Law of 22 December 1999 amending the Law of the Law and certain other laws relating to the exclusion of the right to a social security benefit in the case of freedom of freedom and the opening up of social security schemes in such cases in which the enforcement of a custodial sentence or detention order takes place outside a judicial establishment (Law on Social Security Rights and Detained Persons)

In this regard, we considered that it would be desirable to exclude persons legally deprived of their freedom from the right to benefit under certain social security laws, as they are already provided for by the State in the the cost of living, and to open up the right to benefit under certain social security laws to persons who have been deprived of their freedom of rights in those cases where they do not have their principal residence have within a judicial system;
In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:
With regard to a person whose freedom on the day prior to the entry into force of Article I of this Act It has already been deprived of legal status for the purposes of the application of the Article I, Section B Article 19b, first and fourth paragraph, of the Law of the Health Act, as the first day on which the release of liberty is held, marked the day of entry into force of the Law of the European Union. Article I of this Act and the Social Insurance Institute shall remain responsible until the date of its detention for one month, that the sickness benefit, in whole or in part, shall be granted to the persons, whose breadwinner shall be Article 42, second paragraph, of the Health Act As this article was stated on the day prior to the entry into force of Article I of this Act .
In the case of a person whose freedom had already been deprived of the law of the day prior to the entry into force of the articles of that law, the application of the legislation in question shall be applied in accordance with Article II, Part D , included Article 43 (5) of the Disability Insurance Act (Wet op de Disability) , the in Article III, Parts D and F , included Articles 19, 4th paragraph , and 22, 6th paragraph, of the Law on incapacity for the self-employed , it's in Article IV (C) , included Article 17 (5) of the Law on incapacity for work for the young handicapped , it's in Article VI Included Article 2, fifth paragraph, of the Toeslagenwet Respectively Article VII (B) , included Article 32d, first paragraph, of the General Survivors Law The date of entry into force of the first day of the release of liberty shall be deemed to be the first day of the day Article II, Part D , III Parts D and F , IV, part C , VI Respectively VII, part B, of this Act .
Our Minister of Justice shall, without delay after the date of entry into force of the Articles I , II , III , IV , VI or VII with regard to the person whose freedom had already been deprived of the rights of law on the day prior to the entry into force of the relevant Article and has been deprived of it on the date of entry into force of that Article, free of charge of the available information and of all other declarations and information which may affect respectively:
a. The right to sickness benefit on the basis of the Disease law ;
(b) the right to benefit from incapacity for work on the basis of the Incapacity for work insurance ;
(c) entitlement to incapacity benefit or the right to benefit in connection with childbirth on the basis of the Law for incapacity for the self-employed ;
d. the right to incapacity benefit on the basis of the Law on incapacity for work of young handicapped persons ;
e. the right to a surcharge on the basis of the Supplements Act ; or
f. entitlement to a survivor's benefit, the right to a half-orphan benefit or the right to an orphan's benefit on the basis of the General Survivors Act , to the Social Insurance Bank and the National Social Insurance Institute, where he may make use of the civil service number.
The Social Insurance Law is withdrawn.
The articles of this Law shall enter into force on a date to be determined by royal decree, which may be determined differently for the various articles or parts of such articles.
This law is cited as: Law on social security detainees.
Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
