Decision of 12 April 2003 implementing the Law on Integration Integrity Assessments by Public Administration (Decision BIBOB)

On the nomination of Our Minister of Internal Affairs and Kingdom Relations of 1 October 2002, no. EA2002/88934, Directorate-General for Public Order and Security, also on behalf of our Minister of Justice, in agreement with our Minister for Transport and Water State;
Having regard to the Article 1, second paragraph , 5, second paragraph , 7, second paragraph , 16, second paragraph , 27, first paragraph, part i, and fifth member , and 46 of the Promotion Integrity Assesss Act by the Public Administration ;
The Council of State heard (opinion of 28 November 2002, No W04.02.0448/I);
Having regard to the further report of Our Ministers of Internal Affairs and Kingdom Relations and of Justice of 27 March, nr. EA2003/55758, Directorate General of Public Order and Security, released in accordance with Our Minister of Transport and Water State;
Have found good and understand:
For the purpose of this Decision, the term "law" shall mean the Law promoting integrity assessments by the public administration .
As a legal person with a government function as referred to in Article 1, second paragraph, of the Act , the independent administrative bodies of the legal persons listed in the Annex to this Decision shall be designated.
As sectors as referred to in Article 5, second paragraph, of the Act The following shall be designated:
a. Construction,
b. Information and communication technologies; and
c. the environment.
The Office shall annually make the contribution to the costs of the opinion referred to in the Article 16 of the Act , which shall be based on:
a. the actual costs incurred by the Office for the processing of the application;
b. the number of applications submitted in the previous calendar year,
c. the expected total number of applications to be submitted in the current calendar year;
d. the expected number of applications to be submitted in the following calendar year.
As Governing Bodies as referred to in Article 27, first paragraph, part (i) of the Act The following shall be designated:
a. Our Minister of Security and Justice, as far as the files whose data are processed by the Central Judicial Incasso Office;
b. Our Minister of Infrastructure and the Environment, as far as the files for which the data are processed by the Environment and Transport Inspectorate, domains Transport;
c. the Environment and Transport Inspectorate, domains Transport;
d. Road Traffic.
1 The governing bodies referred to in Article 6 , and the governing bodies, mentioned in Article 27, first paragraph, of the Act , as well as the dishes specified in Article 27a of the Act , provide the information provided for in the introductory wording of Article 27, first paragraph, of the Act , within a period of two weeks from the request of the Office.
2 If the information cannot be supplied within a period of two weeks, the governing body concerned shall inform the Agency, indicating a period within which the information may be considered. That period shall not exceed two weeks after the end of the period mentioned in paragraph 1.
This Decision shall enter into force from the day following the date of issue of the Official Gazette, in which it is to be placed, with the exception of: Article 6 (b). and c. , which will enter into force at a time to be determined by royal decree.
This decision is referred to as: Bibob Decision.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
