Law of 14 February 1998 amending the Law on Works Councils and Title 7.10 (employment contract) of the new Civil Code

In this regard, we considered that it is desirable to promote the effectiveness of participation in undertakings and to provide workers with protection against the unilateral change of working conditions and in relation to them. some changes in the Law on Works Councils and in the Civil Code should be applied;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

If, at the time of the entry into force of this Act, the conditions of employment of an employee are also determined by a regulation referred to in Article 613 of Book 7 of the Civil Code, as this Article has for that time, the (i) the provisions of the said Regulations are part of the contract of employment.

Works councils on the basis of Article 2 of the Law on Works Councils As it was stated before the entry into force of this Act, undertakings which generally operate under 50 persons shall continue to exist until the date of expiry of the current term of that Council, unless the economic operator is (ii) application of Article 5a (2) of the Act.

This Act shall enter into force from the day following the date of issuance of the Official Gazette in which it is placed.
