In this regard, we considered that it would be desirable to make the procedure for the investigation of criminal cases, review cases, extradition cases and cases in the context of the proceedings before the Court of Justice. Law transfer enforcement of criminal judgments to amend a number of points in the interests of effective judicial justice;
In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:
Article I (A), (C) and (E) , except the Articles 438 , 440 and 443 does not apply to cases in which the documents of the proceedings have already entered the Registrar of the High Court at the time of entry into force of this Act. These matters shall be subject to the provisions applicable to the date of entry into force.
Article I (B) , does not apply in cases where, at the time of entry into force of this law, the court of first instance has already delivered the decision. These matters shall be subject to the provisions applicable to the date of entry into force.
Article I, part D , does not apply to applications for revision which have already entered the Registrar of the High Court at the date of entry into force of this Act. Those applications shall be cancelled in accordance with the provisions in force for the moment of entry into force.
Article II Except where reference is made to the Articles 438 and 443 , not applicable to extradition cases in which, at the time of entry into force of this law, the documents of the proceedings have already entered the Registrar of the High Court.
Article IV Except where reference is made to the Articles 438 and 443 , not to apply to cases relating to the transfer of criminal judgments which, at the time of entry into force of this law, have already entered the proceedings of the Registrar of the High Court.
This Act shall enter into force on a date to be determined by Royal Decree which may be made different for the various articles or parts of such articles.
Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
