Decision of 18 August 2004 on the designation of legal persons subject to Article 45 of the 2001 Comptability Law (designation of legal persons with limited cash management function)

On the nomination of our Minister of Finance of 12 July 2004, No BZ2004-648M, Directorate-General of the State Budget, the Budget Directorate;
Having regard to Article 45 of the Comptability Act 2001 ;
The Council of State heard (opinion of 29 July 2004, No W06.04.0349/IV);
Having regard to the further report of our Minister of Finance dated 13 August 2004, No BZ2004-733U, Directorate General of the State Budget, Directorate-General for Budgetary Affairs;
Have found good and understand:
'Legal persons' means: Article 45, first paragraph, of the Comptability Act 2001 , shall be designated by the legal persons included in the Annex A, Part 1 , which is part of this Decision.
'Legal persons' means: Article 45, second paragraph, of the Comptability Act 2001 , shall be designated by the legal persons included in the Annex B, Part 1 , which is part of this Decision.
'Legal persons' means: Article 45, third paragraph, of the Comptability Act 2001 , to which the provisions of Article 45, first paragraph , applicable, shall be designated by the legal persons included in the Annex A, Part 2 , which is part of this Decision.
1 Our Minister of Finance may, in agreement with Our Concern Ministers, provide other legal entities as intended Article 45, first and second paragraph, of the Comptability Act 2001 -To designate.
2 Our Minister of Finance may, in agreement with Our Concern Ministers, designate a legal person as intended Article 45, first and second paragraph, of the Comptability Act 2001 withdraw it from an efficient and risk-management treasury management point of view if it does not make any meaningful assessment of the management of such lists.
3 Of decisions referred to in paragraphs 1 and 2 shall be communicated in the Official Gazette.
1 Article 1 shall not be subject to cash for a period of six months from the date of entry into force of this Decision, which shall be expelled by a designated legal person outside the State Treasury after the date of entry into force of this Decision.
2 Article 1 shall not apply for a period of six months from the cash referred to in paragraph 1 for six months from which the eviction within the six-month period referred to in the first paragraph is to be added. for months, a designated legal person has been notified to our Minister in question, in order to agree on the period within which the legal person concerned will still be responsible for the means provided by the State Treasury.
3 Our Minister of Finance may extend the period of six months referred to in the second paragraph by a period to be determined by him.
4 Our Minister of Finance may reduce the periods of six months referred to in the first and second paragraphs for a separate legal person.
This Decision shall enter into force with effect from 1 September 2004. If the Official Journal of the State issuing this Decision is issued after 30 August 2004, it shall enter into force from the day following the issue of the Official Gazette, in which it is placed and shall operate back to 1 September 2004.
This Decision is cited as: Designation decree legal entities with a limited cash management function.
Charges and orders that this Decision will be placed in the Official Journal with the Annexes and with the corresponding note of explanatory note.
