Law of 26 January 2012 amending the Road Traffic Act 1994 and the Motor Vehicle Driving Law 1993 in connection with the implementation of the third driving licence directive

In this regard, we have taken into consideration that: Directive No 2006 /126/EC of the European Parliament and of the Council of the European Union of 20 December 2006 on driving licences (PbEU L 403) necessareses to amend the Road Traffic Act 1994 and the Motor Vehicle Driving Law 1993;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

  • 1 Article 110 of the Road Traffic Act 1994 as it was before the date of entry into force of the Article I, Section E , shall continue to apply in respect of drivers of motor vehicles:

    • a. to whom, for the time referred to in the introductory phrase, in accordance with the date until that date, at or under the Road Traffic Act 1994 A licence is issued for driving a vehicle of the category to which the driving is being driven;

    • (b) in respect of whom the decision to issue a driving licence for the driving of a vehicle of the category with which the driving is being driven has been taken for the time referred to in the introductory sentence;

    • (c) in respect of whom the decision to issue a driving licence for the driving of a vehicle of the category used has been taken on or after the time referred to in the introductory sentence, but the declaration of that category of The ability to drive that time has been recorded in the row designation registry.

  • 2 For the purposes of paragraph 1 (a), a driving licence shall be taken to mean a driving licence issued by the competent authority in another Member State of the European Union or in another State which is a party to the Agreement on the European Economic Area or Switzerland.

  • 1 Article 111, first paragraph, part a, of the Road Traffic Act 1994 as it was before the date of entry into force of the Article I, Section G , shall continue to apply in respect of applicants for driving licences:

    • a. to whom, for the time referred to in the introductory phrase, in accordance with the date to which it is at or under the Road Traffic Act 1994 has been issued a driving licence for one or more licence categories covered by the application, provided that such licence is either still valid or has lost its validity as a result of the expiry of the period of validity, or its validity has been lost on the basis of Article 123, first paragraph, part g or h, of the Road Traffic Act 1994 , either invalid or invalid on the basis of Article 124, first paragraph, part (e) of the Road Traffic Act 1994 .

    • (b) if the decision to issue the driving licence for the driving licence category or the driving licence categories to which the application relates has been taken for the time referred to in the introductory sentence;

    • (c) if the decision to issue the driving licence for driving licence or driving licence categories to which the application relates has been taken on or after the time referred to in the introductory sentence, but the relevant declaration or declarations of the driving licence or licence fee the time is or are registered in the row signage register.

Article 122, first paragraph, of the Road Traffic Act 1994 as it was before the date of entry into force of the Article I, Section I , shall continue to apply in respect of driving licences:

  • a. Those for the time referred to in the introductory phrase in accordance with the date up to that date at or under the Road Traffic Act 1994 have been issued rules;

  • (b) of which the issuing decision has been taken for the time referred to in the introductory paragraph;

  • c. in respect of driving licences issued after that date on the basis of Article 120 of the Road Traffic Act 1994 .

Certificates issued at the time of entry into force of Article II to empower the business of driving instruction within the meaning of the Motor vehicle driving law 1993 for driving licence categories A, C, E at C, D or E to D, respectively, remain valid until the period of validity specified on the licence and for the purpose of applying that law from that date onwards and until the expiry of the period of validity of the Certificate also the privileges of driving instruction for category A1, A2 and A, C1 and C, E at C1 and E at C, D1 and E for D1 and E in D respectively.

This Law shall enter into force on a date to be determined by Royal Decree, which may be adopted in a different way for the various articles or parts of such articles.

Burdens and orders that it will be placed in the Official Gazette and that all ministries, authorities, colleges and public servants who so far as to do so will keep their hands on the precise execution.
