In this regard, we have taken the view that it is in application of the judgment of the Court of Justice of the European Communities in Case C-299/02, the Commission of the European Communities ν Kingdom of the Netherlands, on the right to freedom of establishment as set out in Articles 43 and 48 of the EC Treaty, is necessary for the Civil Code, Code of Commerce , the Law nationality seagoing vessels in bareboat chartering , the Sea breeze Act and other laws to be amended;
In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:
In the case of a seagoing vessel, which is to be published at the time of entry into force of this Act, in the public registers referred to in Section 2 of Title 1 of Book 3 of the Civil Code , no later than 1 January 2007, Article 311 of the Code of Commerce .
This Act shall enter into force from the day following the date of issuance of the Official Gazette in which it is placed.
Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
