In this regard, we considered that it would be desirable to end the financing by the Minister for Agriculture, Nature and Food Quality of agricultural innovation and practice centres and to make changes in the context of the Community's agricultural policy. In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:
1 Our Minister of Agriculture, Nature and Food Quality knows from the date of entry into force of this law to the legal persons of which the agricultural innovation and practice centres are based, in annual instalments for a maximum period of four years, the financial contribution to be determined.
2 The financial contribution referred to in paragraph 1 shall be composed of:
a. A contribution to the human costs; and
b. a transitional budget.
3 The contribution to the staff costs shall be borne by the legal persons from which the agricultural innovation and practice centres shall in any case be used:
a. Benefits arising from unemployment;
b. Benefits arising from incapacity for work;
c. outplacement; or
d. training courses.
4 The transitional budget is provided by the legal entities from which the agricultural innovation and practice centres are spent by our Minister of Agriculture, Nature and Food Quality to designate educational activities, which will in any case be free of charge. offered to:
a. Agricultural training centres;
b. Training communities as intended Article 2.6 of the Education and Vocational Education Act consisting of an agricultural training centre and a secondary school of general preparation education or consisting of a regional training centre and a school of preparatory and secondary vocational education in the agricultural sector;
c. training communities as referred to in Article 19 of the Law on secondary education with a department of agriculture and natural environment;
d. Schools of preparatory vocational education in the agricultural sector;
e. Higher Agricultural Training Courses;
f. Wageningen University;
g. the Faculty of Veterinary Medicine Utrecht, and
h. Foreign students.
5 Our Minister of Agriculture, Nature and Food Quality determines the amount of the transitional budget on the basis of the amount of the last determined national contribution to agricultural production until the entry into force of this draft law. innovation and practice centres, which will be built up to a value of EUR 0 in a maximum of 4 years.
6 Our Minister of Agriculture, Nature and Food Quality may attach further conditions to the provision of the financial contribution.
1 From the date of entry into force of this law, the management of the legal person from which an agricultural innovation and practice centre assumes in the annual accounts shall be accountable to our Minister for Agriculture, Nature and Food quality on the financial management of the agricultural innovation and field of business, in so far as the financial contribution is as set out in the Article IV . The annual accounts show that there is a legitimate use of the financial contribution. Lawful use only occurs when the goods in or on the ground of Article IV conditions.
2 The management of the legal person from which an agricultural innovation and practice centre is based is the annual financial statements for the year 1 July of the year following the financial year of our Minister for Agriculture, Nature and Food Quality.
3 The annual accounts shall be accompanied by a statement of fidelity and lawfulness issued by an auditor appointed by the Board as referred to in Article 393, 1st paragraph, of Book 2, of the Civil Code .
4 If the contribution to the human costs exceeds the actual costs incurred, or if the transitional budget exceeds the actual costs of taking care of the educational activities, the Legal person whose agricultural innovation and practices centre is the excess of the funds paid out shall not be reimbursed to our Minister for Agriculture, Nature and Agriculture later than one year after submission of the final annual accounts referred to in the preceding paragraph. This Law shall enter into force on a date to be determined by Royal Decree.
