Law of 28 April 2005 amending the Watershed Act and the Withdrawal of the Delta Act major rivers, the Delta Act, the Deltaschade Act, the Damage Oyster Growers Act, the Permitting Law Westerschelde, the Zuidersea Act and the ZuiderzeeAid Act

All of them, who will see or hear these, saluut! do know:

In this regard, we have taken into consideration that it is desirable to Law on the watercourse to amend the experience gained in implementing them, and to make provision for additional provisions in a number of points in the Act, and to repeal a number of laws which have been substantially elaborated;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:


Article I

Transmission of a report as referred to in Article 3, fifth paragraph, of the Law on Water Conversion , as this article reads after the entry into force of this Act, shall be made for the first time within three years of the entry into force of this Act.


Article III

The Delta law large rivers shall be withdrawn.


Article V

The ZuiderSea Law is repealed.


Article X

The ZuiderzeeAid Act shall be withdrawn.


Article XI

Article 12, first paragraph, of the Law on Water Conversion As it stated before the entry into force of this Act, it shall continue to apply in respect of decisions on contributions to the costs of carrying out new or reinforcing works in order to meet the costs of the first Safety standard specified in Article 3, first paragraph, of the Law on Water Conversion .

The Articles 17 to 31 of the Water Conversion Act As they stand before the entry into force of this Act, they shall continue to apply in respect of plans and related acts in respect of primary water conversions as referred to in Article 3 (2). Article 17 .


Article XIII

The Delta law continue to apply in respect of plans and related decisions relating to the works referred to in the Article 1, introductory wording and point II, of the Delta Act .


Article XIV

As regards the further treatment of appeals on the basis of the Deltaschade law which are pending at the date of entry into force of this Act, and with regard to decisions resulting therefrom, remain subject to the provisions of the Deltaschade law applicable.

The ZuiderzeeAid Act and the related Southern Sea Aid Decision 1976 continue to apply in respect of the person entitled to a pecunious concession under Article 13 of the ZuiderzeeAid Act .

Article 7 of the Watershed Law shall not apply to the construction or reinforcement of caden for the execution of the Maasworks project.


Article XVIII

This Law shall enter into force on a date to be determined by Royal Decree.

Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
