of the Law on the legal position of the judicial authorities , 14, fourth member , 16, first and sixth member , 25, second paragraph , 66, fifth and sixth Member States , 67, fifth and sixth members , 73, third member , Eighty-eighth Member , and 145 of the Law on the Judiciary , 3 of the Professional Law , 4 of the Corporate Administration Law governing body , 79, fourth paragraph, of the Seeds and Plant Law 2005 and 5a of the Military Staff Act 1931 ;

Having regard to the further report of our Minister of Security and Justice of 21 November 2012, No 325075;
Have found good and understand:
The persons to whom it is established on the day preceding the entry into force of this Decision to perform the duties of the Chief Officer of the District Office at Haarlem, the 's-Hertogenbosch' arrondissementsparquet, shall be the subject of the decision The district label in Zwolle-Lelystad and, on the other hand, received a salary of € 8412.44 or € 8685,54 per month, multiplied by the labour cost factor applicable to them, and for whom Article CXI, fourth paragraph, of the Law Review Judicial Card the appointment shall be amended by way of appointment as deputy chief judicial officer and shall be automatically determined to perform their duties in the district label for North Holland, the 'arrondissementsparket' (district). In the Netherlands, East Brabant received, by way of derogation from, the middle-Netherlands Article 5, first paragraph, of the Decision of the Court of Justice and the annex to that decision referred to in that Article, a salary of € 8685,54 per month, multiplied by the labour effect factor applicable to them, for as long as they are not the post of Deputy Chief Prosecutor at a parquet, the arrondissementsparket Amsterdam, The Hague, East-Netherlands or Rotterdam, the national parquet or the functional prosecutor.
Those for whom it was established on the day prior to the entry into force of this Decision to perform the post of senior councilor before the Court of Justice in Arnhem or Leeuwarden, the Hague-based court, The Court of Appeal, the ' s-Hertogenbosch Court, has been the Court of Appeal, the Central Board of Appeal, on the one hand, and on the Board of Appeal for the business community, and on that basis, by virtue of the Article V, fourth paragraph, of the Law amending the Law on Justice, the Law of the Judiciary and any other laws relating to the revision of the function and remuneration structure for judicial officers. receive a salary of € 8 412.44 or € 8 685.54 per month, multiplied by the labour effect factor applicable to them, received by derogation from Article 5, first paragraph, of the Decision of the Court of Justice and the annex to that decision referred to in that Article, a salary of € 8 685.54 per month, multiplied by the employment factor applicable to them, for as long as they fulfil the office of senior council member in a court of justice, the Central Council of Profession or the College van Beroep for business.
1 For the applicability of Article 16, first paragraph, fourth sentence, of the Law on Judicial Organisation shall be at the same salary level as chairman or other judicial member in the case of persons who, on the day prior to the date of entry into force of this Decision, are of the following: Article 1, fifth or sixth paragraph, of the Decision of the Legal Position of Members of the Court of Justice and of the Council for the Court of Justice As it was at the time, a salary of € 8 685.54 per month, multiplied by the labour cost factor applicable to them, means a salary level of € 8 685.54 per month, multiplied by the labour cost factor in force for them.
2 The first paragraph shall apply mutatis mutandis to persons who, on the day prior to the entry into force of this Decision, Article 16, first paragraph, of the Law on Judicial Organisation an allowance received equal to the difference between the salary of the person concerned in accordance with the provisions of the Article 7 of the Law on the legal position of judicial officers Enjoy and pay an amount of € 8 685.54 per month.
This Decision shall enter into force with effect from 1 January 2013 and shall work as Article III concerns back to and including 1 January 2011.
