All of them, who will see or hear these, saluut! do know:

In this regard, we considered that it would be desirable to establish the remuneration structure for judicial officers, the corresponding staff members of the courts outside the courts and the judicial officers in training to be amended;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

As regards their remuneration, the Vice-Presidents of the courts appointed at the time of entry into force of this Law shall be equivalent to a coordinating Vice-President.


Article XIII

  • 1 The appointments of the Vice-Presidents of the Centrale Raad van Beroep, or the Vice-Presidents of the College of Appeal for business, appointed as such at the time of entry into force of this Act, shall be regarded as changed by way of appointment to vice-president.

  • As regards their remuneration, they shall be equivalent to a coordinating vice-president.

  • 1 The appointments of the President, the members and alternate members of the Central Board of Appeal appointed at the time of entry into force of this Act shall be amended by law in an appointment as President of the Board of Appeal, Mr President and Mr President-in-Office of the Central Board of Appeal.

  • 2 The appointments of the President, Members and alternate members of the College of Appeal for the business sector appointed as such at the time of entry into force of this Act shall be amended by law in an appointment to the President, Mr President and Mr President-in-Office of the College.

  • 1 If, as a result of this law, the salary or the maximum salary, of a judicial officer or an official in training is determined in an equal or higher amount, the application shall be made in accordance with the provisions of the law. (i) The salary category applicable retroactively to 1 June 1992, until the date of entry into service or the date of his successor, situated after 1 June 1992.

  • 2 For the purposes of application of paragraph 1, the chairmen of the boards of appeal shall be regarded as coordinating vice-president of a district court and the Vice-Presidents with a judge in a district court.

  • 3 The application shall be made on the salary amount enjoyed by the official or judicial officer in training on 1 June 1992, on the date of entry into service or the date of his successor after 1 June 1992; or, if that amount does not occur in the salary category applicable, to the next higher amount in that salary category.

  • 4 For the purposes of the third paragraph, the salary amounts to which the application is made shall be traced in accordance with the Annex to this Act.

Article XVI shall apply mutatis mutandis to judicial officers as referred to in Article 2 (2), second and third paragraphs, of the Law on the remuneration of judicial officers designated as such at the time of entry into force of this Act, and are hereby appointed as a judicial officer as referred to in Articles 1 and 1 in response to their appointment.   • 1 If, as a result of this law, the salary of an official or a judicial officer in training is determined by a higher amount and has been or is being paid to him during the period from 1 January 1992 to 31 December 1994, or he is, at the same time, an old-age pension or an invalidity pension or is granted a lump sum payment to him in respect of lost pension entitlements in accordance with rules to be made by a general provision of directors.

  • 2 If an official or judicial officer in training whose salary is fixed at a higher level as a result of this Law, has died or dies from 1 January 1992 to 31 December 1994, the Survivors ' rights to whom a pension or orphan's pension is or is granted, in respect of lost pension claims, has been granted a lump sum in accordance with rules to be set by a general rule of directors.

  • 3 If, as a result of this law, the salary of a judicial officer or a judicial officer in training to whom he has been dismissed in the period from 1 June 1991 to the day preceding the date of entry into force of this Law, and any person who, at the same time, has been granted an allowance under the voluntary early retirement benefit, has been determined on a higher amount, is to be paid to him in connection with lost pension claims and in relation to an understated pension benefit under the voluntary retirement benefit Act, a one-off benefit shall be granted in accordance with rules to be laid down by general management.

  • 4 If, as a result of this law, the salary of a judicial or judicial officer in training who has been given notice of resignation during the period from 1 June 1991 to 31 May 1992, and to whom, at the same time, a waiting or benefit on the basis of the 1966 benefit scheme is awarded, at a higher amount, is paid to him in connection with an underdetermined waiting or underdetermined payment on the basis of the 1966 benefit scheme a one-off benefit granted in accordance with rules to be set by a general management measure.

This Law shall enter into force on a date to be determined by Royal Decree.

Burdens and orders that are in the State Sheet will be placed, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
