Law of 18 July 2009 to merge the municipalities of Reiderland, Scheemda and Winschoten

In this regard, we have taken the view that the municipalities of Reiderland, Scheemda and Winschoten should be added together;
In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:
Starting from the date of reclassification, the municipalities of Reiderland, Scheemda and Winschoten are lifted.
From the date of reclassification, the new municipality of Oldambt is hereby established, consisting of the territory of the municipalities of Reiderland, Scheemda and Winschoten to be removed, as indicated in the relevant legislation. map .
For the new municipality of Oldambt, the municipality of Winschoten to be removed is designated for the application of Article 36 of the General Rules of Reclassification Law , in connection with the application of the instructions and regulations referred to in that Article .
For the municipalities of Reiderland and Scheemda and Winschoten, the new municipality of Oldambt is designated for the purposes of applying the following provisions of the General Rules Reclassification Act :
a. Article 39, second paragraph , in connection with the levying and recovery of municipal taxes;
b. Article 41, third paragraph , in relation to participation in common schemes;
c. Article 45, second paragraph , in relation to the transfer of rights and obligations related to the supply of drinking water, electricity and gas.
1 For the new municipality of Oldambt, an interim council election is as referred to in Article 52, second paragraph, part (a) of the General Rules of Reorder Law -
2 With the preparation of the by-election of the council, the municipality of Winschoten to be removed shall be taxed.
3 If the date of reclassification falls within two years before the date on which the regular elections for the members of the municipal councils due to the Electoral law must be held, these elections will not take place in the municipality set up by this law.
4 The term of office of the members of the Council of the new assembly shall end in the situation referred to in paragraph 3 with the term of office of the members of the councils of the other communes following the first elections to the Council of the European Union. This Act shall enter into force from the day following the date of issuance of the Official Gazette in which it is placed.
