Law of 26 April 1995, revising the measure on the supervision of minors (Articles 254 et seq. of Book I of the Civil Code)

In this regard, we have taken into consideration that the measure of the surveillance of children, in particular as regards the powers of the child judge, the family guardian and the family custody institution, needs to be reviewed;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

A surveillance statement issued by the Children's Court on the date of entry into force of the Law shall apply as from that date as an under-supervision as provided for by this Law.


Article X

A family guardian appointed for the time of entry into force of the law, who is employed by a family custody institution, shall be deemed to be a member of or under the law of the institution from that date. Law on youth aid Family guardian appointed by this family guardianship institution.


Article XI

A family guardian appointed by the child judge, other than a family member of the family, shall be replaced by a family custody institution within three months of the entry into force of this Article by the child judge. Of the decision of the child courts, no provision shall be made.

  • 1 The entry into force of the Act does not result in the jurisdiction of the court before which proceedings have been previously held, nor for the nature of that case and for the remedies against the judgment.

  • 2 The preceding right shall continue to apply where the proceedings are referred to in the first paragraph.

  • 1 A designation for the entry into force of the law by the member of the family shall be valid from that date as a designation as referred to in Article 258 of Book 1 of the Civil Code.

  • 2 A decision of the judge on a dispute as referred to in paragraph 2 of Article 260 of the preceding right at first instance or appeal, subject to the applicable law in advance, shall be regarded as a designation in the form of a decision of the Court of First Instance of the Article 258, or as a revocation of a designation as referred to in Article 259 of Book 1 of the Civil Code.

This Law shall enter into force on a date to be determined by Royal Decree, except Article XI that enter into force on the day after the placement of this law in the State Sheet .
